An analysis of SC judgments in Veluswamy case [AIR 2011 SC 479] and IndraSarma case [AIR 2014 SC 309] reveals that not all live-in relationships are to be deemed as a “relationship in the nature of marriage” u/s 2(f) of the DV Act. The wider interpretation of the term is aimed at welfare of unmarried women in live-in relationships who are left estranged or abused; but not at promoting adulterous relationships. The benefits provided under the Act are to be interpreted harmoniously, not violating penal provisions of adultery. Since, the applicant admitted the existence of her first marriage, negating the possibility of a legal marriage between the two contesting parties, revision was dismissed stating no “domestic relationship” subsists between them.

Three additional private wells in Blades area return test results exceeding EPA’s health advisory level for PFCs

DNREC and the Division of Public Health announced today that three private wells tested Feb. 19 in the Blades area by the US Environmental Protection Agency had returned results exceeding the EPA’s national health advisory level for perfluorinated compounds (PFCs). DNREC and EPA immediately notified the property owners of the test results and provided home carbon filtration systems for their water supply.

Flu Deaths Hit All-Time High; Weekly Case Numbers Continue to Drop

The Division of Public Health (DPH) is reporting two more flu-related deaths that occurred during the last two weeks of February, bringing the 2017-2018 season death total to 30. This number breaks the previous single-season record of 28 flu-related deaths, set in 2014-2015. The deceased were both females, 83 and 84 years old, from New Castle and Kent counties, respectively. Both had multiple underlying health conditions.

One year after new regulations issued, Delaware opioid prescriptions and quantities dispensed continue to drop

The number of prescriptions for opioid medications in Delaware, as well as the total quantity of opioids dispensed, have dropped significantly in the 12 months since the Department of State enacted stricter prescribing regulations to help combat the opioid crisis statewide.

DPH Announces TB Response at Wilmington Long-Term Care Facility

The Division of Public Health (DPH) announced today that over 600 individuals may have been exposed to someone with active tuberculosis (TB) at the ManorCare Health Services Foulk Road facility during a nine-month period in 2017. Consistent with routine Division TB protocols, the agency is sending out letters to former residents and staff of the facility who may have been exposed to the infected individual between January and September 2017. DPH is also following up with phone calls to provide information on free testing and treatment at one of its three clinics in Newark, Dover, and Georgetown.

Delaware Cancer Mortality Continues to Decrease; Public Health Releases Annual Cancer Report

DPH Advises Customers of BroadKiln Beach, PrimeHook Water Companies to Boil Water After Samples Test Positive for E. coli Bacteria

The Delaware Division of Public Health (DPH) has advised the operator of Broadkiln Beach Water Company located in Sussex County to issue a boil water notice to customers after water samples collected from the system tested positive for the presence of E-coli bacteria on Friday, July 20. Because the Broadkiln Beach Water Company shares a connection with PrimeHook Water Company, anyone who uses drinking water from either system should not drink the water without boiling it first.

Sussex County Man Tests Positive for West Nile Virus

The Division of Public Health (DPH) is announcing that a 60-year-old Sussex County man has tested positive for the state’s first human case of West Nile Virus (WNV) in 2018. The man was briefly hospitalized for illness in July and after a preliminary positive test result from the DPH Laboratory in Smyrna, the blood sample was sent to the Centers for Disease Control and Prevention (CDC) for confirmatory testing. WNV, a mosquito-borne illness, can become serious, and DPH reminds people to take precautions to avoid mosquito bites.
