A fifth individual pleaded guilty today to illegally accessing numerous confidential passport application files. Kevin M. Young, 42, of Temple Hills, Md., pleaded guilty before U.S. Magistrate Judge Alan Kay in the District of Columbia to a one-count criminal information charging him with unauthorized computer access. Young is scheduled to be sentenced on Dec. 9, 2009.

Albert Gonzalez, 28, of Miami, Fla., was indicted today for conspiring to hack into computer networks supporting major American retail and financial organizations, and stealing data relating to more than 130 million credit and debit cards. Among the corporate victims named in the indictment are Heartland Payment Systems, a New Jersey-based card payment processor; 7-Eleven Inc., a Texas-based nationwide convenience store chain; and Hannaford Brothers Co. Inc., a Maine-based supermarket chain.

Bill Melot, a resident of Hobbs, N.M., appeared in federal court today before Magistrate Karen B. Molzen in Las Cruces, N.M., on tax and false statement charges. Melot, a farmer who owns approximately 250 acres in Lea County, N.M., was charged with tax evasion, failing to file tax returns, corruptly impeding the IRS, and making false statements to the U.S. Department of Agriculture.

Two manufacturing companies, in separate settlements, have agreed to pay civil penalties and take corrective measures to settle Clean Air Act violations resulting from explosions at two plants in 2002 and 2003 in Louisville, Ky., and Pascagoula, Miss.

The vice president of a Missouri pesticide company, HPI Products Inc., pleaded guilty today in federal court in Kansas City, Mo., for violating a federal pesticides law designed to provide proper regulatory oversight and prevent improper storage of pesticides.

William Garvey, the president of HPI Products Inc., a pesticide company based in St. Joseph, Mo., was sentenced today in federal court in Kansas City, Mo., for violations of the Clean Water Act and hazardous waste storage laws related to the company’s pesticide production.

A Liberian-incorporated shipping company pleaded guilty today in federal court in Trenton, N.J., to failing to keep accurate oily water discharge records and using falsified records to conceal the discharge at sea of untreated bilge from one of its cargo ships.

The Department will not challenge a proposal by Memorial Health Inc. (Memorial), and St. Joseph’s/Candler Health System (St. Joseph’s/Candler) to enter an exclusive joint purchasing agreement with respect to the purchase of certain medical and surgical supplies.

Adam S. Pretti, a former deputy with the Shelby County, Tenn., Sheriff’s Office, was sentenced today in federal court in Memphis to 18 months in prison and two years of supervised release for using excessive force during an encounter with a citizen. Pretti was also ordered to pay a $4,000 fine and a $100 special assessment.

Four individuals were indicted today by a federal grand jury in the Eastern District of Virginia with conspiracy to commit copyright infringement for allegedly obtaining and illegally releasing copyrighted music.

Robert P. Merz was sentenced to life in prison today for advertising, transporting, receiving and possessing child pornography.

Dr. Candido Negron Mella pleaded guilty and was sentenced today for his participation in a corruption scheme involving the 2000 Resident Commissioner campaign of a former governor of Puerto Rico.

An international computer hacker pleaded guilty today to multiple charges relating to hacking activity and credit card fraud. More than 40 million credit and debit card numbers were stolen from major U.S. retailers as a result of the hacking activity. Albert Gonzalez, 28, of Miami, pleaded guilty today to 19 counts of conspiracy, computer fraud, wire fraud, access device fraud and aggravated identity theft relating to hacks into numerous major U.S. retailers.

A Newark grand jury indicted three individuals for their participation in fraud and kickback conspiracies related to contracts at a U.S. Environmental Protection Agency (EPA)-designated Superfund site, Federal Creosote, located in Manville, N.J.

The former superintendent of a wastewater treatment facility in Rochester, Ind., was sentenced today in U.S. District Court in South Bend, Ind., to serve one year in prison for falsifying discharge monitoring reports that concealed violations of the Clean Water Act.

Odell Folks, of Brooklyn, N.Y., was sentenced to prison today by District Judge Carol Bagley Amon of the Eastern District of New York for his participation in a false tax return scheme. Folks, who pleaded guilty in March 2009 to mail fraud, a false claims conspiracy, and making and subscribing a false return, was sentenced to 77 months in prison and ordered to pay restitution of $489,292.

A federal grand jury in San Diego has indicted an additional eight defendants for conspiracy to cheat a total of 11 casinos across the country. According to the indictment, from approximately March 2002 through July 2006, the defendants and co-conspirators allegedly formed and participated in a conspiracy, defined in the indictment as the “Tran Organization,” to cheat at gambling in casinos across the United States.

A federal court has permanently barred Wayne Perry, a Macon, Ga., man, and his tax preparation firms, Premier Choice Inc. and Perry Tax Services, from preparing federal tax returns. Perry agreed to the injunction.

The Department and the Federal Trade Commission (FTC) announced that they will solicit public comment and hold joint public workshops to explore the possibility of updating the Horizontal Merger Guidelines that are used by both agencies to evaluate the potential competitive effects of mergers and acquisitions.

Mark Edwin Cairnes of Jonestown, Texas, pleaded guilty today to advertising and possessing child pornography.

Eli Goldshor of Boca Raton, Fla.,was sentenced today for conspiracy to commit securities fraud and willfully failing to file tax returns. Goldshor, a self-employed limousine driver, was sentenced by Judge William Zloch in Ft. Lauderdale, Fla., to 18 months in prison.

James Wilbur Fondren Jr., was convicted by a federal jury today on charges involving providing classified information to a man working with the People’s Republic of China (PRC) and lying to the FBI about it.

The Department announced a settlement agreement to make Donna’s, a café and restaurant located in the Mt. Vernon neighborhood of Baltimore accessible to people with disabilities.

Formosa Plastics Corp., Texas, and Formosa Plastics Corp., Louisiana, will spend more than $10 million on pollution controls to address air, water, and hazardous waste violations at two petrochemical plants in Point Comfort, Texas, and Baton Rouge, La.

A Florida doctor was charged today by a federal grand jury in Ft. Lauderdale, Fla., with allegedly orchestrating a fraudulent political fund raising and lobbying scheme through which he secretly diverted to himself more than $350,000 from contributions to political organizations he controlled.

Daniel Earl Danforth, 30, of Minden, La., has been indicted by a federal grand jury for hate crime violations and obstruction of justice charges stemming from a cross-burning in Athens, La., last year near the home of an interracial couple. Danforth was arrested today following the return of the indictment on Sept. 25, 2009.

The city violated the Fair Housing Act by refusing to grant a nonprofit organization a permit to operate a group home for 11 men recovering from drug and alcohol addiction.

Detroit residents Dierdre Teagen, Robert Wynn, Ernest Neal, James Harris and Steve Sherman pleaded guilty for their roles in various Medicare fraud schemes.

Timothy Smith, a resident of Cullman, Ala., was sentenced today to 30 months in prison for tax evasion.

A federal judge today assessed the Southern Union Company $18 million for illegally storing mercury at a company-owned site in Pawtucket.

Three Miami-Dade County, Fla., residents have been indicted in connection with an alleged $2.3 million Medicare fraud scheme operated out of X-Press Center, a Detroit-area clinic that purported to specialize in providing injection and infusion therapies.

The Department will require AT&T Inc. to divest assets in eight areas in Louisiana and Mississippi in order to proceed with its $944 million acquisition of Centennial Communications Corp.

A Louisiana man pleaded guilty today to firing three shots from a shotgun at the home of three Hispanic men and, after they fled, entering the home and setting a fire that burned it to the ground.

The United States has reached a settlement with ranchers in a longstanding dispute over livestock trespasses on public lands in Nye and Esmeralda Counties, Nev.

The Department announced this week that it has filed a lawsuit against TK Properties L.L.C., its officer, Scott Terveen, and two employees, Ann Wagner and Corey Anderson, for violating the Fair Housing Act by discriminating on the basis of race.

Mylan Pharmaceuticals, UDL Laboratories, AstraZeneca Pharmaceuticals and Ortho McNeil Pharmaceutical have entered into settlement agreements for a total of $124 million to resolve claims that they violated the False Claims Act by failing to pay appropriate rebates to state Medicaid programs for drugs paid for by those programs.

Solomon Nathaniel of Sterling Heights, Mich., pleaded guilty today in U.S. District Court in Detroit to participating in a conspiracy to defraud the Medicare program.

A federal grand jury in Denver returned a 15-count felony indictment yesterday charging two individuals with conspiracy, wildlife trafficking and firearms violations stemming from the illegal trapping, killing and selling of bobcats and their pelts.
