2. All the petitioners are accused in FIR No.40/2011 registered with Police Station Kotawali in the District of Jaisalmer for Offences under Sections 353, 332/34 of IPC and Section 3(1)(X) of Schedule Caste and Scheduled Tribe (Prevention of Atrocities Act).

3. By the impugned order dated 13.09.2023, the charges were ordered to be framed for offences under Sections 353, 332/34 of IPC as well as Section 3(1)(X) of Schedule Caste and Scheduled [2024:RJ-JD:44266] (2 of 5) [CRLAS-2169/2023] Tribe (Prevention of Atrocities Act), 1989 (for short "the Act of 1989").

4. The prosecution case is that on 31.01.2011, respondent No.2 along with other officials had gone to identify the area of encroachment on the public land made by Achal Singh, petitioner No.1. When the informant was measuring the site, all the petitioners objected and allegedly committed abuses like Bhangi, Neech, Bhikhari, Mangani to the informant and others and they committed assault as well.

~~~~~~~~~ The petitioners are depositors of the Kadanad Service Co-operative Bank Limited. Respondents 2 and 3 were the former President and Vice President of the Bank. Respondents 4 to 13 were former Committee Members. The 1 st respondent is the Secretary of the Bank.

2. The petitioners state that though the Fixed Deposits of the petitioners are matured long back, those deposits are not paid back. Respondents 1 to 13 committed grave offences. They cheated the Banks and its depositors. Huge loans were given to their own men creating false records and documents. Those loans are now irrecoverable. Ext.P1 inquiry report under 2024:KER:82916 Section 66(2) of the Kerala Co-operative Societies Act, 1969 would prove the misappropriation and forgery.

The petitioner had filed the present petition under Section 528 of B.N.S.S with a prayer to quash the impugned order dated 07.01.2023 (Annexure P-9) passed by the Court of Judicial Magistrate Ist Class, Amritsar, whereby the petitioner was declared as a proclaimed person in a case arising out of FIR No.140, dated 24.05.2021, registered under Sections 419, 420, 467, 468, 471, 448, 511, 506, 148, 149 and 120-B of IPC, Police Station Maqboolpura, District Police Commissionerate, Amritsar (Annexure P-1).

2. Learned counsel for the petitioner contends that the petitioner has been falsely involved in the abovesaid FIR (Annexure P-1). The petitioner was not initially named in the FIR and had no knowledge with regard to the pendency of the proceedings against him. Learned counsel further contends that even the summons/warrants were issued against the petitioner on a wrong address and he was never served in the present case. Even, the 1 of 6 Neutral Citation No:=2024:PHHC:146455 CRM-M-38364-2024 - 2-.

Two appeals, one preferred by the convicted appellant Satyajeet Singh and the other preferred by the parents of the deceased children, assailing the judgment and sentence by the former whereas the latter have preferred to assail the order on the CA Nos.114/2019 & 128/2019 Satyajeet Singh Vs. State & Anuradha Bhattacharya & Ors. Vs. State & Anr. Page 2 of21 sentence only. Both the appeals are taken up together inasmuch as both are arising out of the judgment dated 07.05.2019 and the order on sentence dated 09.05.2019 and are disposed off through the instant judgment.

2. Before adverting to the contentions of the appellants, facts are required to be looked into against the backdrop of which the appeals have emerged. A group of youngsters comprising of appellant Satyajeet Singh and three others namely Gaurav Sobti, Sneha Kapoor and Anirudh Rawat were out to enjoy an evening on 23.02.2008. They had come together at Chattarpur initially in a party hosted by "Red Bulls", where they reached at around 10.00- 10.30 pm and moved out from there in different lots and went to Park Hotel where they reached one after the other at around 01- 01.30 am. In fact, Gaurav Sobti and Anirudh Rawat were picked up by appellant Satyajeet Singh and they went to the party hosted by "Red Bulls" in Chattarpur, where Sneha Kapoor had also came with a friend. Gaurav along with his another friend Rohan, left for Park Hotel at Connaught Place and went to Dance at Disco Bar 'Agni'. The other friends also joined them after about half an hour, that is, Satyajeet, Anirudh Rawat and Sneha Kapoor. They had food, beer and juices etc., there. About 2 - 2 ½ hours were spent by these persons at Park Hotel and after finishing their dinner, etc., they all decided to go back home. Satyajeet Singh, appellant herein, offered to drop Gaurav Sobti, Sneha Kapoor and Anirudh Rawat in his car.

1. By order dated 3rd July 2024, the following substantial questions of law were framed for hearing the Second Appeal finally at the admission stage :

(i) Whether the First Appellate Court could have enhanced the quantum of the plaintiff's claim in the absence of any cross-

appeal or cross-objection preferred by the plaintiff ?

(ii) Whether the quantum regarding the claim of the plaintiff decreed by both the Courts is on correct appreciation of the Surveyor's report at Exhibit-59, relied upon by the appellant ?

(iii) Whether the appellant proved that there was any fraud committed by the plaintiff at the time of submitting the claim ?

It is submitted on behalf of the petitioner he has been falsely implicated in the instant case. Investigation is complete. Accordingly, he prays for anticipatory bail.

2. Learned Advocate for the State opposes the prayer for anticipatory bail and submits victim was a minor.

3. Learned Advocate for the de-facto complainant also opposes the prayer for anticipatory bail.

4. We have considered the materials on record. Victim was a minor and the petitioner subjected her to sexual assault. However, investigation is complete. Under such circumstances, we are of the opinion custodial interrogation of the accused/petitioner is not necessary and he may be granted anticipatory bail however, subject to strict conditions.

Heard the learned Counsels for the parties.

2. We have considered the materials on record. Petitioner is involved in trafficking women for sexual exploitation. Date has been fixed for recording evidence. Under such circumstances we are not inclined to grant bail to the petitioner.

Learned Counsel for the petitioner submits there was an intimate relationship between two young persons. They had eloped and married voluntarily. He prays for anticipatory bail.

2. Learned Counsel for the State opposes the prayer for anticipatory bail and submits victim is a minor.

3. We have considered the materials on record. Statement of the minor supports the contention of the petitioner. Under such circumstances, we are of the opinion no worthwhile purpose would be served in committing the petitioner to custody. Accordingly, we are inclined to grant anticipatory bail to the petitioner.
