(United States Ninth Circuit) - In a petition for review challenging an Objection Letter sent by the EPA regarding draft permits for water reclamation plants in El Monte and Pomona, California, the petition is dismissed for lack of subject matter jurisdiction where neither 33 U.S.C. section 1369(b)(1)(E) nor (F) of the Clean Water Act provided the court with subject matter jurisdiction to review the Objection Letter.

(United States Ninth Circuit) - In an antitrust lawsuit alleging a power district had attempted to entrench its monopoly by setting prices that disfavored solar-power providers, defendant's appeal of the district court order denying its motion to dismiss the suit based on the state-action immunity doctrine, is dismissed for lack of jurisdiction where the collateral order doctrine does not allow an immediate appeal of an order denying a dismissal motion based on state-action immunity.

(California Court of Appeal) - Reversing the dismissal of a claim relating to the alleged conflict of interest in the acquisition of property by the San Lorenzo Valley Water District's acquisition of property where one of the District's directors had partial ownership of the agency facilitating the sale of the property and whose wife was its listing agent because the former owner had standing under the Government Code to bring the action and that the action was not subject to validation statutes because it was a conflict of interest rather than a contracts claim.

(United States Fifth Circuit) - Held that defendant rural power cooperatives were entitled to remove a case from state to federal court. The lawsuit alleged that they had unlawfully failed to provide certain refunds to their members. Reversed a remand order, in these three consolidated cases.

(California Court of Appeal) - Affirmed. Plaintiff sued to prevent Defendant from violating city zoning laws to construct a solar energy project. Defendant claimed an exemption under Gov. Code, section 53091 and 53096. Court found that exemption does not apply and that there was no finding that no feasible alternative was available.

(United States Federal Circuit) - Affirmed in part and vacated in part where a jury found that defendant had infringed on plaintiff's patents and had awarded damages based on the entire market value rule. The Federal Circuit court affirmed the infringement judgment, but vacated the damages award stating that the entire market value rule could not be used in this case.

(United States Federal Circuit) - Denied petitions for writ of mandamus. Plaintiff sought a writ challenging the decision of the Patent Trial and Appeal Board denying the institution of inter partes review of claims from three patents owned by Semiconductor Components industries, LLC.

(Court of Appeals of New York) - Conviction for first-degree murder and other crimes is affirmed. The Court held that New York's standard for admitting evidence of third-party culpability, articulated in People v. Primo, 96 N.Y.2d 351 (2001), is consistent with Holmes v. South Carolina, 547 U.S. 319 (2006) and does not infringe on a defendant's constitutional right to present a complete defense.

(Court of Appeals of New York) - In consolidated criminal actions concerning the People's change of their readiness status after having previously filed off-calendar statements of readiness, the Court held that there is a rebuttable presumption that such statements were truthful when made and that defendants can rebut the presumption with a demonstration that the People were not, in fact, ready at the time the statement was filed.

(Court of Appeals of New York) - Conviction for criminal possession of a weapon is affirmed where: 1) defendant failed to preserve his argument that the trial court erred by re-imposing the original sentence after reversal on appeal; and 2) defense counsel's failure to challenge the resentencing was not ineffective assistance of counsel.

(United States Fifth Circuit) - Partially affirmed, partially reversed. The removal of children from a home under investigation for abuse did not result in substantive due process violation, but did result in procedural due process rights violation.

(United States Fourth Circuit) - In an action challenging defendant Towson University's refusal to allow plaintiff to return to playing football after he suffered a near-death heat-stroke induced coma requiring a liver transplant and additional surgeries, the district court's judgment for plaintiff under Title II of the Americans with Disabilities Act is reversed where plaintiff was not otherwise qualified to participate in defendant's football program under defendant's reasonably applied Return-to-Play Policy.

(United States Supreme Court) - Held that a property owner whose property has been taken by a local government may go directly to federal court to assert a claim under the Takings Clause. Overruled a 1985 Supreme Court precedent (Williamson County Regional Planning Comm'n v. Hamilton Bank of Johnson City), which had said that a property owner must first seek just compensation under state law in state court before bringing a federal takings claim under Section 1983. Chief Justice Roberts delivered the opinion of the 5-4 Court.

The ordinance was preempted by the Interstate Commerce Commission Termination Act. Affirmed a permanent injunction against the town.

Remanded to the agency for reconsideration in regard to legacy wastewater and combustion residual leachate, in this challenge brought by environmentalists, utilities and others.

(United States DC Circuit) - Granted in part. In a petition to review an order loosening regulations to allow microcell transmission towers supporting cell phone reception to be built on or near Native American cultural sites, the FCC's determination that it wasn't in the public interest to review small cell deployment was arbitrary and capricious.

(United States Third Circuit) - Rejected challenges to a natural gas pipeline project but remanded on one issue. Local governments and an environmental organization argued that the Federal Energy Regulatory Commission acted arbitrarily and capriciously in approving a proposed interstate pipeline expansion, but the Third Circuit rejected this argument. However, on a separate issue, the panel remanded to the New Jersey Department of Environmental Protection with instructions to reconsider the petitioners' request for an adjudicatory hearing.

(United States Ninth Circuit) - In a case challenging California's "Shark Fin Law," which makes it "unlawful for any person to possess, sell, offer of sale, trade, or distribute a shark fin" in the state, the district court’s dismissal of plaintiff's amended complaint is affirmed where the claim that the Shark Find Law is preempted by the Magnuson-Stevens Fishery Conservation and management Act is without merit, as plaintiffs failed to identify any actual conflict between federal authority under the Magnuson-Stevens Act to manage shark fishing in the ocean off the California coast and the California Shark Fin Law.

(United States Second Circuit) - In an international trademark action involving rival claims to the "Stolichnaya" trademarks, the district court's dismissal is vacated in part and affirmed in part where: 1) considerations of international comity precluded the district court from determining that the Russian Federation's assignment of trademark rights to plaintiff was invalid under Russian law and dismissing plaintiff's claims under section 32(1) of the Lanham Act for lack of standing; but 2) plaintiff's remaining claims are barred by res judicata and laches.
