2. We heard the Learned Counsel for the parties. This application was filed by the Applicant in the matter of the grant of the mining lease to the Respondent No.1 for executing the construction work of the road from the Jaora-Piplodha-Jalandharkheda & Piploda - Sailana at the instance of the Respondent No. 8/Madhya Pradesh Road Development Corporation Ltd. (MPRDC). For the aforesaid purpose the Respondent No.1 was granted temporary mining lease in July, 2013 for mining of material i.e. stone/boulder and murrum from the land in Khasra no. 308/1/1/a, village Amba, Tahsil Sailana, District Ratlam. The question raised by the Applicant was looking to the close proximity to the site of the aforesaid mining lease granted to the Respondent No.1, to the Sailana Wildlife Sanctuary famous for the Lesser Floricon bird, commonly known as Kharmour which is reported to be on the verge of near extinction and the aforesaid Sanctuary is one of the few habitats left over for the breeding purpose preferred by this bird, would be extensively disturbed as a result of the mining activity in such close proximity of the Sanctuary as also the fact, as was revealed before the Tribunal during the hearing, that the extent of the area of the Sailana Wildlife Sanctuary was limited to just about 13 sq.km.

2. The Informant, a company incorporated in May, 2015, has been operating under the brand name of Treebo Hotels' and is in the business of providing franchising services to budget hotels in India. In addition to this, Treebo also provides service to numerous independent budget hotels who partner with it under its newly launched 'Hotel Superhero' scheme. Under the said scheme, Treebo only provides services such as hotel management technology services, listing on its platform and other online travel aggregators, credit facilities, support and quality control of the staff and hotel management resources etc. but does not provide its brand name.

3. MMT is an Online Travel Agency (OTA) engaged in the business of providing travel and tourism related services in India. It is a part of MakeMyTrip group of companies (MMT Group). OYO, on the other hand, provides budget accommodation to customers and is in the market for providing franchising services to budget hotels under the brand name 'OYO'.

The writ petition has been listed along with the application. Sum and substance of applicant's submission is that she fears being dispossessed. 2. In this appeal the Original Claimant challenges the final judgment and order dated 14.02.2019 passed by the High Court at Calcutta in CAN No.10094 of 2018.

3. The basic facts culled out from the award dated 24.03.2015 passed by the Arbitrator in the present case are:-

“That the respondent company who is engaged in the business of infrastructure development activities approached the claimant company who is also dealing in the business of providing equipments for 2 Civil Appeal No.2378 of 2020 (arising out of SLP (C) NO.11011 of 2019) QUIPPO CONSTRUCTION EQUIPMENT LTD. Vs. JANARDAN NIRMAN PVT. LTD.

1. The petitioner seeks issuance of a writ of certiorari, quashing the disciplinary proceedings, pending against him for over 7 years as on date, on, inter alia, the ground that he has been acquitted in the criminal proceedings initiated against him on the same charge. It is W.P. (C) No.3055/2020 Page 1 of 4 pointed out that, on the ground of pendency of the aforesaid disciplinary proceedings, the petitioner's request for being permitted to voluntarily retire from service, was also been rejected vide communication dated 12th December, 2019.

1. This writ petition is filed by the petitioner seeking to impugn the show cause notice dated 15.09.2014, the demolition order dated 29.04.2015, the order of the ATMCD dated 10.08.2016 and the order of the Appellate Authority dated 10.08.2018.

2. The case of the petitioner is that the property bearing No. 8770/14B, Shidi Pura, Karol Bagh, Delhi (measuring 85 sq. yards) was purchased by Late Sh.Prem Nath Shrama, husband of the petitioner on 20.09.1982. Prior to the said property, he had also purchased the adjacent property bearing No. 8771/14 B (measuring 160 sq. yards) on 28.10.1972. Sh. Prem Nath Sharma died on 11.05.1996. Pursuant to a Will, the petitioner became the absolute owner of the two properties.

2. Summons in the present suit were issued on 24th October 2014 and vide order dated 3rd April 2018, following issues weresettled: -

i. Whether the plaintiff is entitled to a money decree against the defendant, if so for what amount? OPP ii. Whether the plaintiff is entitled to interest, if so at what rate and for what period? OPP iii. Relief.

Briefly stated, case of the plaintiff is that he is a duly registered Class- I contractor, under the name Bharat Construction Company, a CS(COMM) 719/2017 Page 1 of 18 proprietorship firm with the Municipal Corporation of Delhi. The plaintiff was awarded construction work of outfall drain from A-74, Phase-I, Naraina Industrial Area to DTC Nallah at Loha Mandi Naraina in Karol Bagh Zone vide work order No. EE-Project Karol Bagh/SYS/2011- 2012/14 dated 10th February 2012. The contractual amount of the work was Rs. 4,05,26,960 and the time for completion was of 6 months.

The appeal is directed against judgment dated 27.5.2017 passed by Additional Sessions Judge (FTC), Bastar at Jagdalpur/ Special Judge under the Protection of Children From Sexual Offences Act, 2012 (for short 'the Act 2012'), in Special Session Trial No.02/2017 wherein the said Court convicted appellant for commission of offence under Section 376(2)(i) of the Indian Penal Code, 1860 and under Section 4 of the Act 2012 and sentenced him to undergo rigorous imprisonment for 10 years and to pay fine 2 of Rs.1000/- and RI for 07 years and to pay fine of 1000/- respectively with default stipulation.

2. As per the version of the prosecution, the date of incident is 16.01.2017. Prosecutrix is PW-6 who is aged about 04 years. Said prosecutrix complained of pain to her mother on which her mother examined her private parts and found redness and swelling. On enquiry the prosecutrix intimated her mother that the appellant after putting soap inserted his finger in her private part. The matter was reported and investigated. The appellant was charge sheeted and convicted as mentioned above.

The appeal is directed against judgment dated 06.4.2010 passed by Sessions Judge Raipur in Session Trial No.161/2008 wherein the said Court convicted appellant for commission of offence under Section 304 Part-II of the Indian Penal Code, 1860 and sentenced him to undergo rigorous imprisonment for 05 years and to pay fine of Rs.1000/- with default stipulation.

2. In the present case, name of the deceased is Kalu @ Tarun Bagh. As per the version of the prosecution, on 11.6.2008 at 2 noon, the appellant and the deceased were drinking liquor in the house of the appellant. During the course of drinking, a dispute arose regarding daughter of the appellant namely Suman. On this dispute, the appellant and other persons assaulted the deceased and the appellant sat on the chest of the deceased and pressed his neck due to which the deceased become unconscious. He was taken to hospital but succumbed to the injuries. The matter was reported, investigated and the appellant was charge sheeted and convicted as mentioned above.

1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), East Central Railway, DRMO, Dhanbad seeking information on four points, including, inter-alia;

a) Whether rules or instructions issued by Director General, Railway Board in East Central Railway, Dhanbad are valid or not,

b) Whether or not the rules/instructions as per the RBI No. 61/2015, letter no. E(N-G)1-2015/R E-3/2 dated 12.06.2015, is valid in the matter of re-absorption of the medically unfit RPF/RPSF employees into an alternate position? Provide a certified copy of the said rule,

The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), East Central Railway, DRMO, Jharkhand seeking information on three points, including, "(a) What action has been taken on the appellant's application regarding making adjustments to the alternative post in Samastipur division (East Central Railway),

(b) What action was taken by the Screening Committee on the appellant's application, which was received by Electronic Grievance Redressal Arrangement (EGRS) vide no. 24652 on 05.12.2017, regarding the adjustment of the optional post, and

(c) To provide certified copies of all the documents along with the complete file in the name of the appellant, available with the Screening Commissioner, including the written application accepted by the appellant for the clerical post."

1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), East Central Railway, DRMO, Jharkhand seeking information on six points pertaining to technician post, including, inter-alia;

a) Is the proof of validation issued in the railway hospital by the screening committee on the optional post after medical distortion valid,

b) What is the medical category for the post of Technician Grade-III,

c) Does the post of technician grade-III fall in the category of sedentary job. And other related information.

2. The CPIO, vide reply dated 09.05.2018, provided point wise information to the appellant. Being dissatisfied by the information provided on point nos. 3 and 6, the appellant filed a first appeal dated 25.05.2018. FAA, vide order dated 15.06.2018, upheld the CPIO's reply. Thereafter, the appellant filed a second appeal u/Section 19(3) of the RTI Act before the Commission on similar grounds and requested the Commission to direct the CPIO to provide the information sought for.
