1. These Writ Petitions broadly fall in following three categories:-

A] Writ Petition (Civil) No. 936 of 2018 filed by four petitioners, prays for appropriate directions that after the promulgation of Rajasthan Judicial Service Rules, 2010 (“2010 Rules”, for short), all appointments ought to be in conformity with 2010 Rules and allocation of seniority must be in accordance with the Cyclic Order provided in Schedule VII to 2010 Rules. In terms of 2010 Rules, posts in the cadre of District Judges in the Higher Judicial Service in State of Rajasthan were required to be filled up in accordance with quota of 50% for Promotees, 25% for Direct Recruits and 25% by way of Limited Competitive Examination Writ Petition (Civil) No.936 of 2018 etc etc. Dinesh Kumar Gupta & Ors. v. 1. Most of the cases have a chequered history. Initially, petitioners have questioned four notifications ­ two notifications dated 21.12.2010 issued by Medical Council of India (for short, ‘the MCI’) and other two notifications dated 31.5.2012, issued by Dental Council of India (for short, ‘the DCI’). The MCI by virtue of Regulations on Graduate Medical Education (Amendment) 2010, (Part II) notified by the Government of India, amended the Regulations on Graduate Medical Education, 1997. Similarly, the other notification issued by MCI called “Post­Graduate Medical Education (Amendment) Regulation, 2010 (Part­II)” to amend the Post Graduate Medical Education Regulations, 2000. The regulations came into force on their publication in the Official Gazette. The other two notifications dated 31.5.2012 issued by DCI were relating to admission in the BDS and MDS courses.

2. This appeal arises out of the final judgment and order dated 14.12.2018 passed by the High Court1 in Writ Petition (Civil) No.2730 of 2018 preferred by the appellant herein.

3. The facts leading to the filing of this appeal, in brief, are as under:-

The appeal is directed against judgment dated 27.5.2017 passed by Additional Sessions Judge (FTC), Bastar at Jagdalpur/ Special Judge under the Protection of Children From Sexual Offences Act, 2012 (for short 'the Act 2012'), in Special Session Trial No.02/2017 wherein the said Court convicted appellant for commission of offence under Section 376(2)(i) of the Indian Penal Code, 1860 and under Section 4 of the Act 2012 and sentenced him to undergo rigorous imprisonment for 10 years and to pay fine 2 of Rs.1000/- and RI for 07 years and to pay fine of 1000/- respectively with default stipulation.

2. As per the version of the prosecution, the date of incident is 16.01.2017. Prosecutrix is PW-6 who is aged about 04 years. Said prosecutrix complained of pain to her mother on which her mother examined her private parts and found redness and swelling. On enquiry the prosecutrix intimated her mother that the appellant after putting soap inserted his finger in her private part. The matter was reported and investigated. The appellant was charge sheeted and convicted as mentioned above.

The appeal is directed against judgment dated 06.4.2010 passed by Sessions Judge Raipur in Session Trial No.161/2008 wherein the said Court convicted appellant for commission of offence under Section 304 Part-II of the Indian Penal Code, 1860 and sentenced him to undergo rigorous imprisonment for 05 years and to pay fine of Rs.1000/- with default stipulation.

2. In the present case, name of the deceased is Kalu @ Tarun Bagh. As per the version of the prosecution, on 11.6.2008 at 2 noon, the appellant and the deceased were drinking liquor in the house of the appellant. During the course of drinking, a dispute arose regarding daughter of the appellant namely Suman. On this dispute, the appellant and other persons assaulted the deceased and the appellant sat on the chest of the deceased and pressed his neck due to which the deceased become unconscious. He was taken to hospital but succumbed to the injuries. The matter was reported, investigated and the appellant was charge sheeted and convicted as mentioned above.

1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Eastern Railway, DRMO Howrah Division seeking information on two points, including,

b) To provide a copy of seniority list of Track Maintainer III and IV from 2007 to 2015.

2. The CPIO, vide reply dated 27.04.2020, provided requisite information to the appellant. The appellant filed a first appeal dated 24.04.2018 on the ground of no information furnished by the CPIO. The first appeal was not disposed of by the FAA. Thereafter, the appellant filed a second appeal u/Section 19(3) of the RTI Act before the Commission on the ground of non-receipt of information and requested the Commission to direct the CPIO to provide the information sought for.

1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Eastern Railway, Sealdah Division, Kolkata seeking information on two points pertaining to his representation dated 31.05.2018, including,

2. Having not received any response from the CPIO, the appellant filed a first appeal dated 25.07.2018. The first appeal was not disposed of by the FAA. Thereafter, the appellant filed a second appeal u/Section 19(3) of the RTI Act before the Commission on the ground that no information has been furnished by the respondent and requested the Commission to direct the CPIO to provide the information sought for and take appropriate legal action against the CPIO and the FAA.

1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), East Central Railway, DRMO, Jharkhand seeking information on six points pertaining to technician post, including, inter-alia;

a) Is the proof of validation issued in the railway hospital by the screening committee on the optional post after medical distortion valid,

b) What is the medical category for the post of Technician Grade-III,

c) Does the post of technician grade-III fall in the category of sedentary job. And other related information.

2. The CPIO, vide reply dated 09.05.2018, provided point wise information to the appellant. Being dissatisfied by the information provided on point nos. 3 and 6, the appellant filed a first appeal dated 25.05.2018. FAA, vide order dated 15.06.2018, upheld the CPIO's reply. Thereafter, the appellant filed a second appeal u/Section 19(3) of the RTI Act before the Commission on similar grounds and requested the Commission to direct the CPIO to provide the information sought for.

The appellant filed an online application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Eastern Railway, Kolkata seeking information regarding General Conditions to Contract applicable to the works (contracts) under Eastern Railways for the year 2000, 2003 and 2010-2018.

2. The CPIO, vide letter dated 13.07.2018, offered inspection to the appellant. Being dissatisfied, the appellant filed a first appeal dated 30.07.2018 requesting to provide the information sought for. FAA, vide order dated 28.08.2018, upheld the reply of CPIO. We see that one thing that the petitioner has sounded in the status report dated 28 th April, 2020 submitted by him is to provide undersea cable link for ensuring better connectivity and communication to the islanders. He has also pointed out that in the fitness of things it would be proper that the High Court Monitoring Committee appointed by this Court should also include an independent medical expert who can 2 advise the Monitoring Committee on medical matters. It is suggested that High Court Monitoring Committee includes a person who has expertise in the management of contagious diseases.

Learned counsel for the petitioner submits that notice of hearing of the writ petition was served on the DMC by mail today ,i.e. the 7th of May, 2020.

By the impugned notice the petitioner has been threatened with eviction from the premises in issue inspite of the submitted fact that the respondents/DMC is still collecting rents from the petitioner.

The petitioner also alleges that the impugned notice is not preceded by a show cause alleging any acts of omission or commission on the part of the petitioner to continue to be in possession of the premises 2 in issue which the petitioner further submits is under an active lease which has not been terminated.

The Petitioner is aggrieved by the notification issued by the Department of Urban Development and Municipal Affairs, Government of West Bengal dated 6.5.2020 being no. 334/MA/O/C­4/1A­1/2020 as issued by its Principal Secretary.

By the said impugned notification the powers of the Kolkata Municipal Corporation (KMC) has been vested on a Board of Administrators (BOA).
