Supreme Court overturned HC’s decision of convicting the men on the grounds that the HC had erred in accepting the argument of “passive submission” as there was no fear or apparent threat. Supreme Court further added that since “no marks of injury” were found on Mathura’s body there was “no resistance” on her part and since she did not “raise an alarm” for help she “consented to sex.”The Apex Court acquitted both the accused stating that this alleged intercourse was a “peaceful affair”.

An analysis of SC judgments in Veluswamy case [AIR 2011 SC 479] and IndraSarma case [AIR 2014 SC 309] reveals that not all live-in relationships are to be deemed as a “relationship in the nature of marriage” u/s 2(f) of the DV Act. The wider interpretation of the term is aimed at welfare of unmarried women in live-in relationships who are left estranged or abused; but not at promoting adulterous relationships. The benefits provided under the Act are to be interpreted harmoniously, not violating penal provisions of adultery. Since, the applicant admitted the existence of her first marriage, negating the possibility of a legal marriage between the two contesting parties, revision was dismissed stating no “domestic relationship” subsists between them.

DV Act S. 2(q) - Case Law - Females can be respondents in DV complaints - Sandhya Wankhede vs. Manoj Bhimrao Wankhede and others (2011) 3 SCC 650

Although the main body of Section 2(q) expressly states that a respondent is an “adult male person”, the proviso widens the scope of proceedings by stating that an aggrieved wife or female living in a relationship in the nature of marriage can file a complaint against a relative of her husband/male partner. This rescinds the argument that the legislative intent was to exclude females. The Appeal was allowed with a direction to the Trial Courts to consider R2 and R3 as respondents in the proceedings.

The court held Sanji Ram, Parvesh Kumar and Deepak Khajuria guilty for rape and abduction of an 8 year old girl under Section 120B, 376 and 302 of the Indian Penal Code and sentenced a lifetime imprisonment for all the 3 accused. Deepak Khajuria was held liable for causing grevious hurt and confinement without will under Section 363, 343 and 201 of IPC also. SI Anand Dutta, Head-constable Tilak Raj and SO Surinder Kumar were also held liable for disappearance of evidence under Section 201 and punished for 5 years in jail. Whereas, Vishal was acquitted from all the charges against him.

Execution of Delhi rape case convicts

The court held Mukesh Singh, Vinay Sharma, Akshay Thakur and Pawan Gupta guilty for rape, murder, destroying evidences and unnatural offence of the girl based on the testimony of the male companion and medical reports of the victim. Ram Singh, the primary accused commited suicide in Tihar Jail while in police custody. The juvenile, Mohd. Afroz was tried under The Juvenile Justice laws for rape and murder of girl and a maximum sentence of 3 years was given to him. All the four adult convicts were given a death sentence and were executed on 20th March, 2020.

Flu Deaths Hit All-Time High; Weekly Case Numbers Continue to Drop

The Division of Public Health (DPH) is reporting two more flu-related deaths that occurred during the last two weeks of February, bringing the 2017-2018 season death total to 30. This number breaks the previous single-season record of 28 flu-related deaths, set in 2014-2015. The deceased were both females, 83 and 84 years old, from New Castle and Kent counties, respectively. Both had multiple underlying health conditions.

DPH Announces New Flu-Related Death as Numbers of Statewide Cases Continue to Drop

Statewide flu totals in Delaware decreased for the third week in a row, according to the Division of Public Health (DPH). During the week ending March 10, DPH reports 290 laboratory-confirmed flu cases, down from the prior week’s total of 381 confirmed cases. The latest numbers increase the total number of influenza cases for the season to 7,433. DPH is also reporting one additional flu-related death, a 62-year-old female from New Castle County with multiple underlying health conditions, bringing the number of flu-related deaths for the 2017-2018 flu season to 31.

DPH Investigating Mumps Outbreak After February Baile Mejicano Dance at Chase Center on the Riverfront

The Delaware Division of Public Health (DPH) is investigating a mumps outbreak among attendees of a February Hispanic dance festival in New Castle County. Officials have confirmed three cases of the mumps, all involving attendees of a social dance (Baile Mejicano or Mexican Dance) that took place at the Chase Center on the Riverfront in Wilmington on Feb.10, 2018. DPH is recommending that anyone who attended the dance, contact their primary care physician to determine if they may have contracted mumps and if they and their family or close contacts need to receive vaccination against mumps.

An eighth person was working at another Baile Mejicano dance, held at the same location, which occurred on March 3, 2018. DPH is now recommending that anyone who attended either the Feb. 10 or March 3, 2018, dances contact their primary care physician to determine if they may have contracted mumps and if they and their family or close contacts need to receive vaccination against mumps.
