2. We have heard the learned Advocates appearing for parties and formulated following substantial questions of law on 26.02.2020, which reads:

"(i) Whether under Rule 5 of CENVAT Credit Rules, 2004 prior to and from 01.04.2012 appellant would be entitled to seek refund without reference to the limitation? Or

(ii) Whether the time prescribed under Section 11B of the Central Excise Act, 1944 would be applicable for claiming refund of CENVAT Credit?"

CEA No.35/2018 came to be admitted on 23.07.2019 to consider the substantial questions of law indicated thereunder.

2. The subject matter of the suit was property bearing CTS No.4601/B Ward No.1 of J.C.Nagar, Hubballi measuring 431 square yards with an old building thereon.

3. The plaintiff's case in a nutshell is as follows: The defendant is the absolute owner and in possession of the suit property. For her legal necessity, she agreed to sell the suit property to the plaintiff for a consideration of Rs.25,00,000/-. On 22.11.2007, receiving advance R.F.A.No.100209/2015 4 consideration of Rs.14,00,000/- under three cheques drawn on UTI Bank, Hubballi, she executed a registered agreement of sale. Her daughter and grandchildren were also signatories to the said document. As per the schedule of payment agreed under the said document a further sum of Rs.6,00,000/- was to be paid within two months and balance amount of Rs.5,00,000/- was to be paid at the time of execution of registered sale deed.

This application is filed seeking bail under Section 438 of the Code of Criminal Procedure, 1973 in respect of the offences punishable under Sections 65(A)(E), 116 and 81 of the Prohibition Act which FIR came to be registered at FIR Part-C C.R. No.11191038200118 of 2020 with Vatva Police Station.

Learned advocate appearing on behalf of the applicants on instructions submits that the applicants are ready and willing to abide by all the conditions, including the condition with regard to the powers of Investigating Agency to seek remand of the petitioner; subject to the petitioner's right to oppose it.

4. On the other hand, the learned APP appearing for the respondent-State has opposed this application.

It is very much clear from the FIR that accused persons demanded a sum of Rs.11,000/- from the deceased on account of birth of a child to the wife of the deceased and upon his reluctance to pay the amount demanded and his willingness to pay Rs.5,000/-, accused insisted for the full payment; they picked up the quarrel with the deceased and one of the accused Renuka Kunvar allegedly thrashed the head of the deceased against the wall resulting into brain hemorrhage to which the deceased eventually succumbed and died after hospitalization of seven days. The material has been collected and the evidence has been recorded and it is pointed out by the learned Public Prosecutor that accused persons have been identified by the auto-rickshaw driver in his statement under Section 161 of the Criminal Procedure Code in whose auto- rickshw the accused persons commuted to the place of the deceased and thus the argument to the contrary that the accused persons remained unidentified in absence of TI parade has no substance.

This application is filed seeking bail under Section 439 of the Code of Criminal Procedure, 1973 in respect of the offences punishable under Sections 376(2), 363 and 366 of the Indian Penal Code and Sections 4, 6, 17 and 18 of the POCSO Act for which FIR came to be registered at C.R. No.I -25 of 2019 with Mehlav Police Station, District Anand.

On consideration of the rival submissions, the statement of the victim prima facie appears to be very curious in accompanying the unknown persons; she does not seem to be revealing the full and correct facts in her statement and thus considering the nature of accusation against the petitioner and in absence of an apprehension against the petitioner tampering with the evidence or threating the witnesses or fleeing from trial, the case for admitting the petitioner to bail is made out.

2. Learned advocate Mr. Baghel for the applicant submits that present application is filed after the charge-sheet. He submits that there is no recovery or discovery from the present applicant. He further submits that the mobile, which is alleged to have been noted in the alleged incident is not recovered from any of the accused persons. He also submits that since the charge-sheet is filed, there is no possibility of tampering with the evidence of prosecution and the applicant is not likely to flee from the justice. He also submits that the applicant is not named in the FIR. He therefore, urges that the applicant may be released on bail by imposing suitable conditions.

Finance Minister Nirmala Sitharaman will hold a review meeting with CEOs of public sector banks (PSBs) on Monday to discuss various issues, including credit offtake, as part of efforts to prop up the economy hit by the COVID-19 crisis. Learned counsel for the petitioner submits that despite the fact that the petitioner approached initially the Chief Judicial Magistrate, Srinagar, for registration of case against the respondent No. 6, by filing application/complaint under Section 156(3) Cr. PC, but even on the directions of the concerned Magistrate, the Crime Branch has not acted upon the directions. It is further submitted that the petitioner approached the respondent Director School Education, and brought into his notice the fraudulent approach adopted by the respondent No. 6 in fabricating the documents for excluding the role of petitioner as Chairman of the Holy Mission School, Narbal, Budgam, but no action is taken. It is submitted that on failure of the official respondents to take action in tune with the statutory provisions, the petitioner has no option but to approach this Court for seeking the relief as prayed for.

MM committed a grave error in observing that the ECS mandate was not on record. 1. The plaintiff has filed the present suit against the defendant for recovery of Rs. 2,72,858/­. The brief facts of the present case are as under :­ 1.1 That the plaintiff is the proprietor of M/s S.K. Enterprises and doing the business of government electrical contractor since 1995.

1.2 That defendant No. 2 is known to the plaintiff for more than 20 years and defendant No. 2 was running his business of sale of electrical goods as proprietor/partner of defendant No. 1 for the last 7/8 years from the aforesaid address and presently doing the business from the top floor of the aforesaid address.

1.3 That in the first week of March, 2015 defendant No. 2 had requested for a friendly loan of Rs. 2,50,000/­ from the plaintiff for some urgent business need for one week and considering the old friendship with defendant no. 2, the plaintiff had agreed to give a sum of Rs. 2,00,000/­ to the defendants but defendant No. 2 was insisting to increase the amount from Rs. 2,00,000/­ and accordingly, the plaintiff had agreed to give Rs. 2,01,000/­ to the defendants as a friendly loan for one week to the defendant and transferred an amount of Rs. 2,01,000/­ on 09.03.2015 by RTGS No. 17673 from the account of his firm M/s S.K. 2.Since the petitioner, who is the retired employee of the Transport Corporation, claims to have not been paid with the surrender leave salary of 24.5 days for the period from 2011 to 2019, the present writ petition has been filed seeking for direction in that regard.

After filing of charge sheet, the case has been numbered as Spl.S.C.No.61 of 2018 on the file of the Special Court for Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and the Sessions Judge(Full Additional Charge), Sivagangai. After framing of charges, trial commenced and during the pendency of the trial, the appellant did not appear before the trial court and due to non appearance of the appellant Non Bailable Warrant was issued on 04.03.2019 and the appellant surrendered before the trial court on 12.03.2020 and filed recall 2/5 http://www.judis.nic.in Crl.A.(MD)No.153 of 2020 petition and the same was dismissed the appellant was remanded to judicial custody on 12.03.2020.

2.The petitioner has been transferred from Tirunelveli to Chennai, Egmore Railway Police Station. The petitioner, who is working as a Head Constable in Tirunelveli Railway Police Station, has now been asked to join at Egmore Railway Police Station in the same post.

3.Since it is an issue of transfer and an administrative order, it may not be proper on the part of this Court to examine either reasons for transfer or also the grievances of the petitioner. However, she intends to further participate in counselling in the State Government Quota seats including those in Non-Governmental Institutions. One of the conditions stipulated for already selected candidates in the All India Quota to participate in the State Government Quota is that they should would have to resign from the seat secured within the specified date. In furtherance thereto, the First Respondent by notice dated 30.04.2020 had informed that it had been decided by the Competent Authority to allow the candidates who have joined their allotted college of Round -1 (both in Online/Offline mode) to resign from their joined seat by 5.00 p.m. of 08.05.2020 (Wednesday). It is the grievance of the Petitioner that the Second Respondent had not included the Management Seats in the Private/Non-Governmental Medical Institutions in the notification issued for Counselling under the State Quota. In that backdrop, this Writ Petition 3/7 http://www.judis.nic.in W.P. (MD) No. 6132 of 2020 and W.M.P. (MD) No. 5322 of 2020 has been filed for directing the Second Respondent to conduct and conclude the Counselling of Post Graduation Medical Seats in Private/Non-Governmental Medical Institutions along with the State Government Quota Seats for the academic Session 2020-2021 on or before 08.05.2020 by considering her representation dated 30.05.2020 in that regard.

Special Representative for Afghanistan Reconciliation Zalmay Khalilzad has sought Pakistan's support for reducing violence in Afghanistan and accelerate the intra-Afghan dialogue, the US Embassy here said on Saturday. Italy said a near-record 4,008 people were released from hospitals in the past day after testing negative for COVID-19 as the country continues its cautious reopening after a two-month national lockdown. A fire at a Moscow hospital treating people infected by the new coronavirus killed one patient and forced the evacuation of about 200 others. News reports said the fire at the facility in the northern part of the city has been extinguished.
