A former lieutenant with the New Orleans Police Department (NOPD), was sentenced today for his role in a conspiracy to obstruct justice and for misprision of a felony, in connection with a federal investigation of two police-involved shootings that left two civilians dead and four others seriously wounded in the area of the Danziger Bridge in the days after Hurricane Katrina.

The 32-count superseding indictment, which was returned on Nov. 1, 2011, and unsealed today in the U.S. District Court for the District of Columbia, charges various defendants with taking part in a racketeering conspiracy, murder in aid of racketeering, kidnapping in aid of racketeering, assault with a deadly weapon in aid of racketeering and other offenses.

Tierra Environmental, owner Ronald Holmes and manager Stewart J. Roth have been charged with illegally discharging wastewater into the sewers of the Hammond Sanitary District from a closed facility.

Two individuals – a loan officer and a title agent – have been sentenced by U.S. District Court Judge William P. Dimitrouleas in Ft. Lauderdale, Fla., for their participation in a nationwide $2.5 million reverse mortgage fraud scheme.

"It is critical to continue our dialogue about how we can ensure a level playing field for all who are seeking economic opportunity and a fair chance at the American Dream," said Assistant Attorney General Perez.

"As we honor American Indian and Alaska Native Heritage month, we work to build on our continued progress strengthening tribal law enforcement," said Deputy Attorney General Cole.

The 10-count indictment returned today in U.S. District Court in Arizona charges Adalberto Valenzuela, 31, of Tucson, Ariz., with two counts of conspiracy, two counts of bribery, two counts of bribery involving programs receiving federal funds, two counts of Hobbs Act extortion under color of official right and two counts of possession with intent to distribute cocaine.

Federal officials announced a civil settlement with the state of California Department of Transportation (Caltrans) resolving claims brought by the Presidio Trust and the U.S. Army resulting from Caltrans’ construction and operation of Highway 1 (also known as Park Presidio Boulevard) through the Presidio of San Francisco.

Aaron Ford, 22, aka “.40 Cal.,” pleaded guilty on July 12, 2011, to one count of conspiracy to engage in a racketeering enterprise before Senior U.S. District Judge Gustave Diamond.

"We believe that enacting the SAVE Act will strengthen tribal jurisdiction over crimes of domestic violence, tribal protection orders, and Federal assault prosecutions," said Associate Attorney General Perrelli.

The agreement represents approximately 20 percent of the estimated $37.5 million in forfeited assets located in the Dominican Republic that stem from a conspiracy led by brothers Carlos, Luis and Jose Benitez, who allegedly defrauded the U.S. Medicare program of approximately $80 million.

The seven-count indictment alleges that Michael Moore, 44, of Chadds Ford, Penn., infringed the copyright protected works during seven six-month periods between May 2006 and June 2010.

"Sentencing and corrections policy affects everyone in society, and I am confident that the more people are thinking about it, the easier it will prove to arrive at solutions," said Assistant Attorney General Breuer.

Former Tuscaloosa, Ala., Sheriff’s Sergeant, Althea Mallisham, 52, pleaded guilty today in a federal court in Birmingham, Ala., to three counts of assault with a dangerous weapon while acting under color of law for wrongfully using a Taser during three separate incidents over a four month period in 2008.

Ramchand Ramrup, aka Ramy Ramrup, 35, pleaded guilty before U.S. District Judge Marcia G. Cooke in Miami to one count of conspiracy to commit health care fraud.

The Justice Department today filed a lawsuit against the owners and managers of 23 rental homes in Magee, Miss., for violating the Fair Housing Act by discriminating against families with children.

Marion Beverly Metoyer, 57, of Dayton, Texas, was sentenced by U.S. District Judge Gray Miller in the Southern District of Texas. Metoyer was convicted by a jury on May 26, 2011, of one count of conspiracy to commit health care fraud, three counts of health care fraud, one count of conspiracy to defraud the United States and to receive health care kickbacks and two counts of receiving kickbacks.

"Today, I met with the Mayor, Acting Police Chief and City Manager to notify them of our civil investigation into allegations involving the use of excessive deadly force by officers with the City of Miami Police Department," said Assitant Attorney General Perez.

The 15-count third superseding indictment returned by the federal grand jury on Nov. 16, 2011, and unsealed today in Hammond includes 15 new defendants who are charged with conspiracy to engage in racketeering activity from August 1989 until the date of the third superseding indictment.

A federal judge in Arizona has held Mesa, Ariz.-based Business Recovery Services (BRS) and its owner, Brian Hessler, in civil contempt of court for violating the terms of a preliminary injunction.

The Department of Justice today challenged Utah’s immigration law, which comes after recent lawsuits in Arizona, Alabama and South Carolina.

The United States has filed suit against Sonkei Communications Inc., and its principal corporate officers, Peter Turpel and Joseph Turpel.

Attorney General Eric Holder’s National Task Force on Children Exposed to Violence convened its first of four public hearings to gather expert and community testimony on the epidemic of children’s exposure to violence.

The violations include unpermitted discharges of stormwater and failure to comply with stormwater permits at 21 stone, gravel, sand, asphalt and ready-mix concrete facilities in Alabama, Colorado, Georgia, Maryland and New York.

A federal jury today convicted Danilo Velasquez, aka “Triste,” a local leader of La Mara Salvatrucha, or MS-13, in federal court in San Francisco of racketeering conspiracy and related charges.

Acting Assistant Attorney General Sharis Pozen of the Department of Justice’s Antitrust Division and Federal Trade Commission (FTC) Chairman Jon Leibowitz today met with a delegation from China’s Ministry of Commerce (MOFCOM) to discuss antitrust merger enforcement.

A former executive of a Peruvian airline pleaded guilty today for his role in a conspiracy to fix surcharges on air cargo shipments from the United States to South and Central America following Hurricanes Katrina and Rita.

William A. Herder of Mifflin Township, Ohio, was arrested today on federal tax charges.

A former New Orleans Police Department (NOPD) officer was sentenced today to serve five years in prison for his role in covering up a police-involved shooting that occurred on the Danziger Bridge in the days after Hurricane Katrina.

"Since the beginning of their tenure, President Obama and Attorney General Holder have repeatedly made clear their commitment to robust civil rights enforcement that is vigorous, fair, and evenhanded," said Assistant Attorney General Perez.

John Oliver Manning, aka “Fish,” 52, of Pasadena, Texas, was charged by a federal grand jury on Mar. 17, 2011, with violent crimes in aid of racketeering activity.

Antonio C. Martinez Jr., 40, a former Chicago police officer, pleaded guilty today to racketeering conspiracy and related charges, announced Assistant Attorney General Lanny A. Breuer of the Justice Department’s Criminal Division and U.S. Attorney David Capp of the Northern District of Indiana.

"Over the last two days, I’ve had the opportunity to work alongside Ambassador Rivkin, and with my French counterparts – and our fellow G-6 ministers – in discussing the shared concerns, goals, and priorities that bind our nations to one another, and to our allies across Europe," said Attorney General Holder.

Sanjay Anandani, 34, of Clinton, N.J., was arrested on Dec. 1, 2011, in Secaucus, N.J., and made his initial appearance before U.S. Magistrate Judge Robert M. Levy in the Eastern District of New York. Rohit Rohit, 28, of Edgewater, N.J., surrendered to authorities on Dec. 2, 2011, and made his initial appearance before U.S. Magistrate Judge Cheryl L. Pollack in the Eastern District of New York.

“The indictment unsealed today alleges a pattern of violent criminal activity by Latin Kings members in North Carolina,” said Assistant Attorney General Breuer.
