An analysis of SC judgments in Veluswamy case [AIR 2011 SC 479] and IndraSarma case [AIR 2014 SC 309] reveals that not all live-in relationships are to be deemed as a “relationship in the nature of marriage” u/s 2(f) of the DV Act. The wider interpretation of the term is aimed at welfare of unmarried women in live-in relationships who are left estranged or abused; but not at promoting adulterous relationships. The benefits provided under the Act are to be interpreted harmoniously, not violating penal provisions of adultery. Since, the applicant admitted the existence of her first marriage, negating the possibility of a legal marriage between the two contesting parties, revision was dismissed stating no “domestic relationship” subsists between them.

Legal research giant Thomson Reuters has filed a lawsuit against legal research start-up ROSS Intelligence alleging that it surreptitiously stole content from Westlaw to build its own competing legal research product. Thomson Reuters lawsuit against ROSS comes just two days after it ended a related lawsuit against Legal Ease. In that stipulation, LegalEase agreed to an injunction that prevents it from reproducing Westlaw content, using bots to access content, and sharing its Westlaw credentials

Bhanwari Devi who was a social activist / worker in one village in Rajasthan. She was employed under a rural social development program which worked to stop child marriages in the village and this social program was administered / initiated by the state government of Rajasthan. Bhanwari Devi dedicated herself to preventing the marriage of the daughter of Ramkaran Gujjars (thakur), who was just under one year of age, i.e. she was just an infant.

After considering the evidences and conclusions in previous trials, the Court could not establish that the Trial Courts or the High Court were wrong in holding the case against the appellant. Implied consent for the trainer to fly an aircraft do not apply here, as there were telephonic signals sent to the aircraft, to bring it back. Wrongful gain can be mere unlawful acquisition of a property, creating ‘temporary’ loss to the Government. The circumstances conclude both the essential ingredients of theft – absence of consent and unlawfulness of means. From the factual analysis, the Court concludes that the wrongful gain and loss were intentional. However, considering that the appellant has already undergone imprisonment, his sentence was modified to the period already undergone. The appeal was dismissed while maintaining the conviction.

The Division of Public Health (DPH) is reporting two more flu-related deaths that occurred during the last two weeks of February, bringing the 2017-2018 season death total to 30. This number breaks the previous single-season record of 28 flu-related deaths, set in 2014-2015. The deceased were both females, 83 and 84 years old, from New Castle and Kent counties, respectively. Both had multiple underlying health conditions.

The Delaware Division of Public Health (DPH) is investigating a mumps outbreak among attendees of a February Hispanic dance festival in New Castle County. Officials have confirmed three cases of the mumps, all involving attendees of a social dance (Baile Mejicano or Mexican Dance) that took place at the Chase Center on the Riverfront in Wilmington on Feb.10, 2018. DPH is recommending that anyone who attended the dance, contact their primary care physician to determine if they may have contracted mumps and if they and their family or close contacts need to receive vaccination against mumps.

The Delaware Division of Public Health (DPH) is now confirming nine cases of the mumps as part of its ongoing investigation of an outbreak among attendees at a February dance festival in New Castle County. An eighth person was working at another Baile Mejicano dance, held at the same location, which occurred on March 3, 2018. DPH is now recommending that anyone who attended either the Feb. 10 or March 3, 2018, dances contact their primary care physician to determine if they may have contracted mumps and if they and their family or close contacts need to receive vaccination against mumps.

The Delaware Division of Public Health (DPH) has advised the operator of Broadkiln Beach Water Company located in Sussex County to issue a boil water notice to customers after water samples collected from the system tested positive for the presence of E-coli bacteria on Friday, July 20. The Division of Public Health (DPH) is announcing that the Lewes Board of Public Works (BPW) has issued a drinking water notice to customers after tests showed elevated levels of lead in the water. DPH received notification late last week from BPW that drinking water samples collected in August showed an exceedance of the EPA Action Level for lead. Lab analysis found that the 90th percentile result of 26.5 ug/L exceeded the EPA Action Level of 15 ug/L. Sampling consisted of 10 samples collected in different parts of the BPW service area with results ranging from non-detect to 38.4 ug/L.

The Division of Public Health (DPH) and Indian River School District announced today that approximately 50 individuals at Georgetown Elementary School in Sussex County may have been exposed to someone with active tuberculosis (TB). DPH is making contact with those individuals to offer free screenings, as well as treatment if needed. To protect medical privacy, no additional information will be provided regarding the source of the infection or the individuals who need testing.
