Robert P. Merz was sentenced to life in prison today for advertising, transporting, receiving and possessing child pornography.

The Department announced that four men who committed three hate crime assaults in response to President Barack Obama’s election victory were sentenced today by U.S. District Judge Carol B. Amon in federal court in Brooklyn, N.Y.

Thomas Raffanello, a former global director of security at the Fort Lauderdale, Fla., office of Stanford Financial Group (SFG), has been charged today in a three-count superseding indictment with conspiracy to obstruct a U.S. Securities and Exchange Commission (SEC) proceeding and to destroy documents in a federal investigation; obstruction of a proceeding before the SEC; and destruction of records in a federal investigation.

An international computer hacker pleaded guilty today to multiple charges relating to hacking activity and credit card fraud. More than 40 million credit and debit card numbers were stolen from major U.S. retailers as a result of the hacking activity. Albert Gonzalez, 28, of Miami, pleaded guilty today to 19 counts of conspiracy, computer fraud, wire fraud, access device fraud and aggravated identity theft relating to hacks into numerous major U.S. retailers.

A Newark grand jury indicted three individuals for their participation in fraud and kickback conspiracies related to contracts at a U.S. Environmental Protection Agency (EPA)-designated Superfund site, Federal Creosote, located in Manville, N.J.

A federal judge in San Francisco has issued permanent injunctions barring four individuals from promoting what a government lawsuit describes as a complex tax-fraud scheme involving several entities located around the globe.

A federal grand jury in Miami returned a three-count indictment on Sept. 11, 2009, charging former Dade Correctional Institution (DCI) officers Cordell J. White and Christopher W. Bonnet, current DCI Sergeant Obe D. L’Bert, and former DCI inmate Larry T. Williams with violating, and conspiring to violate, the civil rights of other inmates at DCI.

The former superintendent of a wastewater treatment facility in Rochester, Ind., was sentenced today in U.S. District Court in South Bend, Ind., to serve one year in prison for falsifying discharge monitoring reports that concealed violations of the Clean Water Act.

Timothy L. Lantz was sentenced today to 15 years in prison for transporting child pornography in interstate commerce and failing to update his sex offender registration in violation of the Adam Walsh Act.

Odell Folks, of Brooklyn, N.Y., was sentenced to prison today by District Judge Carol Bagley Amon of the Eastern District of New York for his participation in a false tax return scheme. Folks, who pleaded guilty in March 2009 to mail fraud, a false claims conspiracy, and making and subscribing a false return, was sentenced to 77 months in prison and ordered to pay restitution of $489,292.

Teresa Vogt, a resident of Anaheim, Calif., pleaded guilty on Sept. 15, 2009, to one count of obstruction of justice before U.S. District Court Judge Dale S. Fischer in Los Angeles. Vogt and eight co-defendants were indicted in May 2005 on tax fraud, conspiracy, money laundering and other charges related to the operation of the Genesis Fund.

James A. Mattatall, of Torrance, Calif., was convicted Tuesday of criminal contempt by a federal district court in Los Angeles. Mattatall’s conviction relates to his violations of a 2004 permanent injunction that barred him from preparing tax returns for others and representing persons before the IRS.

Patrick Cochran, 47, of Lake Jackson, Texas, was sentenced late on Monday in Phoenix to 76 months in prison for travel with intent to engage in sex with minors and possession of child pornography.

Four owners of Costa Rica-based telemarketing call centers, an employee and a Texas-based list broker have been sentenced for their roles in defrauding thousands of U.S. victims of more than $20 million through a phony sweepstakes scheme.

Najibullah Zazi has been indicted on a charge of conspiracy to use weapons of mass destruction (explosive bombs) against persons or property in the United States.

Beverly Masek was sentenced today to six months in prison.

Hosam Maher Husein Smadi, 19, has been arrested and charged in a federal criminal complaint with attempting to use a weapon of mass destruction.

Former Choctaw County, Okla., deputy sheriff Ben Westley Milner was found guilty today by a federal jury in Muskogee, Okla., of violating the civil rights of three men by assaulting them without legal justification. In one incident, which took place on Oct. 31, 2005, defendant Milner physically abused a truck driver following a traffic stop.

Eli Goldshor of Boca Raton, Fla.,was sentenced today for conspiracy to commit securities fraud and willfully failing to file tax returns. Goldshor, a self-employed limousine driver, was sentenced by Judge William Zloch in Ft. Lauderdale, Fla., to 18 months in prison.

James Wilbur Fondren Jr., was convicted by a federal jury today on charges involving providing classified information to a man working with the People’s Republic of China (PRC) and lying to the FBI about it.

Joseph Hirko, former co-chief executive officer of Enron Broadband Services (EBS), Enron’s failed telecommunications business, was sentenced today to 16 months in prison.

The Department’s complaint alleges that Massachusetts and the MDOC are using an unlawful physical abilities test (PAT) that disproportionately screens out female applicants for entry-level correctional officer jobs.

Formosa Plastics Corp., Texas, and Formosa Plastics Corp., Louisiana, will spend more than $10 million on pollution controls to address air, water, and hazardous waste violations at two petrochemical plants in Point Comfort, Texas, and Baton Rouge, La.

Daniel Earl Danforth, 30, of Minden, La., has been indicted by a federal grand jury for hate crime violations and obstruction of justice charges stemming from a cross-burning in Athens, La., last year near the home of an interracial couple. Danforth was arrested today following the return of the indictment on Sept. 25, 2009.

The consent decree will resolve the Department’s complaint on behalf of an Indiana National Guardsman alleging that the law firm violated the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA).

AGCO Corp., a U.S. corporation based in Duluth, Ga., has agreed to pay a $1.6 million penalty for illegal kickbacks paid to the former government of Iraq.

Theresa Jeanne Baker was sentenced for her participation in two separate bribery conspiracies relating to DOD contracts at Camp Vistory, Iraq.

Matthew Fox, a former Atlantic City, N.J., firefighter, was sentenced today to 18 months in prison by U.S. District Court Judge Jerome B. Simandle in Newark, N.J.

Timothy Smith, a resident of Cullman, Ala., was sentenced today to 30 months in prison for tax evasion.

A federal judge today assessed the Southern Union Company $18 million for illegally storing mercury at a company-owned site in Pawtucket.

Travis Dardenne and Jeffery Brown of Plaquemine, La., each pleaded guilty today in U.S. District Court in Baton Rouge, La., to a violation of the Lacey Act for knowingly attempting to acquire an American alligator in violation of the federal Endangered Species Act and Louisiana law.

The United States has asked a federal court in Denver to bar Curtis Morris, an Elizabeth, Colo., tax return preparer, and his business, Numbers & Beyond, from preparing tax returns.

“Youth violence isn’t a Chicago problem, any more than it is a black problem or a white problem. It’s something that affects communities big and small, and people of all races and colors. Today is the beginning of what will be a sustained, national effort on behalf of this entire administration to address youth violence and to make our streets safe for everyone,” Holder said.

Bruce Lapierre of Pascoag, R.I., was sentenced to 51 months in prison today for tax evasion and conspiracy to defraud the United States

Michael Wildridge, 41, pleaded guilty today to transportation and possession of child pornography and was sentenced to 10 years in prison.

A Moldovan national pleaded guilty today in federal court in Kansas City, Mo., for his role in a forced labor trafficking scheme that victimized workers in 14 states.

“A noose is an unmistakable symbol of hatred and violence in our nation, conjuring up images of a despicable period in our history. Mailing a noose to an individual who advocates for racial equality sends a clear threat of violence,” said Thomas E. Perez, Assistant Attorney General for the Civil Rights Division.

Donald Collier, 45, was sentenced today to nine years in prison for mailing child pornography.

A Louisiana man pleaded guilty today to firing three shots from a shotgun at the home of three Hispanic men and, after they fled, entering the home and setting a fire that burned it to the ground.

Marcel J. Toto-Ngosso of Silver Spring, Md., was sentenced to 70 months in prison today for preparing and filing false tax returns in connection with a scheme to generate fraudulent tax refunds for his clients.

Panagiotis Lekkas, the captain of the cargo ship, M/V Theotokos, was sentenced today in federal court in New Orleans to 10 months confinement.

David H. Safavian was sentenced today to one year in prison on charges of obstruction of justice and making false statements in connection with the investigation into the activities of former Washington lobbyist Jack Abramoff.

The Department announced this week that it has filed a lawsuit against TK Properties L.L.C., its officer, Scott Terveen, and two employees, Ann Wagner and Corey Anderson, for violating the Fair Housing Act by discriminating on the basis of race.

“It will not be a priority to use federal resources to prosecute patients with serious illnesses or their caregivers who are complying with state laws on medical marijuana, but we will not tolerate drug traffickers who hide behind claims of compliance with state law to mask activities that are clearly illegal,” Holder said.
