Supreme Court overturned HC’s decision of convicting the men on the grounds that the HC had erred in accepting the argument of “passive submission” as there was no fear or apparent threat. Supreme Court further added that since “no marks of injury” were found on Mathura’s body there was “no resistance” on her part and since she did not “raise an alarm” for help she “consented to sex.”The Apex Court acquitted both the accused stating that this alleged intercourse was a “peaceful affair”.

The Tribunal held that Respondents 5,6,7 and 11 were negligent and the element of Mens rea could be traced as the Respondents did not follow the Principle of Due Diligence pre-voyage and they directed the ship to continue its voyage even though one of the pumps and generator of the ship had been nonfunctional and according to the principle of polluter pays, Respondents 5,7 and 11 were liable to pay environmental compensation.

An analysis of SC judgments in Veluswamy case [AIR 2011 SC 479] and IndraSarma case [AIR 2014 SC 309] reveals that not all live-in relationships are to be deemed as a “relationship in the nature of marriage” u/s 2(f) of the DV Act. The wider interpretation of the term is aimed at welfare of unmarried women in live-in relationships who are left estranged or abused; but not at promoting adulterous relationships. The benefits provided under the Act are to be interpreted harmoniously, not violating penal provisions of adultery. Since, the applicant admitted the existence of her first marriage, negating the possibility of a legal marriage between the two contesting parties, revision was dismissed stating no “domestic relationship” subsists between them.

Although the main body of Section 2(q) expressly states that a respondent is an “adult male person”, the proviso widens the scope of proceedings by stating that an aggrieved wife or female living in a relationship in the nature of marriage can file a complaint against a relative of her husband/male partner. This rescinds the argument that the legislative intent was to exclude females. The Appeal was allowed with a direction to the Trial Courts to consider R2 and R3 as respondents in the proceedings.

Legal research giant Thomson Reuters has filed a lawsuit against legal research start-up ROSS Intelligence alleging that it surreptitiously stole content from Westlaw to build its own competing legal research product. Thomson Reuters lawsuit against ROSS comes just two days after it ended a related lawsuit against Legal Ease. In that stipulation, LegalEase agreed to an injunction that prevents it from reproducing Westlaw content, using bots to access content, and sharing its Westlaw credentials

The court held Mukesh Singh, Vinay Sharma, Akshay Thakur and Pawan Gupta guilty for rape, murder, destroying evidences and unnatural offence of the girl based on the testimony of the male companion and medical reports of the victim. Ram Singh, the primary accused commited suicide in Tihar Jail while in police custody. The juvenile, Mohd. Afroz was tried under The Juvenile Justice laws for rape and murder of girl and a maximum sentence of 3 years was given to him. All the four adult convicts were given a death sentence and were executed on 20th March, 2020.

After considering the evidences and conclusions in previous trials, the Court could not establish that the Trial Courts or the High Court were wrong in holding the case against the appellant. Implied consent for the trainer to fly an aircraft do not apply here, as there were telephonic signals sent to the aircraft, to bring it back. Wrongful gain can be mere unlawful acquisition of a property, creating ‘temporary’ loss to the Government. The circumstances conclude both the essential ingredients of theft – absence of consent and unlawfulness of means. From the factual analysis, the Court concludes that the wrongful gain and loss were intentional. However, considering that the appellant has already undergone imprisonment, his sentence was modified to the period already undergone. The appeal was dismissed while maintaining the conviction.

The Hon’ble court after observing reports given by various technical authorities like the Varadharajan Committee and The Central Board for the prevention and Control of Water Pollution, held that the emissions generated by the coke/coal consuming industries are air-pollutants and have a damaging effect on the Taj and the people living in TTZ. The court directed the atmospheric pollution generated in TTZ to be eliminated and the industries to use natural gas as an industrial fuel and those industries who are not in a position to obtain gas connections to relocate themselves.

DNREC and the Division of Public Health announced today that three private wells tested Feb. 19 in the Blades area by the US Environmental Protection Agency had returned results exceeding the EPA’s national health advisory level for perfluorinated compounds (PFCs). DNREC and EPA immediately notified the property owners of the test results and provided home carbon filtration systems for their water supply.

The Division of Public Health (DPH) is reporting two more flu-related deaths that occurred during the last two weeks of February, bringing the 2017-2018 season death total to 30. This number breaks the previous single-season record of 28 flu-related deaths, set in 2014-2015. The deceased were both females, 83 and 84 years old, from New Castle and Kent counties, respectively. Both had multiple underlying health conditions.

Statewide flu totals in Delaware decreased for the third week in a row, according to the Division of Public Health (DPH). During the week ending March 10, DPH reports 290 laboratory-confirmed flu cases, down from the prior week’s total of 381 confirmed cases. The latest numbers increase the total number of influenza cases for the season to 7,433. DPH is also reporting one additional flu-related death, a 62-year-old female from New Castle County with multiple underlying health conditions, bringing the number of flu-related deaths for the 2017-2018 flu season to 31.

The Delaware Division of Public Health (DPH) is investigating a mumps outbreak among attendees of a February Hispanic dance festival in New Castle County. Officials have confirmed three cases of the mumps, all involving attendees of a social dance (Baile Mejicano or Mexican Dance) that took place at the Chase Center on the Riverfront in Wilmington on Feb.10, 2018. DPH is recommending that anyone who attended the dance, contact their primary care physician to determine if they may have contracted mumps and if they and their family or close contacts need to receive vaccination against mumps.

The Division of Public Health (DPH) is advising parents and teachers to be aware of a recent trend among youth known as “JUULing.” JUUL is a brand of e-cigarette that looks similar to a flash drive and can be charged in the USB port of a computer. JUULs can be appealing to youth for a variety of reasons. Pods come in a variety of fruit and candy flavors, the devices can be difficult to distinguish from a real flash drive, and the vapor dissipates quickly instead of hanging in the air like a smoke trail. This has caused concern among school administrators across the country as youth have taken to “JUULing” on school property, even in class.

The Delaware Division of Public Health (DPH) is advising Delawareans of a multistate outbreak of E. coli infections linked to chopped romaine lettuce from the Yuma, Arizona, growing region. The lettuce could be contaminated with Shiga toxin-producing Escherichia coli O157:H7 and could make people sick. To date, there have been no confirmed cases reported in Delaware, but DPH urges consumers to take precautions to prevent illness.

The number of prescriptions for opioid medications in Delaware, as well as the total quantity of opioids dispensed, have dropped significantly in the 12 months since the Department of State enacted stricter prescribing regulations to help combat the opioid crisis statewide.

The Division of Public Health (DPH) announced today that over 600 individuals may have been exposed to someone with active tuberculosis (TB) at the ManorCare Health Services Foulk Road facility during a nine-month period in 2017. Consistent with routine Division TB protocols, the agency is sending out letters to former residents and staff of the facility who may have been exposed to the infected individual between January and September 2017. DPH is also following up with phone calls to provide information on free testing and treatment at one of its three clinics in Newark, Dover, and Georgetown.

The Division of Public Health is continuing its efforts to encourage former residents and employees of the ManorCare Health Services Foulk Road facility in Wilmington, between January and September 2017, to be tested for tuberculosis (TB). DPH opened a call center on Tuesday, May 29, 2018, to follow up with individuals who had been sent a letter and answer any questions, as well as to field questions from the public.
