The U.S. Energy Information Administration (EIA) expects most U.S. households, on average, will pay about the same to heat their homes as they did last winter. A notable exception is that EIA expects Midwestern homes heated by natural gas will pay about 11% more on average for heat than last winter.

Average U.S. nuclear capacity outages during the summer of 2024 (June 1 through August 31) decreased to about 2.6 gigawatts (GW) per day from 3.1 GW in 2023, similar to average summer daily outages in 2022. Outages this past summer were highest in mid-July and early August, averaging 3.1 GW per day and peaking at 5.7 GW on the last day of August. 01. Petitioner through the medium of this petition filed under Article 226 of the Constitution of India seeks following reliefs:-

(i) Writ of mandamus commanding the respondents particularly respondent No. 3 to hand over the physical possession of plot No. 288/15 Sector-C measuring 44'x60' at Sainik Colony Jammu to the petitioner by executing all necessary documents.

(ii) The respondent No. 3 be further directed to extend the period of 05 years as stipulated in condition No. 4 of the perpetual lease deed dated 18/07/1994 for raising constructions.

01. Petitioner through the medium of this petition filed under Article 226 of the Constitution of India seeks for the following reliefs:-

i) Commanding upon the respondents to allow the petitioner to work as Lambardar in view of his appointment vide order No. 145-47/TBG Auth dated 07.07.2022 and also in view of the J&K Lambardari Act, 1972 and J&K Lambardari Rules, 1980 till general elections are held.

ii) Commanding upon the respondents to confirm the appointment of the petitioner in accordance with the J&K Lambardari Act and Lambardari Rules.

1. The petitioners have sought a direction upon respondent No. 3 to issue passports in their favour.

2. According to the petitioners, they had applied for passports after depositing the requisite fee. The application of the petitioner was allotted file number JM1066761201422 whereas, application of petitioner No. 2 was allotted file number JM1066765476422, whereafter, the said applications were forwarded to respondent No. 2 for verification. The applications were submitted by the petitioners on 11.08.2022 and 12.08.2022 but despite lapse of so many years, the respondents have not taken any action in the matter which has compelled the petitioners to approach this Court.

3. The petitioner has been arrested in a case arising out of the Crime No. 15/2024 for the commission of offences under Sections 8/21/22/29 NDPS Act. As per case of the prosecution, commercial quantity of contraband drugs was recovered from the possession of the petitioner on 27.08.2024 when he along with co-accused was travelling in a bus. The investigation is stated to be still in progress.

This Letters Patent Appeal1 is directed against the judgment rendered by the learned Single Judge on 19 February 2013 in terms of which an Award rendered by the Industrial Tribunal2 has come to be upheld. In terms of the Award dated 05 October 2005, the petitioner- appellant was directed to frame a policy of regularisation in respect of the respondent workmen. Both the Tribunal as well as the learned LPA Tribunal Single Judge have essentially held against the appellant on the ground that the engagement of the respondent-workmen through a contractor was merely a ruse to overcome the obligations which would have stood attached in case it were to be recognized to be the principal employer.

According to the petitioner, taking cognizance of the offence against the petitioner by the learned Court of Metropolitan Magistrate, 15 th at Calcutta, West Bengal on the basis of the complaint of the respondent No.1 is without jurisdiction and bad in law.

2. The Petitioner is the State Bank of India represented by its Branch Manager at their Zonal Office, Trichirappalli. Aggrieved by the common award passed by the First Respondent Central Government Industrial Tribunal (CGIT) at Chennai made in I.D.No.22 to 25 of 2007 dt. 27.7.2010 these writ petitions were filed by them.

3. The 1st Respondent CGIT by its Common Award granted the following relief to the 2nd Respondent workmen in all the WPs:-

“In the result all the petitioners in ID 22/2007, 23/2007, 24/2007 and ID 25/2007 are entitled to be reinstated into service forthwith with continuity of service and all attendant benefits but they are not entitled to back-wages for the whole period during which they remained out of employment of Respondent. After reinstatement into service the Management may start a process for the regularization of the workmen if and in accordance with the rules in vogue they are entitled to the same.”

This writ petition has been filed challenging the order, dated 18.02.2000 passed by the Respondent No.2, dismissing the petitioner from service and the order dated 27.06.2003 passed by the Respondent No.1 on an appeal filed by the petitioner, confirming the punishment of dismissal from service in the year 2013 and seeking a consequential relief to reinstate the petitioner into service.

2. The brief facts that are relevant for disposal of this writ petition are as under:-

2.1. The petitioner herein, while working as a 'Peon' in Rasipuram Branch of the respondent Bank, Salem Division, he was subjected to departmental proceedings by issuing a charge-sheet dated 21.06.1997 containing two charges. The said charges reads as under:-

The Bank of Madura was amalgamated with the 1st respondent Bank under the Scheme of amalgamation sanctioned by the Reserve Bank of India with effect from 10.03.2001.
