LA County supervisors criticize 'piecemeal' cleanup around Exide, seek money for lead testing

All five members of the Los Angeles County Board of Supervisors have signed a letter imploring California Gov. Jerry Brown to intervene in the state’s handling of contamination around the Exide Technologies plant in Vernon.

The letter criticizing the state’s “piecemeal approach to an urgent environmental hazard” comes as workers paid for by Exide are removing lead-contaminated topsoil from two homes near the intersection of Olympic and Indiana avenues in L.A. 

Signed Tuesday, the letter asks for “guaranteed state funding to immediately begin testing” at 37 more homes also sampled, but to less specific degrees, during November 2013. In the words of the board, “further testing and remediation of the other 37 homes has not been confirmed and may not begin until at least October 2014 because Exide has not yet agreed to comply with DTSC directives issued last March.”

The supervisors also say the state has “reneged” on its commitments to test for lead inside the homes as well as outside.

The Department of Toxic Substances Control says that the two homes workers are at this week will be cleaned inside and out — even without indoor testing.  The DTSC’s Rizgar Ghazi said Monday that crews will use HEPA filters, vacuums and shampooing equipment on “basically any flat surface” inside the two residences.

Dirty for the drought: LA Waterkeeper wants you to take the no-car wash pledge

Washing your car with a garden hose can use up to 120 gallons of water. Most corner conveyor belt operations use less, but all that water can add up, as we told you in August.

That’s why the group LA Waterkeeper is challenging motorists to drive dirty and pledge to skip car washes for 60 days. 

"Water conservation is the easiest and most affordable way to quickly reduce water demand and also extend supplies into next year," says Liz Crosson, the group's executive director. 

This summer Ventura County’s water agency asked people to skip washing their rides for a month; some people got detailing and car washes as a reward. Crosson’s group is hoping bragging rights will be enough of an incentive. (Though there are some as-yet-undisclosed prizes.)

People who live in LA are really excited and interested by the cars that they drive," Crosson says. "And frankly, you can have a dirty car and you can have a sticker and have an excuse for having a dirty car so it saves your image too."

The campaign’s just kicking off this weekend (at the Abbott-Kinney festival), but Crosson’s already optimistic for success. Early adopters of the pledge are hundreds of people from the online site Reddit and the general manager for the Los Angeles Department of Water and Power.

With California drought lengthening, city of Los Angeles develops stormwater capture plan

With a historic drought showing no signs of letting up, the city of Los Angeles is drafting a new plan to use more local water sources by capturing storm water throughout the L.A. basin. At recent community meetings, officials from the Department of Water and Power (along with the city's Sanitation Department) have been showcasing potential ideas for the final plan, due out this summer.

This new plan would make storm water about 4 percent of the city's annual water budget. For the first time, LA is talking about making storm water a small but reliable part of the city’s water sources – 25,000 acre-feet, or somewhat over 8 billion gallons of storm water a year. For perspective, a typical one-inch rain event in Los Angeles County produces more than 10 billion gallons of storm water, most of which hits asphalt and concrete, flows into storm drains and goes to the sea.

It’s hardly a new idea. But storm water capture has taken on additional urgency because of the drought, because of the increasing price of importing water, and because of local water quality rules.

On top of that, Los Angeles Mayor Eric Garcetti issued an executive order last October, directing the LADWP to cut its purchase of imported water in half within a decade, in part by cutting water consumption at least 20 percent.

Storm water capture projects have captured the energy and attention of environmental groups who’ve demonstrated them in backyards, neighborhoods, and alleyways.

LA could invest in much-larger-scale versions of those ideas. Good places for those bigger projects tend to be in the San Fernando Valley, where the geology is hospitable to rain water capture and the city has clearest rights. 

Some examples featured in the LADWP’s presentation aren’t yet approved, but are in consideration:

  • Water capture and storage at the Van Norman Complex
  • The Canterbury Power Line Easement, running between the Tujunga Spreading Grounds and the Pacoima Wash, which would capture 1500 acre-feet of water a year; and 
  • Converting Strathern Park (near the Hollywood Freeway) from a disused gravel pit/landfill to a wetlands park, in joint operation with L.A. County. 

Storing storm water in the ground means protecting some areas from industrial pollution, and means filtering and treating polluted groundwater as it’s pulled from aquifers. Last November’s $7.5 billion dollar water bond earmarked funds for storm water capture and for groundwater cleanup. DWP officials say they’re hoping to bring some of that money to Los Angeles.

For These Federal Employees, Telework Means Productivity Is Up, Their Backlog Is Down

The coronavirus pandemic has forced many people to work from home, and that includes employees of the federal government. The numbers vary by agency, but at the Social Security Administration, some 53,000 workers are doing so.

Social Security field offices are closed. But the shutdown hasn't stopped the agency from processing claims for new benefits and appeals of benefit denials. And according to statistics that the SSA sent its workers, the agency has been doing so at a faster pace than before.

"Telework is proving a great boon to the service Social Security provides to the American people," says Ralph deJuliis, who works at the SSA's office in Tulsa, Okla. "We are getting the checks to people faster and quicker."

DeJuliis is president of the American Federation of Government Employees Council 220, which represents many Social Security workers. And he says he hopes the SSA will continue allowing employees to work from home.

Telework, he says, is "good for the employees, good for the public. We've got the work done. We kept the public out of harm's way because, let's face it, we deal with mostly people who are old or disabled. They are at the highest risk."

According to deJuliis, the SSA has found that its backlog of pending cases has fallen by 11% since March 23, when the agency instituted wide-scale telework, and that calls from recipients are answered more quickly.

Isabel Sawhill, a senior fellow at the Brookings Institution, says it's not surprising that productivity is up.

"Actually, there are studies that have been done, including studies in government agencies — small-scale studies, to be sure — but they have shown that productivity does rise when people get to work from home," she says.

Jeff Neal, a former head of human resources at the Department of Homeland Security, says it's not surprising that people become more productive when they work from home.

"The really good workers might be sitting there at their home desk, wherever that is," he says. "And they're supposed to stop at 5 o'clock, and they look at their watch or their computer and they realize it's 7 o'clock and they've still been working, because they get into things and they start getting stuff done and they just keep on going."

It's unclear how many federal workers across the government are teleworking. According to the most recent statistics, from two years ago, 42% of the some 2.1 million government employees were eligible to telework, although only about half of those were in fact working from home.

The Trump administration had been hostile to teleworking, Neal says, because in its view it sees it as a benefit to federal workers. But Neal says it's also a benefit to taxpayers.

"If people view it as what it really is, which is something that is in the interest of the federal government to have, then they would continue it because it helps them hire. It helps them retain people," he says. "And most importantly, it helps them remain operational during a national emergency. So it's a very good thing."

And Sawhill at Brookings says she expects teleworking will continue to increase both in government and the private sector after the coronavirus crisis ends.

"This experience has showed us that we can get work done at home and that we can meet people's needs, the public's needs, by doing so," she says. "That doesn't mean there aren't lots of downsides. But overall, I think this is a trend that is going to accelerate sharply as a result of this recent experience."

The federal government has not given any guidance as to when it expects all federal workers to return to their offices.

The SSA issued a statement saying it continues to monitor the COVID-19 situation across the nation, promising that when it does reopen offices, it will provide a safe environment for the people it serves and its employees.

Comedy Community Mourns The 'End Of An Era' As UCB Closes New York Locations

When the Upright Citizens Brigade announced plans to permanently close its New York bases last week, comedy lost a beloved home. The scrappy, alternative comedy troupe that grew into a school and theater revolutionized improv in New York and beyond with its embrace of "Yes, and ..."

The New York institution incubated the talents of stars such as Kate McKinnon, Aziz Ansari, Chris Gethard, Donald Glover, Aubrey Plaza and many others in the comedy world. A pillar of longform improv, UCB teachings have been brought into countless comedy writers' rooms and are etched into many successful TV shows.

Four of the company's founding members, known as the "UCB4" — Amy Poehler, Matt Besser, Matt Walsh and Ian Roberts — told staff in an email on April 21 that the organization couldn't afford to renew its leases on the group's two Manhattan locations: the UCB theater in Hell's Kitchen and a training center in the Garment District.

UCB also has two locations in Los Angeles where operations have been temporarily halted during the coronavirus outbreak, but there are currently no plans to close them.

Obits followed, marking the exit of UCB's physical presence in the city where it took off in the '90s, when the group turned a former strip club into its first theater.

"The guys that I came up with in New York at the UCB Theater — we made our bones there basically," said Rob Corddry, who went on to be a Daily Show correspondent and star in comedy films including Hot Tub Time Machine. "It's really sad. Sort of the end of an era."

The news comes a month after layoffs were announced at the group's New York and Los Angeles facilities in response to the coronavirus. A small number of staff were kept at training centers on both coasts.

But UCB was under financial strain long before the pandemic. Many UCBers cast the move as an example of an opaque, top-down decision-making that, over the years, they say has sowed distrust in UCB leadership among its members.

"The biggest issue with UCB was the lack of communication of the company and the owners to their employees," said Paris Adkins, a New York performer who was laid off from her administrative job with the company last month.

A previous round of layoffs took place at the end of 2018, mostly of New York employees. Adkins said the pandemic "is just the extenuating circumstance that put things over the edge."

As for the most recent closures, UCB's founders admitted to falling short of expectations.

"Look, we heard the community when they said, 'We're scared, too, and we want better communication,' " Amy Poehler told The Hollywood Reporter in an interview with the UCB4 after the announcement. "I think we did make mistakes, and we're trying to do better."

UCB has not responded to NPR's attempts to contact the organization.

Chris Renfro, an LA-based performer and show producer who relied on UCB as his main source of income, said that learning in March via a mass email that his 3-year career there had come to an end struck him as a betrayal of the values the UCB4 claimed to live by.

"UCB is about a community, it's about having each other's backs," he said, referencing the improv tradition UCB students learn of literally patting each other's backs and saying "Got your back."

"It felt like they had turned their backs on this massive community they had built up around them," he said. "So now there's a weird taste in a lot of peoples' mouths because of that."

According to a letter sent to staff addressing the layoffs, Poehler said she would pay for an additional month of health care for former full-time staff.

Much of the company's operations run on part-time staff, according to Adkins. She estimated that UCB cut a total of 45 New York-based employees across the city since last month.

Despite the community's frustrations, when the indefinite shutdown of the New York outposts turned definite, the tributes rolled in online.

Stephen Colbert, who studied at the peer improv hub Second City in Chicago before moving to New York, tweeted "I'll always be grateful" for the times he was roped in to perform with UCB during the '90s in the acclaimed sketch show mainstay Asssscat.

Daily Show correspondent Jordan Klepper added, "When I left Chicago, the people at UCB NY welcomed me, challenged me, and embodied the NY spirit of full commitment today because tomorrow you could run out of cash and life ships you back home."

Other dispatches on social media were less endearing.

Former students, many of whom shelled out several hundred dollars for improv classes, wrote about negative experiences and wasted money. Some revived longstanding criticism of the theater's policy to not pay its performers, unlike many of its improv peers.

Despite its problems, many felt a sense of community at UCB, Adkins said.

"I think people are grieving," she said. "It's pretty much my only community in New York and I think a lot of people feel that way. You don't get the support of a community like you do at UCB."

In an effort to financially support herself and her peers following the layoffs, Adkins started a GoFundMe page to raise money for New York staff. To date, the account has raised nearly $60,000. She's splitting the funds between staff members, who will receive a month's worth of pay. The rest will be divided among teachers who are in need, Adkins said.

In the THR interview, Amy Poehler assured the UCB community, "We're not leaving New York."

At least for the short-term, the company has moved both LA and New York classes online. For the long-term in New York, leadership has floated plans to return to the old days of renting other independent spaces to hold classes and performances.

Still, even some of its youngest members see the now-shuttered hubs as a piece of history.

"But that's replaceable and people are not," said former training center staff member Maicy Jo Schwartz, who began her UCB NY career in 2014.

Schwartz sees a silver lining.

"I wouldn't be surprised if in the future some people branch off and start their own theaters or their own training centers or their own underground improv and sketch, because New York is a perfect place to do that," she said. "And I do hope that the UCB4 — Amy, Matt, Matt and Ian — can be part of that and support that when there are future endeavors that their alumni take on."

It was a remarkable show of listener generosity and commitment

His expression said it all.  KPCC Director of On-Air Fundraising Rob Risko walked into my studio about 10:45 a.m. to update me on where we stood with our Fall member drive.  I knew we had a $10,000 challenge that had started first thing in the morning, but didn't have any idea how far behind we had fallen in reaching the required 1,000 member threshold.

 Rob gave it to me straight -- we had to attract well over 500 members during "AirTalk" to meet the challenge.  I knew that was nearly impossible during a full two-hour show, let alone one that would be significantly pre-empted by the President's news conference.  Regardless, I knew we had to do our best and hope our listeners would contribute in a record-setting way.  Boy, did they.

We didn't start our show until 11:25 a.m., following the news conference.  Right off the bat the phones started ringing and the KPCC website starting humming.  The volume of member contributions stayed high with only a few exceptions.  There were times we could barely keep track of how many members were coming in.  It was one of the most exciting and rewarding experiences I've had in all my years hosting "AirTalk."

I've been on a high all afternoon thinking about how commited our listeners are to the mission of KPCC.  You've made me very happy, and very proud of our audience.  Thank you for a wonderful show of support.  I will long remember this day.

The Getty's new $65M Manet: 'Spring' from an artist in the autumn of his life

The Getty spent $65m (and change) for this late Manet masterpiece, "Spring."

A  132-year-old vision of springtime has landed permanently at the Getty Museum, smack in the middle of this California autumn: "Spring (Jeanne Demarsy)," one of Impressionist painter Edouard Manet’s  last completed pictures.

Here's what Getty Director Timothy Potts had to say about the artist:

Manet was the ultimate painter’s painter: totally committed to his craft, solidly grounded in the history of painting and yet determined to carve out a new path for himself and for modern art. ... Alone of his contemporaries (the only one who comes near is Degas), Manet achieved this almost impossible balancing act, absorbing and channeling the achievements of the past into a radically new vision of what painting could be.

"Spring" somehow manages to be the evocation of youth itself and all its hopes. The subject is 16-year-old actress Jeanne Demarsy, just then seeing her stage career ascend at the same time Manet neared the end of his own career. (He died at age 51 in 1883,  soon after the painting went on display.) 

For most of the years since its creation, the picture has been in private hands. It was recently on loan to the National Gallery.

Getty Assistant Curator Scott Allan said that the Getty worked hard to acquire "Spring" and was lucky to get her. According to news reports, the Christie's auction price paid was an eyebrow-lifting $65 million — about double the top previous sale price for a Manet. "We don’t discuss the price," Potts said.

At the Getty, "Spring (Jeanne Demarsy)" hangs next to an early Manet in the museum's Impressionist-Post Impressionist gallery. It was intended to be one of the "Four Seasons" by the late-19th century French master. The series was never completed (although "Autumn" hangs in a museum in France).

Allan said that, unlike many of Manet's early works, "Spring" was intended to hang in the Salon, the French art establishment’s showplace of traditional painting, which had rejected innovators like the Impressionists for decades. That led most of the Impressionists to disdain the Salon. But Allan said Manet was extremely pleased that his late work was accepted there.

So popular was it that "Spring" became the subject of one of the first color photographs of a work of art. Its acquisition by the Getty brings to Los Angeles the most important — and beautiful! — painting by this artist left in private hands and one of the great masterpieces of late-19th-century art. 

The painting depicts a lovely teenager, dressed in the peak of 1880s fashion in a blue-on-white printed dress; a flowered, fringed hat; and a parasol balanced on her left shoulder. The background features white rhododendrons, barely in blossom.

Mlle. Demarsy stares off to the left, the demure image of a confident young woman at the earliest spring of her adulthood, with an entire creative life before her, already immortalized before the world by one of the century’s greatest artists.

But Manet was himself at the peak of his accomplishments,  just before his sudden demise.
 
"Spring" became one of Manet’s most popular works, deeply appreciated by art lovers young and old and by critics of both the old guard and the avant garde. It was his last picture to hang in the Salon. Manet’s powers would soon decline, and he devoted much of his last few months to watercolors, said Allan.

Palm Springs Film Festival: A celebrity warm-up for Oscar

The 26th Annual Palm Springs International Film Festival opened this weekend, distinguished by robust audience turnouts, megawatt celebrity visitations and constant reminders of the unique space PSIFF occupies and the specialized services it provides to Hollywood.

Falling as it does just before Sundance and just after the Golden Globes nominations, Palm Springs is as much a part of the awards season calendar as it is the festival circuit. Big ticket screenings are presented with all the photo op pomp that would greet a major world premiere at, say, the Los Angeles Film Festival, but in many cases this is to build buzz for (or to re-energize) films that are already in theaters.

At Sundance or Tribeca, the suspense is usually about whether the films in competition will get good reviews and/or find distribution. At Palm Springs, especially on opening weekend, it's more about whether you'll run into Brad Pitt in the guest and industry suite at the Renaissance Hotel.

At the PSIFF awards gala, Golden Globe nominee Reese Witherspoon took home the oddly gender specific Chairman's Award for her performance in "Wild."

J.K. Simmons received something called a Spotlight Award for his superb turn as the menacing music instructor in "Whiplash."

David Oyelowo grabbed the "Breakthrough Performance Award (Male)" for depicting Martin Luther King Jr. in "Selma." Brad Pitt's sing-along presentation of Oyelowo's award became the meme for much of the post-event press coverage.

Rosamund Pike got the "Breakthrough Performance Award (Female)" for "Gone Girl."

Michael Keaton presented the Director of the Year award to his "Birdman" collaborator Alejandro G. Iñárritu.

And the Palm Spring Convention Center stage was home to two young British heartthrobs who are in Oscar contention this year for period biopics about scientific genius: Eddie Redmayne, who grabbed the Desert Palm Achievement Award (Male) for portraying ALS sufferer Stephen Hawking in "The Theory of Everything," and Benedict Cumberbatch, who split glory with the cast of the Alan Turing biography "The Imitation Game" as co-winner of the Ensemble Performance Award.

The Desert Palm Achievement Award (Female) went to Julianne Moore in the Alzheimer's drama "Still Alice."

Every single one of the movies honored is in theaters now, almost all of them in the midst of slowly expanding release patterns as they mount their long slow march toward the Academy Awards.

The generous "one award per movie" policy and the care with which PSIFF avoids alienating celebrity affections by giving out trophies with such blunt and unequivocal titles as "Best Actress" or "Best Actor" mark the PSIFF awards gala as a psuedo-event: a kind of open-armed Hollywood team huddle before things get grim and serious with the Oscar announcements at the end of the month.

Even an Oscar-worthy oddity like Richard Linklater's "Boyhood" managed to find a place in the parade, with Linklater, who directed Shirley MacLaine in the 2010 black comedy "Bernie," presenting the 80-year-old actress with the Sonny Bono Visionary Award, essentially for career achievement.

Meanwhile, the festival's generous supply of indie, studio and foreign movies churned away in various local movie theaters, a really quite remarkable cluster of buzzworthy pictures, almost all of which have played elsewhere, including at Sundance and Toronto and Tribeca, and in many cases at your local multiplex.

This programming approach can be a double-edged sword. Director Ava DuVernay, whose civil rights-era epic "Selma" opened the festival, was unable to stay for her full run of Palm Springs personal appearances because her movie has been out long enough to spark a rather bitter controversy over its depiction of President Lyndon Johnson. DuVernay abandoned a Palm Springs Q and A in order to defend her film on Charlie Rose. 

While some audience members were bitterly disappointed at missing the chance to hear one of this year's golden ones, I'm sure the PSIFF Board of Governors understood completely. This time of year, you have to play the long game, and, in the words of the civil rights anthem, "keep your eyes on the prize."

Three More Orange County Beaches Get Approval To Reopen As Supervisors Vote To Send Countywide Rules To Sacramento

After the cities of San Clemente and Laguna Beach were given the OK by state officials on Monday to reopen beaches with limited conditions, the California Natural Resources Agency gave Dana Point, Seal Beach and Huntington Beach the green light on Tuesday after approving the plans they submitted for safe reopening.

The plans vary as far as when the beach can be used, but the common thread through each is that leisure activities like sunbathing or large gatherings of people would not be allowed, and that beachgoers will be required to remain active while on the sand. 

The news comes as Orange County Supervisors voted 3-2 on Tuesday to submit a plan to submit to Sacramento that would create a set of uniform rules for reopening beaches countywide. Supervisor Lisa Bartlett spearheaded the proposal, which received pushback from Supervisors Don Wagner and Michelle Steel who argue that after being singled out by Governor Gavin Newsom last week when he ordered a “hard close” on all state and local beaches in Orange County, taking issue with the idea of the county bowing to pressure from the state.

How Will Chief Justice And Supreme Court Conservative Majority Affect 2020 Election?

The U.S. Supreme Court is no stranger to controversy, but it still gets higher marks in public opinion polls than the other branches of government. Now though, for the first time in memory, the court is not just split along ideological lines, but along political lines as well: All the conservatives are Republican appointees, all the liberals Democratic appointees. That division could put the court in the crosshairs of public opinion if it is forced to make decisions that affect the 2020 election.

Chief Justice John Roberts has worked hard to persuade the public that the justices are fair-minded legal umpires--not politicians in robes. That image got pretty scuffed up earlier this month when the conservative court majority shot down accommodations for the coronavirus that would have allowed six more days for absentee ballots to be received in Wisconsin's election for 500 school board seats, over 100 judicial seats, and thousands of other state and local positions.

In the weeks leading up to the election, the COVID-19 pandemic had become a public health crisis. Encouraged by local officials, about a million more voters than usual requested absentee ballots, and local officials were unable to keep up with the surge. To mitigate that problem, the lower courts allowed an extra six days for election officials to receive completed absentee ballots.

But the day before the election, the Supreme Court overturned the lower court ruling by a 5-to-4 vote. The result was that tens of thousands of people who had not yet even received their absentee ballots were forced to, as the dissenters put it, choose between their health and their right to vote.

The TV footage of people wearing masks waiting for hours to vote at the very few precincts that were open amid the pandemic was, to say the least, not a good look. Health officials in Milwaukee have since identified six voters and one poll worker who appear to have contracted the virus during the election.

The majority opinion was unsigned, so no one knows who the principal author was. But we do know some things.

First, the emergency appeal in the case came through the justice assigned to that region of the country, Brett Kavanaugh. Typically, when a justice refers a case to the full court, he or she writes a memo about the issues, likely with a recommendation. Kavanaugh almost certainly did that. But other justices would then chime in. And in a voting case, Chief Justice Roberts assuredly would have played a pivotal role.

"John Roberts' fingerprints are on this as chief justice and as someone who has owned this area of the law," says Joan Biskupic, a Supreme Court biographer and CNN legal analyst who is the author of a critically acclaimed biography about Roberts.

Indeed, Roberts was invested in voting-rights law as far back as 1982 when he was a staffer in the Reagan administration. Back then, he led the effort to narrow the landmark 1965 Voting Rights Act. When that failed, President Reagan signed the broad extension of the law, rejecting advice to veto it. But years later, on the Supreme Court, Roberts wrote the decision in Shelby County v. Holder, gutting a key provision of that law.

So, it was no surprise when the conservative majority refused to make even a modest accommodation to the pandemic. What was surprising was the tone of the opinion. Critics of the opinion, including some Roberts defenders, called the language "callous," "cynical," and "unfortunate."

In fact, the word "pandemic" appears not once in the court's unsigned opinion. Rather, the majority sought to portray the issue before the court as a "narrow, technical question." The majority said the lower court had overstepped the Supreme Court's established rule that courts should "ordinarily not alter the election rules on the eve of an election."

The dissenters replied that the court's treatment of the current situation as ordinary "boggles the mind." Writing for the dissenters, Justice Ruth Bader Ginsburg opined that "a voter cannot deliver...a ballot she has not yet received. Yet tens of thousands of voters who timely requested absentee ballots" are being asked to do just that.

"I do think there's something to this idea that we need to stick with the rules even in the context of an emergency," says law professor Rick Hasen, an election expert at the University of California, Irvine.

He and others see the legal question before the court as a close call, but say the decision was, at the very least, tone deaf in light of the reality of a pandemic.

Hasen says that the court could have recognized "the inhumanity of making people vote in this way," but that instead the tone of the opinion was "really dismissive of the entire threat facing these voters."

Chief Justice Roberts has, on some occasions tried to bridge the two wings of the court, in a couple of big cases siding with the court's liberals, or sometimes trying to fashion a compromise. But as Hasen observes, "there really is not any case I can think of involving elections where Roberts has forged a larger consensus."

Roberts must have anticipated at least some of the outcry over the Wisconsin decision. He is, after all, an astute political observer.

But as any student of the court knows, Roberts is a reliable, and often leading member of the conservative majority when it comes to a whole host of issues involving campaigns, voting and elections. That includes decisions he has written striking down laws aimed at limiting the role of big money in campaigns and decisions upholding partisan gerrymanders. Moreover voting rights in particular "is an area of the law where John Roberts has not been deterred by anticipated public criticism," says Biskupic, his biographer.

For the chief, says Biskupic, "It's not just voting rights. It's a broader overlay of representation" in his decisions, a pattern that "often will favor Republicans, but more fundamentally, it seems to favor entrenched powers, the status quo in many states, against ordinary citizens. And we certainly saw that in Wisconsin."

Uncertainties around COVID-19 remain, with states facing decisions about when to reopen and what size of public gatherings are safe. As November inches closer, those decisions could affect the 2020 election. Who gets to vote, when, and how, are unanswered questions and states are surely exploring different plans to keep voters safe. But Roberts' Supreme Court may be the ultimate arbiter of what changes and accommodations to voting are allowed.

The majority opinion "tried to tell the public that this was a very small decision," says Biskupic. "But as the dissent pointed out, it laid down a very serious marker about how voters will be accommodated in the middle of the coronavirus crisis."

Virginia Gun Range Can Reopen — Governor Overstepped His Authority, Judge Rules

A Virginia gun range can remain open, despite Gov. Ralph Northam's order closing nonessential businesses throughout the state in response to the coronavirus pandemic, a state judge ruled Monday.

In a March executive order, Northam had included indoor shooting ranges among the businesses to be temporarily shuttered to stop the spread of COVID-19. In response, the shooting range SafeSide sued, asking a court to block the order. Judge F. Patrick Yeatts granted the request, prohibiting law enforcement from blocking citizens' access to the gun range.

Northam lacks the authority to close gun ranges, Yeatts said, because of a state statute, modeled on the Second Amendment to the U.S. Constitution, giving citizens the right to bear arms. "During an emergency, the governor is given great deference, but [the statute] specifically limits his authority in relation to the right to keep and bear arms," Yeatts wrote.

"The purpose of the right is to have a population trained with firearms in order to defend the Commonwealth," Yeatts wrote. "Proper training and practice at a range ... is fundamental to the right to keep and bear arms."

"The Court understands the Governor's desire to protect the citizens of our great commonwealth," Yeatts said. "But in taking steps to stop the spread of COVID-19, he took a step beyond what is allowed."

In a statement, Attorney General Mark Herring said that his office was considering how to respond. "Governor Northam's efforts to save lives and slow the spread of COVID-19 are necessary and proving to be effective, but unfortunately, the gun lobby believes the ability to shoot a gun indoors during this pandemic is worth risking further spread of the virus and making Virginia communities and families less safe," Herring said, according to the Associated Press.

University of Virginia law professor Richard Schragger told The Virginian-Pilot that the ruling only applies to the Lynchburg gun range — but the reasoning could apply to any subsequent lawsuits brought by other gun ranges in the state.

SafeSide was joined on the lawsuit by Gun Owners of America, the Association of Virginia Gun Ranges and the Virginia Citizens Defense League. Philip Van Cleave, president of the Virginia Citizens Defense League, told the AP his group would try to get a broader ruling that applied statewide.

Flood Of Calls And Texts To Crisis Hotlines Reflects Americans' Rising Anxiety

Normally, Laura Mayer helps the most acutely suicidal callers find the nearest hospital emergency room. But in a pandemic, that has become a crisis counselor's advice of last resort.

"It's a difficult decision because we do know that by sending them into an overburdened health care system, they may or may not get the treatment that they need," says Mayer, who is director of PRS CrisisLink in Oakton, Va., which also takes calls for the National Suicide Prevention Lifeline. "The resources may or may not be there, and we're exposing them to the illness."

So instead, counselors are devoting more time to each caller, offering ad hoc therapy and coaxing them to talk through their pain. These days, that pain often has many sources: lost jobs, severed relationships and sick family.

"The type of call and the seriousness of the call is very different this year than it was in previous years," Mayer says. "There's environmental issues, internal issues, family issues. ... It's never one thing."

America's crisis centers and hotlines are themselves in crisis. As people grapple with fear, loneliness and grief, on a grand scale, those stresses are showing up at crisis hotlines. Not only are the needs greater, but their clients' problems are more acute and complex and offer a window into the emotional struggles Americans face.

Across the board, hotlines of all kinds are reporting increases in volume.

The Substance Abuse and Mental Health Services Administration saw a fivefold increase at its National Helpline in March. The Crisis Text Line says its volumes are up 40% in the pandemic, to about 100,000 conversations a month.

Volunteer counselors and good Samaritans are responding by lining up to help.

But Mayer says the heaviness takes its toll. Those offering this kind of support end up needing support themselves.

"This illness is starting to impact each of our crisis workers and counselors themselves personally," she says. "So everyone is kind of a client right now, and that's been really challenging."

Nancy Lublin, CEO and co-founder of the Crisis Text Line, says she is bracing for sustained need. "This echo of the physical virus, the mental health echo, we fear it's going to last a very long time and that the intensity will remain," she says.

Over the last two months, the focal point of the emotional pain has shifted, she says. Initially, the spike in traffic was over anxiety about the virus itself. That shifted to complaints of isolation. Now, texters talk of depression and grief.

"So we've doubled the number of conversations that are about grief, and there the top two words that we see are 'grandma' and 'grandpa,' " she says.

And it's no longer just young people texting. Adults are complaining of loneliness, sexual abuse and eating disorders.

"As the quarantines go on and continue, we're seeing it's the people over the age of 35 who are increasing at a higher percentage of our volume," Lublin says. "For the first time, we're seeing people over the age of 60 texting us."

Texting is an ideal medium, she says, for those stuck at home with no personal space: "You don't have to find a quiet space where no one else can hear you."

And for some, that might be the only form of escape. The text line has seen a 74% increase in references to domestic violence. "We see words like 'trapped' [and] 'hurt,' " says Lublin.

Many shelters have shut down, and some of those in-person centers, including the Salvation Army in Philadelphia, now rely on their own hotlines instead.

Arielle Curry, director of the Salvation Army's anti-human trafficking program, says many of her clients can't afford cell phones and have lost touch; those who remain in contact are in dire straits, searching for a shorter supply of money or drugs, and are often suicidal. Curry says addressing those acute emotional needs by phone is frustrating; sometimes she doesn't even know where they are and can't send help to intervene.

"You can't ... comfort someone and look them in their eyes and support them face-to-face," she says. That makes it hard, Curry says, not to feel helpless and hopeless herself.

Secretary DeVos Forgoes Waiving Disability Law Amid School Closures

U.S. Education Secretary Betsy DeVos will not recommend that Congress waive the main requirements of three federal education laws, including the Individuals with Disabilities Education Act, known as IDEA. The federal law ensures that children with disabilities have a right to a free, appropriate public education whenever and wherever schools are operating.

When Congress passed the coronavirus relief package, known as the CARES act, they included a provision that allowed the Secretary to request waivers to parts of the special education law during the pandemic. The concern was that holding strictly to IDEA and other laws could hinder schools in the urgency to move schooling from the classroom setting to online and home-based approaches.

Th waiver provision, however, made disability advocates nervous. "We're talking about waiving a civil right for our most vulnerable people in our society, children who don't vote, who have no voice, who are relying on their parents to advocate for them," Stephanie Langer, a Florida civil rights attorney who focuses on education and disability, told NPR in March.

But the Education Department came to the conclusions that in general, big changes weren't needed. "While the Department has provided extensive flexibility to help schools transition," Devos said in a statement, "there is no reason for Congress to waive any provision designed to keep students learning."

While the bulk of the IDEA remains unchanged, Devos did issue limited waivers to a few sections of the law, including one that will extend the timeline schools have to offer services. The provision that bans discrimination based on disability status, will go untouched.

"This is truly a celebration," says Kelly Grillo, a special education coordinator in Indiana. "My teams are elated to keep IDEA intact. Waivers would seriously threaten equitable education."

As schools and learning have moved online, one of the biggest challenges has been providing special education. School districts were concerned they might get sued if their digital offerings couldn't meet the needs of their students with disabilities, though the Education Department issued guidance in March telling schools to be flexible, writing in a fact sheet that disability law, "should not prevent any school from offering educational programs through distance instruction."

Educators say that flexibility helped them improve their offerings for students. "This situation made us get creative and actually allowed us to have an all-hands-on-deck approach," says Grillo.

But advocates warn there are still areas to watch, including in New Jersey, where parents have been asked to waive their right to sue before districts are able to provide their children with special education services.

The reopening of Tyson Foods' largest U.S. pork plant came the same day that health officials in Black Hawk County, where the plant is located, announced that 1,031 of the plant's estimated 2,800 employees have tested positive for the virus. That's higher than previous estimates by state officials.

Tony Thompson, sheriff of Black Hawk County, was among the public officials who called for the Waterloo facility to shut down temporarily. His call to close the plant came after he first toured the facility on April 10.

Thompson says that when he toured the plant then, he "fully expected" to see barriers, masks and other personal protective equipment in place. That wasn't the case.

"What I saw when we went into that plant was an absolute free-for-all," he says. "Some people were wearing bandannas. Some people were wearing surgical masks. .... Most people weren't wearing anything. People working on the line were working elbow to elbow, sometimes reaching over each other, processing the meat that was coming down the line.

"There was absolutely no opportunity for social distancing," he says. "We left the plant thinking, 'oh, my gosh, we've got a huge problem here.'"

Health officials say 90% of the cases of coronavirus in the county are linked to the Tyson facility.

During the closure, Tyson installed clear plastic mats to divide workstations and hand sanitizing stations. The plant has also instituted temperature checks and provides workers with surgical masks when they arrive and when they leave.

After touring the facility last week, Thompson is in cautious support of the reopening, saying he feels "reserved encouragement" after seeing the new safety measures.

If, however, the outbreak continues at this facility, Thompson says he would support a second shutdown.

Thompson's primary focus is on the safety and security of the roughly 131,000 citizens of Black Hawk County — and he says he feels especially responsible for the Tyson workers.

"We like our bacon, but we don't want to think about how it's actually done. When you got a carcass hanging there, bleeding on the floor, you don't want to think about that ... a byproduct of that is the people that actually do that work," he says.

"Unfortunately, these are oftentimes marginalized citizens because they are refugees, because they don't speak English, because they do a job that not many people want to do," he continues. "So there's something inherent there that was not right that I hope that they have corrected. And I'll hold my breath and pray that that is true. If it's not, we'll back up, regroup and go at this again."

Small firms and nonprofits like KPCC struggle with technology's diversity problem

KPCC recently reported on the tech world’s diversity problem. Technology firms face challenges in hiring diverse staffs of its coders, web developers and software engineers.

It’s also a challenge at nonprofits such as Southern California Public Radio,  parent of 89.3 KPCC, which has always sought to build a staff that reflects the region it serves. The section of that staff that develops the KPCC app and makes its website run is all white and mostly male.

But a small talent pool means the diversity challenge is even greater for nonprofits and even smaller tech firms.

“The first problem is that all of the people working for me are male,” says Alex Schaffert, the one female on KPCC’s tech team.  “I’m kind of focusing on maybe getting another girl into the mix.”

Schaffert can use the term “girl” because she happens to be the leader of the tech team:  KPCC’s Managing Director of Digital Strategy and Innovation. 

Why diversity is important

Schaffert recently launched the topic of diversity – or lack thereof – at a weekly meeting of her team. She expected a “stilted and awkward” discussion from the five white men on her team, but a few of them didn’t hold back.  

“Not having diversity represented on the team leaves us more susceptible to circular thinking and everyone sort of verifying each other's assumptions,” said Joel Withrow,  who was serving at the time as KPCC’s Product Manager. “It impacts the work. It limits what you’re able to build.”

Sean Dillingham, KPCC’s Design and Development Manager, said living in a diverse community is what attracted him to Los Angeles, and he wants diversity in his immediate work team, too.

“When I look at other tech companies, I will often go to their ‘about us’ page, where they’ll have a page of photos of everyone, and I am immediately turned off when I just see just a sea of white dudes, or even just a sea of dudes,” Dillingham said.

Big competition, small talent pool

Dillingham and Schaffert are currently recruiting heavily to fill two tech-savvy positions. When a reporter or editor job opens up at KPCC, Schaffert says close to 100 resumes come in.

"But if you post a programmer job, and you get three or four resumes, you may not get lucky among those resumes," she says. "There may not be a woman in there. There may not be a person of color in there."

In other words, the talent pool is already small, and the diversity challenge makes it even smaller. KPCC is competing for talent with Google and Yahoo and all the start-ups on L.A.’s Silicon Beach. 

Schaffert’s being proactive, mining LinkedIn and staging networking events to attract potential candidates. She’s also trying to make sure KPCC’s job descriptions don’t sound like some she's seen in the tech world.

"If you read between the lines, they’re really looking for someone who is male and is somewhere between 25-30 years old and likes foosball tables and free energy drinks in the refrigerator," Schaffert says. “So you read between lines, and you know that they’re not talking about me, a mother of two kids who also has a demanding career. They're talking about someone different.”

Pay vs. passion

Schaffert's challenges and approaches to dealing with them are similar to those of Mary Ann de Lares Norris, the Chief Operating Officer at Oblong Industries. Based in downtown Los Angeles and founded in 2006, the company designs operating platforms for businesses that allow teams to collaborate in real time on digital parts of a project.

“I think technology and diversity is tough,” Norris told KPCC.  She’s proud her company’s management ranks are diverse, but says only 12 percent of its engineers are female. “Pretty standard in the tech industry, but it’s not great,” Norris says. “We really strive to increase that number, and all of the other companies are also, and it's really hard.”

Like Schaffert at KPCC, Norris works hard fine-tuning job descriptions and communicating that her company values diversity and work-life balance. But sometimes, it just boils down to money.

"We have to put out offers that have competitive salaries,” Norris says, adding that she can’t compete with the major tech firms. "The Googles and the Facebooks of the world can always pay more than we can. So we attract people who are passionate about coming to work for Oblong.  And, of course, we also offer stock options."

KPCC doesn’t have the  stock options, but we’ve got plenty of passion. Could that be the secret recruiting weapon for both small tech companies and nonprofits?  

LinkedIn recently surveyed engineers about what they look for in an employer. Good pay and work-life balance were the two top draws. Slightly more women prioritized work-life balance and slightly more men chose the big bucks. 

Clinical Entrepreneurship professor Adlai Wertman says that, historically, nonprofits and small businesses actually had the upper hand over big companies in recruiting minorities and women.

"There’s a feeling that they’re safer, more caring environments, less killer environments, and we know that corporate America has been the bastion of white males," said Wertman. 

But Wertman says that advantage disappears in the tech world because of the "supply-and-demand" problem with talent. When big firms decide to focus on diversity – as some have recently — they have plenty of resources.

"They’re always going to be able to pay more, and in truth they’re getting access to students coming out of these schools in ways that we as nonprofits and small companies never will," said Wertman. 

Wertman worked 18 years as an investment banker on Wall Street, then left to head a nonprofit on L.A.’s skid row. Now he heads the Brittingham Social Enterprise Lab Enterprise Lab at USC’s Marshall School of Business. He believes that, early on, the big companies have the best shot attracting diverse tech talent. But in the long run, much of that talent will turn back to smaller firms and nonprofits.

"I think ultimately people vote with where they’re most comfortable, where 'my values align with my employer's values, and if I don’t feel those values align, then I’m going to leave,'" Wertman said. "Ultimately, I think, for a lot of women and minorities, there’s a lot of value alignment within communities that are doing good in the world."

Overall unemployment in state, LA County keeps falling, but some places still struggle

California's unemployment rate continued its decline in December, ending the year at 7 percent, according to figures released Friday by the state Employment Development Department.

But in Compton, Willowbrook and the Florence-Graham section of Los Angeles County, it remains about double that, data show.

“You might have work this week. But next week, you won’t have work,” said James Hicks, 36, 0f Compton. He's worked in warehouses through staffing agencies, but said the jobs have always been temporary.

Statewide, California has added jobs at a faster rate than the United States for three straight years, according to Robert Kleinhenz, Chief Economist with the Los Angeles County Economic Development Corporation. He pointed out the statewide unemployment rate is now where it was June 2008. 

"All in all, with the recession now five years back in our rearview mirror, we’re finally at the point where we can say that we have shrugged off quite a bit of the pain that occurred back during those times," Kleinhenz said.

The Los Angeles County metro area saw a net gain of almost 71,000 jobs in 2014.  The County's overall unemployment rate has fallen to 7.9 percent from 9.2 percent a year ago.

But Compton's unemployment rate was 13 percent in December.

“I’d rather have a  full-time type of gig, working 40 hours a week, but right now, even if you get 25 hours, it’s a blessing,” said Hicks, the warehouse worker in Compton.

On Thursday, he interviewed to be a guard with a security firm, but was told there weren’t any positions available. He had another security guard job six months ago that he thought might become full time and permanent. 

"It was going all right for about two to three months, until they cut my hours and days," Hicks said. 

Walter Flores lives in La Mirada but currently works as an account executive in the Compton office of Workforce Solutions. He was unemployed for about eight months last year after a car accident.

"Losing what you love to do is a tough one, but I'm back," he said. "2015 is going to be a great year."

Flores said most major warehouse and logistics companies prefer to hire temporary workers through industrial staffing firms like the one where he's working because their needs are sporadic.  

But he said it's still a potential opportunity.

"It doesn't matter that it's a temporary position, as long as you put your foot in the door, and then you let the employer know how much value you are for the company," Flores said.  

Hicks, who's earned a GED, wants to find a program to study physical therapy. But first, he’d like to find a job. 

He said you can't judge Compton’s residents by its unemployment rate.

"Some of us out here who [are] looking for jobs, but sometimes it’s the luck of the draw," he said. "It’s kind of scarce out there.”

Genetic diversity couldn't save Darwin's finches

A National Science Foundation-funded study found that Charles Darwin's famous finches defy what has long been considered a key to evolutionary success: genetic diversity. The research on finches of the Galapagos Islands could change the way conservation biologists think about a species' potential for extinction in naturally fragmented populations. Researchers examined 212 tissue samples from museum specimens and living birds. Some of the museum specimens in the study were collected by Darwin himself in 1835. Only one of the extinct populations, a species called the vegetarian finch, had lower genetic diversity compared to modern survivors. Specifically, researchers believe a biological phenomenon called sink-source dynamics is at play in which larger populations of birds from other islands act as a "source" of immigrants to the island population that is naturally shrinking, the "sink." Without these immigrant individuals, the natural population on the island likely would continue to dwindle to local extinction. The immigrants have diverse genetics because they are coming from a variety of healthier islands, giving this struggling "sink" population inflated genetic diversity.
