"At the core of the complaint is a simple story. If you were African-American or Latino, you were more likely to be placed in a subprime loan or pay more for your mortgage loan, even though you were qualified and deserved better treatment. This is a case about real people-African American and Latino- who suffered real harm as a result of Wells Fargo’s discriminatory lending practices," said Assistant Attorney General Perez.

The Department of Justice and the U.S. Environmental Protection Agency announced today an agreement with over three dozen companies and government agencies that will result in a $56.4 million cleanup of the “Malone Services Company” Superfund Site in Texas City, Texas, a former waste-disposal site near the shore of Galveston Bay.

Two foreign nationals have pleaded guilty for their roles in a scheme to traffic the identities of Puerto Rican U.S. citizens and corresponding identity documents.

The decree places tools in the hands of the entire community so that long after the agreement has ended, effective, constitutional policing will endure. There are creative approaches to assessing compliance that focus on meaningful outcomes and encourage innovation," said Assistant Attorney General Perez.

It is fitting that I come before you today, on the 22nd anniversary of the Americans with Disabilities Act, a landmark law that represents a bipartisan tradition of evenhanded civil rights enforcement," said Assistant Attorney General Perez.

"Thanks to the work of so many of you in this room, the ADA has both literally and figuratively opened millions of doors for individuals with disabilities across this nation. Just as importantly, it has revolutionized the way our society thinks about individuals with disabilities, and it has revolutionized the way people with disabilities live in our communities," said Assistant Attorney General Perez.

Daniyar Zhaxalyk, 26, a citizen of Kazakhstan who entered the United States on a student visa, was sentenced today to 27 months in prison for his role in a sophisticated stock fraud scheme that caused more than $400,000 in losses.

"For more than a century, UNCA has worked to improve conditions in distressed neighborhoods and restore opportunity to those who live there," said Acting Associate Attorney General West.

Pfizer H.C.P. Corporation, an indirect wholly owned subsidiary of Pfizer Inc., has agreed to pay a $15 million penalty to resolve an investigation of Foreign Corrupt Practices Act (FCPA) violations.

Richard Kellogg Armstrong, 77, of Prescott, Ariz., was sentenced today by U.S. District Court Judge Robert E. Blackburn to 108 months in prison followed by three years of supervised release. Judge Blackburn ordered the sentence to run consecutively to the 660 day prison term and $1,021,500 of fines cumulatively imposed upon Armstrong as punitive sanctions for 10 acts of contempt of court. He also ordered Armstrong to pay restitution to the Internal Revenue Service (IRS) in the amount of $1,678,834 and to forfeit two residences and a personal aircraft. The sentence was announced by the Justice Department’s Tax Division, the U.S. Attorney’s Office for the District of Colorado and the IRS Criminal Investigation Denver Field Office. Codefendant Curtis L. Morris, age 43, of Elizabeth, Colo., is scheduled to be sentenced on Nov. 6, 2012.

A federal jury in Washington, D.C., today returned guilty verdicts against Sanford Ltd., a New Zealand fishing company, on six counts of conspiracy, obstruction of justice, and violating the Act to Prevent Pollution from Ships.

An executive of Tokyo-based Yazaki Corporation has agreed to plead guilty for his role in a conspiracy to fix prices of instrument panel clusters, also known as meters, installed in cars sold in the United States and elsewhere.

The Department of Justice announced today that it will require Verizon and four of the nation’s largest cable companies—Comcast, Time Warner Cable, Bright House Networks and Cox Communications—to make changes to a series of agreements concerning both the sale of bundled wireless and wireline services, and the formation of a technology research joint venture. The department said that, if left unaltered, the agreements would have harmed competition by diminishing the companies’ incentive to compete, resulting in higher prices and lower quality for consumers.

Gino Carlucci was sentenced to 188 months in prison for his role in conspiracies to commit money laundering and to defraud the Internal Revenue Service (IRS), and for filing a false income tax return, the Justice Department and the IRS announced today. On July 25, 2011, a federal jury in Phoenix convicted Carlucci of both conspiracies and the tax crime after an eight-day trial.

William Duran Vizzerra Jr. pleaded guilty today to illegally disposing of hazardous waste, a felony criminal offense, at a storage lot in Anchorage, Alaska.

The department said that this is the first time website domains involving cell phone app marketplaces have been seized.

The United States has joined a whistleblower lawsuit against The Gallup Organization, the Justice Department announced today. The lawsuit was filed by Michael Lindley, a former Gallup employee, who alleges that Gallup violated the False Claims Act by making false claims for payment under contracts with the U.S. Mint, the State Department and other federal agencies to provide polling services for various government programs.

The Justice Department announced today that it will monitor elections on Aug. 28, 2012, in Lanett, Reform, and Phenix City, Ala., and Maricopa County, Ariz., to ensure compliance with the Voting Rights Act of 1965. The Voting Rights Act prohibits discrimination in the election process on the basis of race, color or membership in a minority language group.

The Department of Justice, Civil Rights Division, and the Department of Education, Office for Civil Rights, today entered into a settlement agreement with the Arizona Department of Education (ADE) that requires ADE and Arizona public schools to offer targeted reading and writing intervention services to tens of thousands of English Language Learner (ELL) students who were prematurely exited or incorrectly identified as Initially Fluent English Proficient (IFEP) over the past five school years. The agreement also requires ADE to develop proficiency criteria that accurately identify and exit ELL students.

Simon Jasper McCarty, 39, was sentenced by U.S. District Judge J. Michael Seabright of the District of Hawaii.

Rafael Joaquin Beltre-Beltre, 35, formerly of Caguas, Puerto Rico, pleaded guilty to one count of conspiracy to commit identification fraud, one count of conspiracy to commit alien smuggling for financial gain and one count of international money laundering.

Joshua Schichtel, 30, of Phoenix, was sentenced today to 30 months in prison for selling command-and-control access to and use of thousands of malware-infected computers.

John Wyss, aka “Bones,” 55, of Monroe, Wis., was sentenced by U.S. District Judge Maurice Hicks in the Western District of Louisiana.

Roland J. Flath, 72, of Fond du Lac, Wis., was sentenced in U.S. District Court in the Eastern District of Wisconsin by Judge J.P. Stadtmueller.

A federal grand jury in Montgomery, Ala., charged James Timothy Turner, also known as Tim Turner, with conspiracy to defraud the United States, attempting to pay taxes with fictitious financial instruments, attempting to obstruct and impede the Internal Revenue Service, failing to file a 2009 federal income tax return and falsely testifying under oath in a bankruptcy proceeding.

A 22-count federal indictment was unsealed today in federal court in New Orleans charging Connie M. Knight, 46, with impersonating a federal employee for the purpose of enticing people to pay her for fraudulent hazardous waste safety training.

New Mexico-based Akal Security, Inc., one of the largest providers of security services at federal courthouses, agreed to pay $1,875,000 to resolve allegations that it failed to appropriately conduct firearms testing in the Northern District of California.

Suiza Dairy has agreed to pay a penalty and make significant upgrades to settle Clean Air Act violations, the Department of Justice and the U.S. Environmental Protection Agency (EPA) announced today.

Andrew Strempler, a Canadian citizen, pleaded guilty today in the Southern District of Florida for his role in a scheme to defraud consumers purchasing pharmaceuticals online, the Justice Department announced. Strempler faces up to five years in prison, a forfeiture of $300,000, a fine and restitution.

Arizona State Representative Paul Ben Arredondo pleaded guilty today in Phoenix federal court, admitting that he solicited and took a bribe in exchange for promises of official action both as a city councilmember and a state representative.

BP Exploration and Production Inc. (BP) has agreed to plead guilty to felony manslaughter, environmental crimes and obstruction of Congress and pay a record $4 billion in criminal fines and penalties for its conduct leading to the 2010 Deepwater Horizon disaster that killed 11 people and caused the largest environmental disaster in U.S. history, Attorney General Eric Holder announced today.

"Too many of our neighbors are still victims of discrimination, bigotry, and violence. Too many are denied opportunities to participate fully in their communities and build valued lives for their families. But at the Division, we are in the opportunity business. And we are committed to working together with all of you to expand access to the promise of American life and the fundamental civil rights protected by our federal laws," said Assistant Attorney General Perez.

A federal judge sentenced Spokane, Wash., Police Officer Karl F. Thompson Jr. to 51 months in prison followed by three years supervised release for civil rights and obstruction violations stemming from his March 18, 2006, beating of an unarmed citizen and an extensive cover-up that followed, the Justice Department announced today. Following a Taser deployment and a rapid series of baton blows to the head, neck and body, the victim, the late Otto Zehm, 36, was hogtied, stopped breathing and was transported to the hospital, where he died two days later. The defendant claimed the beating was justified because he felt threatened by a plastic bottle of soda Zehm was holding.

"Let’s work to prevent fraud, but let’s not erect new, unnecessary requirements that have a discriminatory impact. Let’s have a debate on the merits without trying to make it harder for our perceived opponents to vote," said Assistant Attorney General Perez.

"We are a nation of great principles of religious freedom. But as we have learned, these principles are not self-executing. We have to work hard to preserve them," said Assistant Attorney General Perez.

Jose Sergio Garcia-Ramirez, 37, formerly of Rockford, Ill., was sentenced by U.S. District Judge Gustavo A. Gelpí, in the District of Puerto Rico.

"The road ahead will be difficult. This work is not easy, but this independent review is critical to ensuring and preserving trust between a police department and the community it serves," said Assistant Attorney General Perez.

The Department of Justice today announced the opening of their comprehensive grant solicitation period for funding to support public safety, victim services and crime prevention improvements for American Indian and Alaska Native tribal governments.
