These long-awaited decisions are the most important developments in tax law in the past decade. Are you on the right side of GAAR? History When GAAR was introduced in 1988, it gave Revenue Canada very broad powers to challenge perceived tax avoidance activity. And since its genesis, there have been many justifiable concerns regarding GAAR's impact on tax planning. Some of these awards have been very controversial and have had a tremendous impact on the development of the concept of fair and equitable treatment (FET) and the evolution of international investment law. Yet, in spite of the fundamental importance of these awards, no comprehensive study had been undertaken to determine the meaning and the content of the FET standard under NAFTA Article 1105. This book’s systematic analysis of the provision and its case law fills this analytical gap. Because Article 1105 is in many ways different from typical FET clauses contained within most investment treaties, the author examines the particular parameters under which it must be interpreted. He also analyzes how these specific features have influenced NAFTA tribunals’ interpretation of the provision, and how their assessments differ from awards rendered by other tribunals outside NAFTA. Failure to Learn also analyses the similarities between this event and the Longford Gas Plant explosion in Victoria in 1998, featured in his earlier book Lessons from Longford. Professor Andrew Hopkins is being recognized by the European Process Safety Centre in October 2008, in recognition of his contribution to safety. Professor Hopkins is the first winner to receive the award, outside of Europe, which is a demonstration of the impact of his valuable work worldwide. Andrew has been awarded a prize by the European Process Safety Centre for “extraordinary contribution to process safety”, the first time this has been awarded outside of Europe.
