Disagreeing, the Seventh Circuit held that the longstanding tax code exemption for religious housing is constitutional, reversing the district court.

(United States Seventh Circuit) - Revived a parochial school's claim that its students were being denied state‐funded bus transportation equivalent to public-school students, contrary to Wisconsin law and the Equal Protection Clause. Reversed summary judgment in relevant part and remanded.

(United States Fifth Circuit) - Held that a company had legal standing to challenge a city council resolution barring it from holding a controversial love- and sex-themed expo at the city's convention center. Reversed the district court's ruling on standing, which was based on the specific language of the resolution, in a case where the company asserted First Amendment, equal protection, and other claims against the city.

(United States Ninth Circuit) - Affirming that a 1999 amendment to trademark statutes did not eliminate the plaintiff's requirement that they establish wilfulness to justify the award of defendant's profits in a trademark infringement case, but reversing the holding that the defendant's mark was not likely to cause confusion and remanding for inquiry into intent.

(United States Second Circuit) - Reversed summary judgment for an apparel company in its trademark infringement action. A company that sold leather jackets branded ROGUE contended that a commercial brewery that sold ROGUE-branded beer had infringed its trademark by using the name on t‐shirts and hats. The Second Circuit held that the apparel company was not entitled to summary judgment, because the brewery was the senior user and the evidence did not show that it was precluded by laches.

(United States Fifth Circuit) - Held that the First Amendment's commercial speech protections entitled a company to operate automotive service centers under the name "Tire Engineers," even though a state board that licenses engineers objected to the use of the profession's occupational title. Reversed and rendered summary judgment in favor of the company, in this declaratory judgment action.

(United States Supreme Court) - Held that the Tennessee Valley Authority is subject to suits challenging any of its commercial activities, just as if it were a private corporation supplying electricity. The TVA insisted that, as a government-owned corporation, it has sovereign immunity from all tort suits arising from its performance of so-called discretionary functions. However, the U.S. Supreme Court disagreed in a unanimous opinion delivered by Justice Kagan.

(United States Supreme Court) - Struck down a Tennessee requirement that applicants for a license to operate a retail liquor store have resided in the State for the prior two years. Held that the residency requirement violates the Commerce Clause because it blatantly favors the State's residents and has little relationship to public health and safety, and further held that the Twenty-first Amendment does not save the state law. Justice Alito delivered the opinion of the 7-2 Court.

(United States Seventh Circuit) - Held that an Iranian national may not appeal the revocation of his petition for conditional permanent residency. Affirmed the ruling below, which concluded that Congress has stripped the courts of jurisdiction to review discretionary revocations of visa petitions.

(United States Fifth Circuit) - Vacated and complaint dismissed. Plaintiff sought declaratory judgment against Defendant, Homeland Security, claiming that DHS improperly denied application for legal permanent resident. Appellate court held that Plaintiff failed to state a legally cognizable claim.
