Four individuals were charged in court documents unsealed today in the Eastern District of Michigan for their participation in a Medicare fraud scheme involving home health services.

Three defendants pleaded guilty today to charges of conspiracy, smuggling, Lacey Act violations, money laundering and tax fraud for their roles in the international illegal trafficking of rhinoceros horn. All of the defendants were charged in February 2012 as part of “Operation Crash,” a nationwide U.S. Fish and Wildlife Service crackdown on those involved in the black market trade of endangered rhinoceros horn.

"Together, we can create atmospheres of tolerance, climates of trust, environments both virtual and real where people young and old can feel welcome to be who they truly are," said Assistant Attorney General Perez.

David James Garrison, 50, was sentenced by U.S. District Judge Consuelo B. Marshall in the Central District of California.

A Japanese freight forwarding company has agreed to plead guilty and to pay a $2.3 million criminal fine for its role in a conspiracy to fix certain fees in connection with the provision of freight forwarding services for air cargo shipments from Japan to the United States.

Five individuals were charged in court documents unsealed today in the Eastern District of Michigan for their participation in a Medicare fraud scheme involving purported home health and psychotherapy services.

A jury in Cleveland today convicted 16 people, all residents of Ohio, of federal hate crimes arising out of a series of religiously-motivated assaults on practitioners of the Amish religion, the Justice Department announced.

According to a criminal complaint unsealed today in U.S. District Court in Detroit, Dr. Hicham Elhorr, 45, masterminded a $40 million scheme involving the submission of fraudulent claims submitted to Medicare for services that were medically unnecessary and/or never provided through House Calls Physicians (HCP), a physician home visiting service he owned and operated.

"Protecting the American people from financial fraud crimes – and safeguarding the most vulnerable members of society – is, and will remain, a Justice Department priority," said Attorney General Holder.

"As we carry our efforts into the future, there’s no question that we’ll keep relying on organizations like the CBCF to help extend fundamental protections – and to encourage broad-based engagement – on a host of issues of national concern and consequence," said Attorney General Holder.

San Antonio-based Biglari Holdings Inc. will pay an $850,000 civil penalty to settle charges that it violated premerger reporting and waiting requirements when it acquired Cracker Barrel voting securities.

The Justice Department announced today that it has filed a Fair Housing Act lawsuit against the owners and manager of approximately two dozen rental homes in Washington, N,C., alleging that the manager, William I. Cochran III, discriminated against African-American tenants.

"We at the U.S. Department of Justice, want to do all that we can to protect American businesses against criminals who seek to steal and illegally profit from your creativity and innovation," said Deputy Attorney General Cole.

Van Thu Tran was sentenced today in San Diego to 36 months in prison for her role in a scheme to cheat casinos across the country out of millions of dollars.

"With today’s announcement – which opens this process to the general public, and which should allow approximately 1,000 children to be screened, assessed, and – if necessary – treated each month – I am confident that we can continue to extend the momentum that’s been established here in Cleveland," said Attorney General Holder.

"In so many different ways, this organization – along with its ever-expanding network of partners – has been instrumental in improving lives and bringing positive change to communities across this city," said Attorney General Holder.

"That’s why today’s Justice Department is determined – and I am determined – to meet acts of senseless violence with renewed vigilance. It’s also why we’re striving to promote innovative, evidence-based strategies, programs, and information-sharing tools that can help us to analyze and address specific types of threats," said Attorney General Holder.

The Residential Mortgage Backed Securities Working Group members today announced their first legal action since the working group formation earlier this year.

"While the Task Force’s goals are ambitious, its foundation is simple: Those in all levels of the government charged with protecting the public from fraud and abuse cannot work in compartmentalized silos. Instead, we must be cohesive, coordinated, and committed to a common purpose, because working together, we can achieve more than we can separately," said Acting Associate Attorney General West.

Attorney General Eric Holder, Deputy Attorney General James Cole, U.S. Attorney for the District of Maryland Rod Rosenstein, and Bureau of Justice Assistance Deputy Director, Kristen Mahoney, today announced more than $2.4 million in grants to 13 jurisdictions to combat the purchase and sale of counterfeit and pirated products. Intellectual Property theft refers to the violation of criminal laws that protect copyrights, patents, trademarks, other forms of intellectual property and trade secrets, both in the United States and abroad.

Demetrio Juan Gonzales, 40, a former corrections officer at the Bernalillo County Metropolitan Detention Center (MDC) in Albuquerque, N.M., pleaded guilty today to one count of violating the civil rights of an individual in his custody when he struck and choked the victim in the shower room/dress out area of MDC.

"No one program can solve all the challenges our communities face, but programs such as CityLIFT that provide families access to sustainable homeownership are critical," said Assistant Attorney General Perez.

"Imitation may be the highest form of flattery, but American industry is not looking to be flattered by thieves engaged in illicit competition. Industry seeks a fair and level marketplace where American innovation can thrive," said Deputy Attorney General Cole.

"Although these awards will be utilized in a variety of ways, they will help to achieve our common goals: to advance prosecutions – as well as prevention and education activities – related to IP theft," said Attorney General Holder.

Medicare Fraud Strike Force operations in seven cities have led to charges against 91 individuals – including doctors, nurses and other licensed medical professionals – for their alleged participation in Medicare fraud schemes involving approximately $429.2 million in false billing.

"It’s a privilege to welcome so many friends, colleagues, and key Justice Department leaders to this morning’s important program. And it’s a pleasure to join each of you in highlighting – and paying tribute to – the extraordinary contributions that so many Hispanic Americans have made in guiding our nation’s progress – and strengthening this Department’s essential work," said Attorney General Holder.

"We have made it one of our missions at the Department of Justice to hold accountable those who abuse the Medicare program for personal profit. And there are Medicare fraudsters in prisons across the country – some who will be there for decades – who can attest to our determination and our effectiveness," said Assistant Attorney General Breuer.

"Over the last 24 hours, Medicare Fraud Strike Force operations in seven different cities have conducted one of the largest health care fraud takedowns on record. Through a series of coordinated, nationwide law enforcement actions, charges have been brought against 91 individuals – including doctors, nurses, and other licensed medical professionals – for their alleged participation in fraud schemes involving nearly $430 million in false billings," said Attorney General Holder.

A Los Angeles medical equipment supplier, who submitted almost $1 million in false claims to Medicare for expensive, high-end power wheelchairs, was sentenced today to serve 30 months in prison.

A U.S. Customs and Border Protection (CBP) Officer, his girlfriend and an associate have been charged in Brownsville, Texas, for engaging in a multi-year bribery and alien smuggling operation along the U.S./Mexico.

"Several years ago, our Office for Victims of Crime funded the Clery Center to develop a training curriculum for university administrators and law enforcement executives about the requirements of the Clery Act. The Center continues to deliver the training throughout the country," said Acting Assistant Attorney General Leary.

"Put simply, these comprehensive efforts represent an historic, government-wide commitment to eradicating mortgage fraud and related offenses across the country," said Attorney General Holder.

The Justice Department today filed a lawsuit against the homeowners association and former manager of a 249-townhome community in Gibsonton, Fla., for violating the Fair Housing Act by discriminating against families with children.
