I hear this questions a lot in the daily real estate game, "can you give us part of our fee back after the closing?"

The answer is yes but only if done in a certain way.

RESPA, the Real Estate Settlement Procdures Acts, requires a couple of things that need to be mentioned. The first thing is that payment cannot be made for services not performed. The second one is that if any payments are made, they must be disclosed on the HUD-1 Settlement Statement.

Futher, Alabama License Law, and most states License Laws, require that no "rebate" be made to any party in a real estate transaction from another party. Another section of the code also requires that the TRUE terms of a real estate transaction be diclosed to the lender or lending institution.

What does all this mean? For starters, if your agent says they can give you cash back after the closing, in nearly every case, this is both against case law and the license law governing the licensees in your state. So - in short - don't do it. If you are a participant in a transaction and you recieve cash back later, after the closing takes place, then you are participating in loan fraud. Fraud is a crime. Because the lender didn't know that you were receiving additional cash proceeds from the sale, they are not aware of the TRUE details of the transaction. Alomst every loan program for the purchase of a home has the provision that the buyer cannot receive what is called "cash out" - that is - get money back when they make a purchase. This, in essence, would be overfinancing the home. on a refinance, however, this is okay.

The way to get a credit back from your agent is to have the credit put on the settlement statement as a CREDIT to you and then the credit is applied to any costs you have to pay at the closing table. This applies whether you are buying or selling.

Basic Rule of them: If you can put the cash payment on the HUD-1 settlement statement so that it is disclosed to all parties, including the lender, chances are it's AOK to do it.

ePartners is making it's debut in Alabama in 492 cities statewide. ePartners is a nationwide relocation network that allows anyone to search for and find properties for sale in any city any time.

The local cities are affiliated with an agent or team of real estate agents who work the areas and are specialists in properties in each city. They can help members of the homebuying or homeselling public find exactly what they are looking for.

The ePartners network also contains specific city information on schools and neighborhoods, shopping and restaurants, and parks and recreation.

Sellers can market their homes through the nationwide network and buyers can easily find them from anywhere in the United States.

Some of the main sites are very easy to find: Alabamawebpage.com, Montgomerywebpage.com are examples of url's that make this network very consumer friendly.

The ePartners network also allows real estate agents to easily get plugged into a nationwide relocation and referral network.

ePartners is set to take off in early December 2006. We will be watching.

A new network of websites which features the largest 494 cities in Alabama will make it's debut statewide in December. Called the ePartners Network, the statewide web will make it easier for consumers to find properties all across the state of Alabama. In particular, the major cities, Montgomery, Huntsville, Birmingham, and Mobile and their surrounding communities are linked and cross linked so consumers can easily search for homes and real estate from one single location.

The state affiliate Broker, Mike Carraway (Broker, Access Realty), has already introduced the network to real estate agents in Birmingham, Huntsville, Jasper, Cullman, Hoover, Gulf Shores, Orange Beach, Montgomery, and several other Alabama cities. Each city has it's own site and weblog and an agent can elect to be the exclusive real estate agent for their city to help consumers find what they want or to market their property statewide.

This is the first time in the history of real estate that geographic boundaries have been erased. In the past, agents and brokers have worked in certain geographic areas and basically limited themselves to that area, even though they were licensed to do business anywhere in the state. Now, for the first time, those boundaries are gone. An agent licensed to do business in the state can assist customers finding homes or locating a local agent from anywhere.

This new network will be a plus for all real estate ancillary services as well. Mortgage companies, insurance companies, and others can now advertsie their services on the network either statewide or in a local community.

The ePartners Network will change the way that the real estate business is done in other ways as well. It will serve as the first statewide, and even nationwide, platform for paperless real estate transactions.

(Birmingham, AL) The Alabama real estate market is already recovering from recent lows. Evidence is everywhere.

Inventories of property on the market hit an all time high at the end of november 2007 into the first of December 2007. Since then, the inventory of property for sale has been shrinking. This is always the first sign. As property inventories decrease, the demand for property rises. This causes price support and shores up values.

Mortgage applications, or new people applying for a home loan, increased 12% just last week. This is yet another sign that more buyers are entering the market to buy a home. If you combine this with the fact that inventories are shrinking, it doesn't take a genius to see that values will stop declining soon and prices will again start to rise.

There are early signs that media will be one of many industries to take a huge blow from the COVID-19 pandemic, with sharp declines in ad revenue and significant layoffs. Podcasting is unlikely to be an exception; Podtrac recently reported that downloads have fallen 10% since the beginning of March, while unique listeners fell by 20%.

A different picture emerged when I spoke to Ross Adams,  CEO of podcast advertising company Acast, which works with both bedroom podcasters and large publishers like the BBC and PBS NewsHour.

Adams said listenership is not down — it’s just that audiences have changed when they are listening and what they’re listening to, with Acast  seeing its largest weekends ever in recent weeks. And plenty of people want to start new podcasts; signups for the Acast Open platform increased 49% month-over-month in March.

Theres good news on the horizon for podcast revenue growth, and presumably for radio organizations that are active in that space.

With expected growth of 14.7% through 2020, the stage has been set for podcast revenues to hit $1.1 billion in 2021, according to the IAB/PwC report.

While it remains to be seen what long-term impact the pandemic has on podcast revenues, IAB/PwC still predicts a 15% jump in 2020. This comes after podcast ad revenues soared 48% between 2018 and 2019, a stunning growth rate.

Building out a physical space associated with a podcast business used to be a really good idea. For one thing, it offers an alternative revenue stream — through studio rentals and in-person events, among other things — that could check against the growing but volatile advertising revenue pool. It is also a really good fit for any podcast operation built on a sense of community. Having a physical space for listeners to routinely gather can really strengthen that relationship between publisher and fan, expanding the notion of how that community can be served.

Today, podcasting has exponential reach. In the US, for example, The latest Niesen release notes that the number of heavy podcast listeners—those listening every day— has grown by more than 3.6 million. The total podcast audience is growing at a compound average growth rate of 20%. (source: Nielsen)

Similarly, in the United Kingdom, at the end of 2019 around 7.1 million people were listening to podcasts each week. That’s one in eight people and is an increase of 24% over the past year – and more than double over the past five years. Ofcom research also found that half of listeners have joined the podcast wave in the last two years. (source: Ofcom)

Podcasting is having a moment. Maybe, if we stretch just a bit, a year. And possibly even an era.

Twitter just bought podcasting platform Breaker, the app that took podcasting and made it social. And what began as a trend — Spotify buying podcast platforms Anchor and Gimlet in 2019 — is turning into a torrent as many of the other big players in technology are buying podcasts, podcasters, podcasting tools, and podcast publishing platforms.

Tech moves in eras.

There was the era of PCs. The era of search. The era of social, and the era of smartphones. None of these necessarily roll over and go away: like radio or TV or magazines, they adapt, morph, and persist as new eras and new paradigms take precedence. But each era focuses innovation and investment and attention in a new space.

Today podcasting is one of those spaces.

Illustrating how podcasting have captured the interest of people all over the globe in recent years, research company Grand View Research suggested that the global podcasting market size valued at USD 9.28 billion in 2019 and is expected to grow at a compound annual growth rate (CAGR) of 27.5% from 2020 to 2027. During the pandemic, listeners worldwide are observed to be spending more time at home due to work-from-home and social distancing policies – changing the entire dynamics of the market for podcasts, which used to have a pre-pandemic target audience of people listening to broadcasts during their commute. The industry is now expected to grow with engaged listeners who are stuck indoors while working from home.

Every year at this time, Edison Research and Triton Digital publish the results of a study called The Infinite Dial that tracks the use of digital audio and related media in the United States. It’s a study that dates back over 20 years—it got its name from the digital radio that was introduced at that time—and is well-respected for the rigor and consistency of its methodology. This year’s study shows how the pandemic has changed digital audio consumption habits. It also shows a few surprises in the streaming music sweepstakes.

The 2021 Infinite Dial results show that the use of online audio—including digital radio, AM/FM internet streams, podcasts, and music services—has plateaued at 68% of Americans ages 12 and up. But there are clear winners and losers, and they don’t merely reflect pandemic-related factors such as people staying at home.

One big winner is podcasting. Growth in podcast listenership shows no signs of tapering off, as monthly listenership continues its linear growth path to 41% penetration, up from 37% in 2020. Growth is particularly high in the 12-34 age bracket, more than half of whom now listen to podcasts regularly (while the 35-54 bracket levels off around 40%). Podcast listenership is also getting more racially diverse, with nonwhite listeners now at 43%, up from 37% last year.

Cuban shared his unique insights about the current and future state of  not just podcasting, but the entire media industry. We discussed both legacy media companies and independent creators.

Here are the main takeaways and my thoughts from our conversation:

1. Streaming is the future, and legacy companies need to get on  board in order to survive
2. These days, audio is just as competitive as video because the  barrier to entry is lower and there's no pressure to look nice
3. As new technology emerges, media will continue to evolve — and creators must keep up

Any summation of the past year begins and ends with COVID, even if we’re just talking about podcasts. Given everything that’s happened, how can it not?

We had just a little over two months of expected life in 2020 before counties across the United States started implementing initial lockdown measures, drastically altering the shape of everyday activity. Movement was scaled down, businesses were shuttered, and a great cloud of uncertainty descended upon the populace as this massive and utterly terrifying thing unfolded all around us.
