An analysis of SC judgments in Veluswamy case [AIR 2011 SC 479] and IndraSarma case [AIR 2014 SC 309] reveals that not all live-in relationships are to be deemed as a “relationship in the nature of marriage” u/s 2(f) of the DV Act. The wider interpretation of the term is aimed at welfare of unmarried women in live-in relationships who are left estranged or abused; but not at promoting adulterous relationships. The benefits provided under the Act are to be interpreted harmoniously, not violating penal provisions of adultery. Since, the applicant admitted the existence of her first marriage, negating the possibility of a legal marriage between the two contesting parties, revision was dismissed stating no “domestic relationship” subsists between them.

Although the main body of Section 2(q) expressly states that a respondent is an “adult male person”, the proviso widens the scope of proceedings by stating that an aggrieved wife or female living in a relationship in the nature of marriage can file a complaint against a relative of her husband/male partner. This rescinds the argument that the legislative intent was to exclude females. The Appeal was allowed with a direction to the Trial Courts to consider R2 and R3 as respondents in the proceedings.

The Division of Public Health is continuing its efforts to encourage former residents and employees of the ManorCare Health Services Foulk Road facility in Wilmington, between January and September 2017, to be tested for tuberculosis (TB). DPH opened a call center on Tuesday, May 29, 2018, to follow up with individuals who had been sent a letter and answer any questions, as well as to field questions from the public. As the number of incoming calls has decreased significantly since the opening, DPH is announcing that the call center will cease operations at 4:00 p.m., Friday, June 1, 2018.

The Division of Public Health (DPH) will host a two-day, exercise on Tuesday, June 19, and Wednesday, June 20, at Sussex Central High School, Georgetown. The Division of Public Health (DPH) is reporting the first flu-related deaths of the 2018-2019 flu season. A 65-year-old man who was infected with Influenza A passed away last week, making him the first person to die due to flu complications this season. In addition, a 73-year-old man and a 77-year-old woman, both also infected with Influenza A, passed away within the last week. All three individuals were Sussex County residents and all had underlying health conditions.

The Delaware Division of Public Health (DPH) is reporting the state’s first laboratory-confirmed cases of influenza in Kent and Sussex counties, for the 2019-2020 flu season. The Kent County case involves a 26-year-old female, while the Sussex County case involves a 7-year-old male. This brings the total number of flu cases this season to three. The first confirmed flu case for New Castle County was announced last week.
