The Department today commemorated the 15th anniversary of the Violence Against Women Act (VAWA), which was signed into law on September 13, 1994.

The Department today filed a lawsuit in federal court in Michigan alleging that Knight Protective Service Inc., willfully violated the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA) by failing to promptly and properly reemploy King A. Gatten, a retired Army servicemember, when he returned from military service.

James Wilbur Fondren Jr., was convicted by a federal jury today on charges involving providing classified information to a man working with the People’s Republic of China (PRC) and lying to the FBI about it.

Formosa Plastics Corp., Texas, and Formosa Plastics Corp., Louisiana, will spend more than $10 million on pollution controls to address air, water, and hazardous waste violations at two petrochemical plants in Point Comfort, Texas, and Baton Rouge, La.

Gary Fillers pleaded guilty to one criminal felony count for conspiring to violate the Clean Air Act’s “work practice standards” related to the proper stripping, bagging, removal and disposal of asbestos.

A federal judge today assessed the Southern Union Company $18 million for illegally storing mercury at a company-owned site in Pawtucket.

Arctic Glacier International Inc., headquartered in St. Paul, Minn., has agreed to plead guilty and to pay a $9 million criminal fine for allocating customers. Three of the company’s former executives pleaded guilty for their roles in the conspiracy.

Mylan Pharmaceuticals, UDL Laboratories, AstraZeneca Pharmaceuticals and Ortho McNeil Pharmaceutical have entered into settlement agreements for a total of $124 million to resolve claims that they violated the False Claims Act by failing to pay appropriate rebates to state Medicaid programs for drugs paid for by those programs.

Three Ohio residents, Mohammad Zaki Amawi, 29, Marwan Othman El-Hindi, 46, and Wassim I. Mazloum, 28, have been sentenced to prison terms ranging from more than 8 years to 20 years for conspiring to commit terrorist acts against Americans overseas, including U.S. military personnel in Iraq, and other terrorism-related violations.

Rodolfo Rodriguez Cabrera, 43, a Cuban national, was arraigned today in U.S. District Court for the District of Nevada on charges of producing and selling counterfeit slot machines and counterfeit computer programs.

"This settlement demonstrates our vigilant protection of the employment rights of our servicemembers, and our commitment to vigorous enforcement of the laws that protect them," said Thomas E. Perez, Assistant Attorney General for the Civil Rights Division.

The United States today sued Lincoln Fabrics Ltd., a Canadian company, and Lincoln Fabrics Inc., aka Lincoln Textiles Inc., its American subsidiary, under the False Claims Act in connection with the companies’ weaving and sale of defective Zylon fabric which was used as the key ballistic material in bullet-proof vests.

Noel Wayne Jhagroo, 47, pleaded guilty to conspiracy to commit health care fraud before U.S. District Judge Vanessa Gilmore in the U.S. District Court in Houston. 

Laura Wang-Woodford, a U.S. citizen who served as a director of Monarch Aviation Pte Ltd., a Singapore company that imported and exported military and commercial aircraft components for more than 20 years, was sentenced today in federal court in Brooklyn to 46 months in prison for conspiring to violate the U.S. trade embargo by exporting controlled aircraft components to Iran.

“I am pleased to welcome Ignacia back to the Department and the Environment and Natural Resources Division,” said Attorney General Holder.

The United States has reached a settlement resolving a housing discrimination lawsuit in Tennessee concerning discrimination against families with children, the Justice Department announced.

Under the settlement, which must still be approved by the court, 11 defendants will pay all costs related to making the complexes for which they were responsible accessible to persons with disabilities.

Laurie O. Robinson was sworn in today as Assistant Attorney General in the U.S. Department of Justice’s Office of Justice Programs (OJP).

After conducting a careful investigation of the proposed transaction between Oracle and Sun, the Department’s Antitrust Division concluded that the merger is unlikely to be anticompetitive.

The all-day workshops, which will begin in March 2010, will be held in Alabama, Colorado, Iowa, Washington, D.C. and Wisconsin.

The lawsuit, which was filed in the U.S. District Court for the Northern District of Georgia, alleges that since 2003, defendants have violated the False Claims Act.

A federal court in Boston issued a judgment against Excel Home Care Inc. in the amount of $473,510.76 for unpaid federal employment and unemployment taxes after its owner Diane E. Porter consented to the entry of an order of permanent injunction that prohibits her or anyone else from operating this Tewksbury, Mass., home health care provider.

A Washington, D.C., fish wholesaler and two of its employees have been charged in U.S. District Court in Maryland for the purchase of illegally harvested striped bass, commonly referred to as rockfish, from the Potomac River from 1995 through 2007.

Our Lady of Lourdes Health Care Services Inc., the parent company of two New Jersey hospitals, has agreed to pay the United States $7.95 million to resolve allegations that the hospitals defrauded Medicare.

The Department filed a brief as a friend of the court in Marlo M., et al. v. Cansler, et al., a community integration case in federal court for the Eastern District of North Carolina.

Aristotle R. Matsa, an attorney in Columbus, Ohio, was charged with tax offenses, obstruction of justice and additional charges in a 20-count indictment unsealed today.

UTStarcom Inc. (UTSI) has entered into an agreement with the Department of Justice, agreeing to pay a $1.5 million fine for violations of the Foreign Corrupt Practices Act by providing travel and other things of value to foreign officials, specifically employees at state-owned telecommunications firms in the People’s Republic of China.

The United States this week filed five civil injunction lawsuits in Detroit, Cincinnati and Chicago against several individuals and their tax preparation services.

A former Army and Air Force Exchange Service (AAFES) official was sentenced today in U.S. District Court in Columbus, Ga., to three years in prison for his role in a bribery conspiracy involving a multi-million dollar telecommunications contract, and for not reporting the bribes he accepted on his income tax returns.

Michael Sayklay, the former vice president of Economy Cash & Carry Inc., a Texas-based grocery wholesaler, pleaded guilty today in federal court in El Paso, Texas, to a criminal violation of the Plant Protection Act.

A Florida man has been sentenced to 90 months in prison for making e-mail and telephone threats, including threats intended to cause a candidate for statewide office in Florida to drop out of an election.

Anthony Mowl, the former assistant vice president of business development for Viable Communications Inc. (Viable), and Donald Tropp, the former human resources manager for Viable, pleaded guilty today to engaging in a conspiracy to defraud the Federal Communications Commission’s (FCC) Video Relay Service (VRS) program of more than $2.5 million, announced Assistant Attorney General Lanny A. Breuer of the Criminal Division.

Paul Schlesselman pleaded guilty to one count of conspiracy, one count of threatening to kill and inflict bodily harm upon a presidential candidate, and one count of possessing a firearm in furtherance of a crime of violence.

Manual Deluna has pleaded guilty to one count of conspiracy to commit health care fraud in connection with his role in Memorial Medical Supply, a Houston durable medical equipment company.

The 16 indictments unsealed today represent the largest single investigation and prosecution against individuals in the history of DOJ’s enforcement of the Foreign Corrupt Practices Act.

As a part of the tax conspiracy, Ronald Boyarsky assisted in paying approximately $2.6 million in commissions earned by a printing services broker to third parties, so that the broker and his companies could avoid paying taxes on the income they earned.
