Presidential Candidate Visits To CA And NV And The Individual Mandate

With the Nevada caucuses in February and California now a Super Tuesday state, the visits of presidential candidates are increasing in frequency. Just yesterday, former New York City Mayor Michael Bloomberg was in Stockton and San Francisco. Bloomberg’s San Francisco appearance was with former California Gov. Jerry Brown.

CapRadio’s Scott Rodd spoke with Bloomberg in Stockton, and CapRadio’s Bert Johnson had an interview with Warren in Reno. They fill us in on the visits and what the candidates had to say.

We’ll also explore California’s individual mandate for health insurance coverage with CapRadio’s Health Care Reporter Sammy Caiola.

CapChat: Santa Anita Horse Deaths / Uber Pilots New Pricing / State Of The State

Today’s CapChat looks at three current issues. 

First, with horse death investigations underway at Santa Anita Park, three more deaths have occurred in recent days. Since December 2018, there have been a total of 42 deaths at the park. California Gov. Gavin Newsom signed a law in June of 2019 allowing the state to suspend horse racing at tracks with dangerous conditions. That has, as yet, not happened at Santa Anita.

Next, in a new pilot program, Uber is giving some of its driving contractors more control by letting them set their own rates. Drivers at the Sacramento, Palm Springs and Santa Barbara airports can increase rates in ten percent increments, with a cap. Depending on results, Uber could expand this to other airports. This is an effort to clarify that Uber drivers are independent, not employees, since the implementation of AB 5 on Jan. 1, 2020.

Third, with the impeachment trial underway in the U.S. Senate, the date of President Donald Trump’s State of the Union somewhat uncertain, Newsom has yet to set a date for his own annual State of the State address.

A new rent control ballot measure would permit local governments establish rent control on buildings over 15 years old and allow landlords to raise rents by no more than 15 percent every three years. This new initiative mirrors one that failed in 2018.

The move to unionize child care workers: there was a rally yesterday at the Capitol where workers delivered over 8,000 union cards. This number of cards qualifies workers to hold an election to form a union. Their union would allow collective bargaining with the state for health care benefits and funding for training, as well as the ability to negotiate wages.

Reversed and remanded, in this case involving a fishing vessel crew member's personal injury claim.

Salgado v. Carrows Restaurants Inc.

(California Court of Appeal) - Addressed whether an arbitration agreement could be enforced, given that it was signed only after the employee filed her employment discrimination lawsuit. Reversed and remanded for further findings.

(United States Fifth Circuit) - Held that insurers that paid a claim arising from the failure of a floating oil-drilling platform could not proceed with a subrogation claim against an engineering firm that helped secure the platform to the ocean floor. Also addressed an arbitrability issue. Affirmed a dismissal.

(California Court of Appeal) - Remanded for a redetermination of whether an arbitration agreement covered a dispute between a school and a consulting firm. Reversed an order denying arbitration.

Stemcor USA Inc. v. Cia Siderurgica do Para Cosipar

(United States Fifth Circuit) - On rehearing of a dispute between two creditors, held that Louisiana's non-resident attachment statute allows for attachment in aid of arbitration. Further held that subject matter jurisdiction existed here under the Convention on the Recognition and Enforcement of Foreign Arbitral Awards. Vacated and remanded.

Valentine v. Plum Healthcare Group, LLC.

(California Court of Appeal) - Affirmed order denying petition to compel arbitration. Plaintiffs attempted to enforce arbitration in an action for elder abuse and wrongful death at a skilled nursing facility. The trial court determined that the successor in interest was bound by the agreement to arbitrate, but the children of the decedent were not so bound. The trial court denied the petition to arbitrate to prevent inconsistent findings if both arbitration and litigation proceeded concurrently. The appeals court agreed.

Lacayo v. Catalina Restaurant Group Inc.

(California Court of Appeal) - Dismissed part of appeal and affirmed part. Plaintiff filed a class action complaint against Defendant alleging wage and hour violations and a unfair competition law claim (UCL). Defendants sought to compel arbitration. The trial court granted Defendant’s motion as to Plaintiffs individual claims, allowed the arbitrator to decide the class action claims, and denied the motion as to the UCL claim. The appeals court found that the motion that granted arbitration could not be appealed and found no error in the denial of arbitration for the UCL claim.

Lopez v. Bartlett Care Center, LLC

(California Court of Appeal) - Affirmed. Defendant, a skilled nursing facility, appealed an order denying its petition to compel arbitration for claims of negligent, elder abuse and wrongful death. The trial court found that the claims were not arbitratable because there was no arbitration agreement between Defendant and the decedent.

Why Pastors Don't Get Political

Pastors often loathe to weigh in on controversial topics. There are reasons.

I have never considered myself a very political person. As a proudly evangelical pastor, for a long time I possessed a somewhat bemused and distant attitude towards politics, focusing my attention instead on my calling to teach and preach the Word, which was above all worldly concerns. But that changed a few years ago. After my wife was diagnosed with breast cancer, and our insurance company tried to terminate her coverage using the dreaded “pre-existing condition” clause, I became a vocal advocate for health care reform. Shortly after that, as a resident of a city wracked with racial tensions, I timidly called for greater understanding between Korean and African-American communities.

These brief forays into the public sphere have taught me a lot, and have given me a lot more compassion on the plight of pastors. Evangelical pastors are often lambasted for their lack of engagement with society and politics. We accuse evangelical leaders of being too passive and silent on the most pressing issues of the day, and wonder if this is due to a lack of conviction, or a lack of courage. We call them cowards, dinosaurs, unbiblical, irrelevant. And I hate to admit that I have often joined that chorus of criticism. But the truth is not nearly so simple. Although I don't seek to totally exonerate myself from wrongdoing, here are five reasons why I personally hesitate to speak out on controversial issues:
