Virginia Gun Range Can Reopen — Governor Overstepped His Authority, Judge Rules

A Virginia gun range can remain open, despite Gov. Ralph Northam's order closing nonessential businesses throughout the state in response to the coronavirus pandemic, a state judge ruled Monday.

In a March executive order, Northam had included indoor shooting ranges among the businesses to be temporarily shuttered to stop the spread of COVID-19. In response, the shooting range SafeSide sued, asking a court to block the order. Judge F. Patrick Yeatts granted the request, prohibiting law enforcement from blocking citizens' access to the gun range.

Northam lacks the authority to close gun ranges, Yeatts said, because of a state statute, modeled on the Second Amendment to the U.S. Constitution, giving citizens the right to bear arms. "During an emergency, the governor is given great deference, but [the statute] specifically limits his authority in relation to the right to keep and bear arms," Yeatts wrote.

"The purpose of the right is to have a population trained with firearms in order to defend the Commonwealth," Yeatts wrote. "Proper training and practice at a range ... is fundamental to the right to keep and bear arms."

"The Court understands the Governor's desire to protect the citizens of our great commonwealth," Yeatts said. "But in taking steps to stop the spread of COVID-19, he took a step beyond what is allowed."

In a statement, Attorney General Mark Herring said that his office was considering how to respond. "Governor Northam's efforts to save lives and slow the spread of COVID-19 are necessary and proving to be effective, but unfortunately, the gun lobby believes the ability to shoot a gun indoors during this pandemic is worth risking further spread of the virus and making Virginia communities and families less safe," Herring said, according to the Associated Press.

University of Virginia law professor Richard Schragger told The Virginian-Pilot that the ruling only applies to the Lynchburg gun range — but the reasoning could apply to any subsequent lawsuits brought by other gun ranges in the state.

SafeSide was joined on the lawsuit by Gun Owners of America, the Association of Virginia Gun Ranges and the Virginia Citizens Defense League. Philip Van Cleave, president of the Virginia Citizens Defense League, told the AP his group would try to get a broader ruling that applied statewide.

L.A. Philharmonic To Take Over Operations At Ford Theatre

The L.A. Philharmonic will be the new operator of the John Anson Ford Theatre, the smaller outdoor venue near  the 101 Freeway across from the Hollywood Bowl, under a plan approved by the Los Angeles County Board of Supervisors.  

L.A.  funding sustains the Ford, and the county recently spent $80 million renovating the 1,200  seat amphitheater.  But attendance has been lackluster — and Supervisor Sheila Kuehl hopes the L.A. Philharmonic can change that. 

“The Ford will be able to take advantage of the natural synergies in marketing, capacity-building and program resources that simply haven’t been available to the Ford as an independent institution," she  said.

The move by the L.A. County  blindsided many local artists.  They say the Ford is an important incubator for diverse talent.  They also worry ticket prices will increase.  Prompted by their criticism, the Supervisors will require the Phil to meet with artists and annually review the diversity of the Ford’s shows with county officials.

White House Rejected 'Overly Prescriptive' CDC Guidance For Reopening Communities

The White House coronavirus task force rejected detailed guidance drafted by the Centers for Disease Control and Prevention on how workplaces ranging from schools to bars to churches should resume operations to prevent the spread of the virus because it was viewed as "overly prescriptive."

President Trump has said he wants to see the country begin to reopen. The pandemic crashed the economy by keeping people at home, leading to millions of job losses. The White House task force issued guidelines on how to gradually and safely reopen but left decisions up to governors based on conditions in their states.

Experts have warned that a rush to reopen could have disastrous implications for containing COVID-19. Many businesses have said they want more details about how to do things safely.

The draft detailed guidance was provided to the task force in late April, a couple of weeks after it released its April 16 guidance to states for reopening.

The task force sought "certain revisions" to the CDC's detailed guidance, two administration officials told NPR. But revised recommendations were never returned to the task force.

The Associated Press first reported on the task force decision to shelve the detailed guidance. Copies obtained and published by the AP, The New York Times and The Washington Post revealed detailed, staged directions for child care centers, schools, camps, restaurants and bars, churches and mass transit providers about how to safely resume operations.

"I think many people would argue that it is not the role of the federal government to tell specific entities — whether they be schools or churches or businesses — how they should go about doing things because the nation is so diverse," one of the administration officials said.

The task force said that some of the points may be helpful, but they needed to "zoom out a little bit and not be so prescriptive," according to the official. The task force said they would welcome a new set of recommendations, but that never happened, the official said.

"Issuing overly specific instructions — that CDC leadership never cleared — for how various types of businesses open up would be overly prescriptive and broad for the various circumstances states are experiencing throughout the country," the second administration official said. "Guidance in rural Tennessee shouldn't be the same guidance for urban New York City."

The United States last month reached 1 million known coronavirus cases, representing one-third of all coronavirus cases worldwide. Nearly 74,000 Americans have been felled by the disease as of Thursday, according to data compiled by the Johns Hopkins Coronavirus Resource Center.

President Trump wants states to begin relaxing stay-at-home orders and reopen businesses after the spread of the coronavirus pummeled the global economy and killed millions of jobs.

The White House coronavirus task force released guidelines on April 16 to encourage state governors to adopt a phased approach to lifting restrictions across the country. Some states have moved ahead without meeting the criteria.

The task force rejected a set of additional detailed draft recommendations for schools, restaurants, churches and mass transit systems from the Centers for Disease Control and Prevention that it considered "overly prescriptive."

A number of states have already begun to lift restrictions, allowing for businesses including hair salons, diners and tattoo parlors to once again begin accepting customers. Health experts have warned that reopening too quickly could result in a potential rebound in cases.

States are supposed to wait to begin lifting any restrictions until they have a 14-day "downward trajectory" of influenza-like illnesses and confirmed virus cases, as well as sufficient hospital capacity and testing for health care workers.

In Parkland, Another Senior Year Ends In Turmoil. But This Time, 'It's Not Just Us'

Friday, March 13, was the last time Alexandra Sullivan saw her fellow yearbook staffers in person.

"We were trying to get as many pictures of people as possible 'cause we knew we wouldn't be able to take any more," Sullivan, 18, says.

Like most U.S. public school students, Sullivan is learning from home now. And much like her lessons, her work on the yearbook continues.

Sullivan is the yearbook profiles editor at Marjory Stoneman Douglas High School in Parkland, Fla. She's one of 10 seniors who were also on staff two years ago, when a gunman opened fire at their school. Back then, she and her classmates had to adapt to an unimaginable tragedy. Now, they have to adapt again – this time, to the pandemic.

"This book has to get done and we'll do whatever we have to do to finish it," she says, "which is exactly how we approached the '18 book."

Senior Caitlynn Tibbetts, the yearbook's co-editor-in-chief, was also on staff when the shooting happened. She says there's a collective grief among seniors over what their class — which has already lost so much — is losing now. They won't be able to dance together at prom, or walk across the stage at graduation.

"This class especially has gotten screwed over so much through the past four years," Tibbetts, 18, says. "The last two months were supposed to be the best, and they were supposed to make up for everything that we've been through. And it's really hard on us to kind of just watch it all disappear."

Amid all the uncertainty, she says, one thing is clear: The yearbook must get done, and it must get to students.

High school yearbooks are like time capsules. They record theater productions, which teams went to state finals, who was voted most likely to succeed.

And when a news event makes history – leaving a mark on students and society – it's the yearbook's job to document it. At Stoneman Douglas, that's meant changing plans just weeks before the yearbook is due.

Yearbook advisor Sarah Lerner says, "Having done one under unthinkable circumstances before, I hate to say that we're kind of, you know, used to it, but, for the seniors on staff, we are."

Two years ago, after the shooting, the yearbook staff pivoted to include remembrances of the victims. Tibbetts and Sullivan stepped up to help write them, and anything else that was needed at the last minute, while other yearbook staffers took time to attend funerals.

This year, they're making room for two new spreads about the pandemic.

"One of them is more of a factual-based one, how it's affected our community, including businesses," Tibbetts explains. "The other spread is focused on the effect it's had on us personally, both with online schooling and especially with seniors."

Logistically, putting the yearbook together and writing the new sections has been a challenge. Unlike 2018, they can't be in the same room with each other to finish the design.

"We have to social distance and our parents wouldn't let us go out," Tibbetts says.

They mainly rely on a group chat with everyone on the staff. "It can get hectic," Tibbetts says, "especially when it's all happening at like 12 a.m."

Lerner and her students missed the original deadline to finish the book, on April 6. But the printer, Walsworth, says the company is being flexible with Stoneman Douglas and other yearbook staffs across the country. Lerner says she's aiming to get the book in by the end of April.

Once the printed copies come back, more than 1,200 books will somehow have to be distributed to students. Lerner has some ideas for how to do that safely.

However, there's one important yearbook tradition they may not be able to save.

"We may not actually get to sign books this year," Lerner says. And that's been hard to accept.

"As a teacher, I really like to get my students to sign my book, you know, and I like to sign theirs and I like to see the kids carrying them around at school."

Lerner says she's sad that might not happen this year. But at least this time, the students of Marjory Stoneman Douglas High School aren't on their own.

"Unlike the 2018 books, this situation is not unique to us," she says. "So there's comfort in knowing that all staffs are going through the same issue. It's not just us."

CDC Guidance For Reopening Schools, Child Care And Summer Camps Is Leaked

No field trips. No game rooms. No teddy bears. These are some of the CDC's guidelines for reopening schools, childcare centers and day camps safely in places where coronavirus cases are on the decline.

The guidance, which also covers restaurants, churches and other public places, was obtained by The Associated Press, which reports that the White House tried to keep it from coming to light. The New York Times quoted Mark Meadows, the chief of staff, as being concerned that the guidelines were "overly prescriptive."

The CDC does not have authority to enforce its guidance, which is intended for public information only; the actual policy decisions are up to state and local governments. Schools are closed through the end of the school year throughout much of the country, with the exception of Montana, which welcomed a handful of students back this week. Child care protocols are different in different states.

But millions of parents need child care so they can work, and socialization and stimulation for children who have been confined to home by lockdowns for weeks on end. This is the guidance that summer camps and day cares have been waiting for to make decisions about reopening safely.

The guidance says that where coronavirus is spreading rapidly, child care should only serve the children of essential workers. This is the case today in much of the country, which the guidelines refer to as "Phase 1".

In Phase 2, programs can expand to serve all children with enhanced social distancing measures, and in Phase 3, with a lower risk, social distancing will continue.

Recommended measures include:

Handwashing;

Cloth masks for staff;

Regular disinfection of all surfaces;

Six-foot distance "if possible," head-to-toe positioning with bedding;

As much outdoor air as possible — open windows, fans;

Restricting mixing of groups;

Restricting visitors, and staggering dropoffs and pickups to reduce contact among parents;

Limiting sharing of materials like art supplies or toys. Disinfecting them in between use.;

Avoiding soft toys that can't be easily disinfected;

Not using common areas like dining halls or playgrounds if possible. If it is necessary, stagger visits and disinfect in between;

Adjust operations based on local health data;

Monitor absenteeism.

The guidelines also emphasize keeping attendance at such programs local, to limit children bringing the disease from high to low transmission areas.

New Documentary Explores History, Legacy Of Iconic LGBTQ Bookstore ‘Circus Of Books’ Through The Owners’ Daughter’s Eyes

Rachel Mason had, to a certain extent, the normal upbringing you’d imagine a family of five with small business owner parents would have. But in her documentary, ‘Circus of Books’, she pulls the curtain on the double-life her parents led as modest business owners and pillars of the LGBTQ community.

Karen and Barry Mason established West Hollywood’s Circus of Books on Santa Monica Boulevard in the 1980s. What seemed like an unassuming bookstore was actually a gay porn shop that became an institution in the LGBTQ community during a time when homosexuality was still largely unaccepted. The store was far from being a “bookstore with a circus theme”. The Los Angeles-based shop was the central hub for gay pornography around the country, once one of the main distributors for adult films. 

While the store was becoming a home for gay culture and pride, the Masons largely kept their business a secret from colleagues, friends, family, even their own children. It’s a central conflict that Rachel Mason explores throughout the film as the daughter of two shop owners caught between the pressures of maintaining a traditional family image and making a living as gay pornography distributors.

Animator, Director Brad Bird Teams Up With Turner Classic Movies To Curate ‘The Essentials’

Brad Bird has made a name for himself as the director of new age, animated classics, like “The Iron Giant” and “The Incredibles”. Now he’s teaming up with Turner Classic Movies to share his picks for classic movie watching that will keep you busy and entertained while you’re stuck at home.

Bird has curated a list of his favorite films which will air on this season’s “The Essentials” with TCM Primetime host Ben Mankiewicz. Every Saturday from May up to January of next year, TCM will air one of twenty movies chosen by Bird. His list includes big-name classics that any movie buff will recognize, like “Casablanca” and “Dr. Strangelove”. But Bird throws in a few surprises, one being that there are no animated films on his list. Another surprising thing viewers will notice is that about a third of the films included are musicals, like “Singin’ In The Rain” and “Guys And Dolls”. With TCM’s seemingly infinite library of movie classics to choose from, Bird says narrowing it down to only twenty favorites was a challenge. According to Bird, his list comprises movies that are not only entertaining but “transcend time” and “speak in a language that is still in many ways current”.

“The Essentials” was filmed in early December, but Bird’s list is coming out during a time when movie-going is looking very different these days. The virus has put the entire film industry on pause, with studios halting production and theaters closing their doors indefinitely. In lieu of new movie releases and regular theater-going, many are taking the opportunity to revisit the classics and Bird’s list provides a starting guide for which ones should be on your watch-list.

Director Of New Documentary ‘Spaceship Earth’ Explores Quarantining In The Name Of Science

Two months is a long time to be quarantined in one place. Just ask, well, pretty much anyone in the era of COVID-19. But imagine if you were quarantined for two years instead of two months, all in the name of science, and it was by choice!

In 1991, eight researchers did exactly that in Oracle, Arizona as part of a first-of-its-kind mission called BIOSPHERE 2. No, there was no failed BIOSPHERE 1 mission -- BIOSPHERE 1 is planet Earth. The mission’s goal was to create a living ecosystem inside a massive glass and steel facility to show that human life could be sustained in outer space. The idea was that whenever humanity finally did gain the ability to travel deeper into space and colonize another planet, a biosphere would need to be built first so that life could be sustained. But what started as a science experiment quickly evolved into a cultural phenomenon, and while some watched with bated breath to see whether the researchers could really create a living ecosystem in a controlled environment, others saw the project and those who were involved as a cult of sorts. Director Matt Wolf explores BIOSPHERE 2  the researchers (“biospherians”) who carried the mission out, what ultimately happened and the good and bad ways in which it became a cultural phenomenon.

The NFL said Wednesday that its new performance-enhancing drug policy will allow the Broncos' Wes Welker and two other suspended players to return to the field this week.

The deal with the players association also adds human growth hormone testing, ending several years of wrangling between the league and the union.

Welker, Dallas Cowboys defensive back Orlando Scandrick and St. Louis Rams wide receiver Stedman Bailey had been suspended for four games.

Under the new rules, players who test positive for banned stimulants in the offseason will no longer be suspended. Instead, they will be referred to the substance abuse program.

The league and union are also nearing an agreement on changes to the substance abuse policy. That could reduce Cleveland Browns receiver Josh Gordon's season-long ban.

Testing for HGH was originally agreed upon in 2011, but the players had balked at the science in the testing and the appeals process for positive tests. Under the new deal, appeals of positive tests in the PED program will be heard by third-party arbitrators jointly selected by the NFL and union. Appeals will be processed more expeditiously under altered procedures

Testing should begin by the end of the month.

The new rules also change the length of suspensions. Previously, all first-time violations of the performance-enhancing drug policy resulted in at least a four-game suspension.

Now, use of a diuretic or masking agent will result in a two-game suspension. The punishment for steroids, in-season use of stimulants, HGH or other banned substances is four games. Evidence of an attempt to manipulate a test is a six-game suspension.

A second violation will result in a 10-game ban, up from a minimum of eight games. A third violation is at least a two-year suspension. Before, the ban was at least a year.

California is one step closer this week to making the 1980s Hollywood fantasy of Knight Rider a 21st century reality because permits for self-driving cars issued by the Department of Motor Vehicles officially went into effect Tuesday. Now a handful of companies can test automated cars on public roads.

With signing of insurance bill, Lyft, Uber ridesharing loophole comes to an end

Amid all the talk about cutting-edge technology, much of Uber and Lyft’s success actually owes to that fact the ride-sharing companies have been able to exploit a basic loophole: The companies foist the cost of insurance on their drivers, but the drivers' insurance companies don’t know they are underwriting cars for hire, and even if drivers wanted to be honest and get a policy that would cover ride-sharing, they couldn’t, because no such policy exists.

AB-2293, introduced by Assemblywoman Susan Bonilla (D-Concord) and signed into law Wednesday by Governor Jerry Brown, tries to close the loophole by paving the way for insurance companies to offer hybrid personal/commercial policies by next summer.

Uber once derided the bill as a backroom deal between insurance companies and trial lawyers.

"The bill does nothing to enhance safety, yet compromises the transportation choices and entrepreneurial opportunities Uber offers Californians," the company wrote in a June blog post that encouraged customers to contact their representatives opposing the bill.

However, the company backed down and supported the legislation when Bonilla insurance requirements were lowered.

AB 2293 also specifically bans drivers from using their personal policies and mandates drivers have to be covered from the moment they turn on their app and look for customers, which is a response to the tragic accident on New Year's Eve in San Francisco when an UberX driver hit and killed a six year old child.

Uber argued that because the driver was waiting for a fare he wasn't working for the company at the time, so he wasn't covered by the company's insurance.

California unemployment rate stays at 7.4 percent

California's unemployment rate is unchanged for a third month, holding at 7.4 percent in August.

The California Employment Development Department reported Friday that the state added 44,200 nonfarm jobs during the month, bringing the state total to 15.5 million in August.

Last month's gains mean the state has added 1.4 million jobs since February 2010, when the jobless number hit a peak of 12.4 percent.

Overall, the number of unemployed Californians ticked up by 1,000 over the month to nearly 1.4 million. The national unemployment rate is down to 6.1 percent.

Construction posted the largest increase over the month, adding 13,600 jobs. Manufacturing, financial activities, business services, education, health, leisure and government all added jobs in August.

Trade, transportation and utilities, along with information, posted job losses of 8,300.

Commissioner Roger Goodell says the NFL wants to implement new personal conduct policies by the Super Bowl. At a news conference Friday, Goodell made his first public statements in more than a week about the rash of NFL players involved in domestic violence. He did not announce any specific changes, but said he has not considered resigning.

"Unfortunately, over the past several weeks, we have seen all too much of the NFL doing wrong," he said. "That starts with me."

The league has faced increasing criticism that it has not acted quickly or emphatically enough concerning the domestic abuse cases.

The commissioner reiterated that he botched the handling of the Ray Rice case.

"The same mistakes can never be repeated," he said.

Goodell now oversees all personal conduct cases, deciding guilt and penalties.

He said he believes he has the support of the NFL's owners, his bosses.

"That has been clear to me," he said.

The commissioner and some NFL teams have been heavily criticized for lenient or delayed punishment of Rice, Adrian Peterson and other players involved in recent domestic violence cases. Less than three weeks into the season, five such cases have made headlines, the others involving Greg Hardy, Ray McDonald and Jonathan Dwyer.

Vikings star running back Peterson, Carolina defensive end Hardy and Arizona running back Dwyer are on a special commissioner's exemption list and are being paid while they go through the legal process. McDonald, a defensive end for San Francisco, continues to practice and play while being investigated on suspicion of domestic violence.

As these cases have come to light, such groups as the National Organization of Women and league partners and sponsors have come down hard on the NFL to be more responsive in dealing with them. Congress also is watching to see how the NFL reacts.

In response to the criticism, the NFL announced it is partnering with a domestic violence hotline and a sexual violence resource center.

Goodell also said in a memo to the clubs late Thursday that within the next 30 days, all NFL and team personnel will participate in education sessions on domestic violence and sexual assault. The memo said the league will work with the union in providing the "information and tools to understand and recognize domestic violence and sexual assault."

The league will provide financial, operational and promotional support to the National Domestic Violence Hotline and the National Sexual Violence Resource Center.

The National Domestic Violence Hotline provides domestic violence victims and survivors access to a national network of resources and shelters. "The hotline will add 25 full-time advocates over the next few weeks that will result in an additional 750 calls a day being answered," he said.

NSVRC supports sexual violence coalitions across the United States. The NFL's initial support will be directed toward state coalitions to provide additional resources to sexual assault hotlines.

Construction helps California lead nation in job creation in August

California employers added 44,200 jobs in August, the largest gain of any state in the country. The state's unemployment rate stood still at 7.4 percent, compared to 6.1 percent nationwide.

"When the national numbers came out for August, and we saw a significant slowdown in job creation, we were a little bit concerned that we'd see the same thing happening here," said economist Kimberly Ritter-Martinez of the Los Angeles County Economic Development Corporation. "But in California, we stayed pretty much on track, outpacing the nation in terms of job creation." 

The construction sector was a huge contributor to California's job growth in August, with a gain of 13,600 jobs.  The other sectors with large gains were Education/Health Services (+12,200), and Professional/Business Services (+10,600). 

"We've been seeing steady increases in construction employment for some time, but it has been a slow steady increase," said Tom Holsman, CEO of the Associated General Contractors of California.

"Recent increases are attributable to many projects that have been in the early stages of startup gaining momentum," Holsman added, citing LA County Metro transit projects and the new Wilshire Grand Hotel construction project as local examples.

In Los Angeles County, the unemployment rate also stayed flat at 8.1 percent, but it remains far lower than the 9.9 percent of August of 2013. In the last twelve months, the L.A. County Metro area has gained 6,600 construction jobs, a rate of 5.6 percent.

Ritter-Martinez, of the LAEDC says other economic indicators support a boost in construction jobs at the Los Angeles and statewide levels: permits for new housing construction, remodeling, and non-residential construction are all on the rise. 

"Builders and developers are reporting that they're having trouble finding some skilled labor for construction," Ritter-Martinez said. "It's taken so long for that sector to come back, a lot of construction people have gone off and found other kinds of jobs or moved out of the region." 

In Orange County, the unemployment rate was 5.4 percent, down from 5.7 percent in July. The unemployment rate in the Riverside-San Bernardino-Ontario area was 8.7 percent in 
August 2014, down from a revised 9.3 percent in July 2014.

One-Way Sidewalks And Parking Lot Dining Rooms: Is This The Future?

Small businesses are essential to cities and towns across the country. They create jobs, they create a sense of place — think of New York City without bodegas, Portland, Ore., without bike shops, or your town without its dance studio or hardware store — but they also create sales, income, and property tax revenues.

"[It's] super important that we make it very easy for people to keep their purchases local," said Karina Ricks, director of the Department of Mobility and Infrastructure in Pittsburgh, Pa.

Cities like Pittsburgh must make it possible to return to the streets and shop without losing the safety of physical distancing, said Ricks. If only so many people are allowed into a store at one time, how can others line up outside? If restaurants operate at 25 percent capacity, where will expectant diners wait?

"It's going to require us to reimagine our streets," she said. "How much of our streets can we turn over?"

Many cities have already removed cars from streets to allow more people to walk and bike. They'll need even more space if people are allowed to go to shops and restaurants again, said Brent Toderian, the former chief planner for Vancouver, Canada who now leads his own company, TODERIAN UrbanWORKS.

"All of it requires more space between buildings, more life between buildings," he said. "If we try to do all that without inconveniencing the cars, we will fail."

In Tampa, Fla., officials will allow restaurants to add tables to streets in front of their establishments. In an Atlanta, Ga. suburb parking lots are the new dining room. Ricks wonders if one-way sidewalks could limit people's exposures to one another the way one-way aisles do in grocery stores. She said some Pittsburgh streets may open to cars only at certain times of the day, or speeds could be dramatically reduced. That way, street parking could be dedicated for walking, biking, or cafe tables while an adjacent travel lane for cars remains.

"I don't have the answers right now, but it's something that we're actively looking at," she said, citing a new city task force that will investigate the issue.

Public space always influences health outcomes and can produce health risks, said Keshia Pollack Porter, a professor at John Hopkins University's Bloomberg School of Public Health. Whatever "normal" cities think they're returning to, this is a chance to evaluate how the public realm worked before, she said.

"We know that there are significant inequities," she said, pointing to pedestrian and cyclist fatalities that continue to rise, and communities that have lacked access to safe streets for decades.

In a post-pandemic world, with even fewer dollars for infrastructure and transportation, officials must be more careful than ever, said Toderian.

"Where we put our money based on our assumed narratives around what people will want to do — drive more, take public transit less — will create self-fulfilling prophecies," he said, and could exacerbate that other existential threat, climate change.

Reopening After COVID: The 3 Phases Recommended By The White House

President Trump wants states to begin relaxing stay-at-home orders and reopen businesses after the spread of the coronavirus pummeled the global economy and killed millions of jobs.

The White House coronavirus task force released guidelines on April 16 to encourage state governors to adopt a phased approach to lifting restrictions across the country. Some states have moved ahead without meeting the criteria.

The task force rejected a set of additional detailed draft recommendations for schools, restaurants, churches and mass transit systems from the Centers for Disease Control and Prevention that it considered "overly prescriptive."

A number of states have already begun to lift restrictions, allowing for businesses including hair salons, diners and tattoo parlors to once again begin accepting customers. Health experts have warned that reopening too quickly could result in a potential rebound in cases.

States are supposed to wait to begin lifting any restrictions until they have a 14-day "downward trajectory" of influenza-like illnesses and confirmed virus cases, as well as sufficient hospital capacity and testing for health care workers.

As Los Angeles mulls a law that would raise the minimum wage above the current California minimum of $9 an hour, it's the latest city to jump on a trend that started as the by-product of a failed labor negotiation in the state of Washington.

The first city to enact a $15-per-hour minimum wage was SeaTac, Wash., — a tiny airport town outside Seattle. "SeaTac will be viewed someday as the vanguard, as the place where the fight started," the lead organizer of SeaTac's $15 campaign, David Rolf, told supporters in November 2013 after a ballot measure there barely passed.

Rolf never set out to raise SeaTac’s minimum wage, much less start a national movement. Speaking from a sparse corner office in downtown Seattle at the Service Employees International Union 775, which he founded in 2002, Rolf told KPCC that his original goal in 2010 was to unionize workers at SeaTac airport.

When employers – led by Alaska Airlines — played hardball, Rolf put the $15 minimum wage on the ballot as leverage. “We had some polling in SeaTac that it could pass, but it was not at all definitive,” Rolf said.

That proved prescient: In a city of just 12,108 registered voters, Rolf's staff signed up around 1,000 new voters, many of them immigrants who had never cast a ballot. The measure won by just 77 votes.

It's an irony that the new law doesn't apply to workers at the center of the minimum wage campaign: The airport workers at SeaTac. That's because the Port of Seattle, which oversees the airport, challenged the initiative, arguing that the city's new minimum wage should not apply to the nearly 5,000 workers at the airport. A county judge agreed. Supporters of the $15 wage have appealed.

Still, Rolf said, "I think people are proud that that’s what happening. There are leaders of the movement in Seattle, including our mayor, that said shortly after the victory, 'Now we have to take it everywhere else.'"

The $15 minimum wage spread to Seattle last June and to San Francisco in November. 

Why $15 an hour?

The $15 figure first came to people’s attention in a series of strikes by fast food workers that started two years ago in New York. 

“I think it’s aspirational, and it provides a clean and easy-to-understand number," Rolf said. "You can debate whether it ought to really be $14.89 or $17.12, and based upon the cost of living in different cities, you could have a different answer. But in the late 19th and early 20th century, American workers didn’t rally for 7.9 or 8.1 hour working day. They rallied for an eight-hour day.”

“What’s really remarkable about social protest movements in American history is that the radical ideas of one group are often the common sense ideas of another group in a matter of a few years," said Peter Dreier, professor of politics at Occidental College.

Rolf is hopeful the $15 minimum wage can spread to every state. But Nelson Lichtenstein, Director of the Center for the Study of Work, Labor and Democracy at the University of California, Santa Barbara, is skeptical.

“I don’t think having high wages in a few cities will mean it will spread to red state America,” he said. 

Lichtenstein said cities like L.A. have become more labor friendly, thanks largely to an influx of immigrants, but that’s not the case in the South. Oklahoma recently banned any city from setting its own minimum wage, joining at least 12 other states with similar laws, according to Paul Sonn, general counsel and program director at the National Employment Law Project.

In November, voters in four Republican-leaning states — Alaska, Arkansas, South Dakota, and Nebraska — approved higher minimum wages, but they weren’t close to $15.

A $15 dollar wage would have a much greater impact in Los Angeles than Seattle or San Francisco because the average income here is much lower than in those cities. Post-recession, income inequality has become much more of a concern for voters, which has made $15 more palatable, Sonn said.

This fall, the Los Angeles City Council enacted a $15.37 minimum wage for hotel workers that takes effect next year. A similar law has been in effect around LAX since 2007. 

But even though California cities have been allowed to set their own minimum wages for more than a decade, L.A. has never come close to doing so.

Until now.

Why unions lead the $15 minimum wage fight, though few members will benefit

Labor unions have led the fight to raise the minimum wage in several American cities, including Los Angeles, where the City Council is considering two proposals right now that would give raises to hundreds of thousands of workers (to $13.25 an hour by 2017 and $15.25 an hour by 2019).

But few of the unions' members have benefited directly from the initiatives. So why do unions care about a $15 wage for non-union workers? 

It’s part of a long-term strategy to protect the interests of their members, labor leaders say. They also see an opportunity to raise the profile of unions after years of falling membership.

"We can’t be the movement that’s just about us," said David Rolf, an international vice-president of SEIU, who led the first successful $15 minimum wage campaign in SeaTac, the town in Washington that is home to the region's similarly named airport. 

“We have to be the movement that’s about justice for all," Rolf added. "The labor movement that people flocked to by the tens of millions in the 1930s wasn’t known for fighting for 500-page contracts. They were known for fighting for the eight-hour day, fighting to end child labor.”

The idea that workers should earn $15 dollars an hour first came to the public’s attention during a series of fast food strikes that started in New York City in late 2012. Those workers didn’t just walk off the job by themselves. They were part of a campaign organized by unions, led by SEIU, which is made up mostly of public sector and health care workers.

$10 million fast-food strikes

The Service Employees International Union spent $10 million dollars on the fast food strikes, according to The New York Times. But none of those restaurants have unionized, and because it’s been so hard to form private sector union these days, they probably never will, said labor historian Nelson Lichtenstein.

“In effect what you have now is the SEIU – its hospital membership or its members working at the Department of Motor Vehicles – helping to raise the wages of fast food workers, but not their own wages,” Lichtenstein said.

That's because unionized workers earn far more than the current or proposed new minimum wages, in L.A. an average of more than $27 an hour, according to UCLA's Center for Research on Employment and Labor. 

The spread of the $15 minimum wage from SeaTac to Seattle to San Francisco — and now possibly Los Angeles — is a huge victory for labor unions, but it’s unlikely most of the people getting raises will ever be part of organized labor.

Still, the rank and file seem to support their unions' efforts.

“I personally support using our organization as a way to advocate for those who don’t have a voice," said Rafael Sanchez III, a teacher's assistant at Bell High School who's a member of SEIU Local 99. 

A challenging time for the labor movement

In the 1950’s, about one in three American workers belonged to a union. Last year, just 11 percent did – or 6 percent of private sector workers – the lowest numbers in nearly a century.

Rolf says the minimum wage campaigns mark a change in tactics for organized labor; Rather than the shop floor, the focus is on the ballot box and city hall.

“Since at least the 1980s, winning unions in the private sector has been a Herculean task," Rolf said. "The political process provides an alternative vehicle.”

And an increasingly successful one. It was voters who approved the first $15 wage, in Washington state in 2013, and another one in San Francisco last year.  

In Los Angeles, the issue is before the city council. Mayor Eric Garcetti opened the bidding, proposing a raise of $13.25 on Labor Day before six council members countered with $15.25.

The Los Angeles County Federation of Labor – lead by Rusty Hicks — is pushing for the higher option.

“Union members and non-union members have an interest in seeing our economy grow," said Hicks. "You can’t continue to have a strong, vibrant economy if in fact folks don’t have money in their pockets.”

Other benefits for unions: A safety net and a higher floor

Some union members see a higher minimum wage as a safety net.

Robert Matsuda is a studio violinist represented by the American Federation of Musicians, part of the AFL-CIO. Even though he’s not working for the minimum wage now, he worries that may not last: He’s getting fewer and fewer gigs as more film and TV scoring is outsourced overseas.

“I might have to take a minimum wage job in the near future, so it might directly affect me,” said Matsuda.

There’s also a more tangible benefit for unions, says Nelson Lichtenstein, the labor historian: A higher minimum wage means a higher wage floor to negotiate with in future contracts.

“It’s one labor market, and if you can raise the wages in those sectors that have been pulling down the general wage level – i.e: fast food and retail – then it makes it easier for unions to create a higher standard and go on and get more stuff,” said Lichtenstein.

On Friday morning, union members will rally in front of Los Angeles City Hall, calling on the council to enact a $15.25 an hour minimum wage as soon as possible.

What an animal eats is a fundamental aspect of its biology, but surprisingly, the evolution of diet had not been studied across the animal kingdom until now. Scientists at the University of Arizona report several unexpected findings from taking a deep dive into the evolutionary history of more than one million animal species and going back 800 million years, when the first animals appeared on our planet. The study revealed several surprising key insights: Many species living today that are carnivorous, meaning they eat other animals, can trace this diet back to a common ancestor more than 800 million years ago; A plant-based, or herbivorous, diet is not the evolutionary driver for new species that it was believed to be; Closely related animals tend to share the same dietary category -- plant-eating, meat-eating, or both. This finding implies that switching between dietary lifestyles is not something that happens easily and often over the course of evolution.

A new study shows that the West Antarctic Peninsula is experiencing some of the most rapid climate change on Earth, featuring dramatic increases in temperatures, retreats in glaciers and declines in sea ice. The Southern Ocean absorbs nearly half of the carbon dioxide -- the key greenhouse gas linked to climate change -- that is absorbed by all the world's oceans. The study tapped an unprecedented 25 years of oceanographic measurements in the Southern Ocean and highlights the need for more monitoring in the region. The research revealed that carbon dioxide absorption by surface waters off the West Antarctic Peninsula is linked to the stability of the upper ocean, along with the amount and type of algae present. A stable upper ocean provides algae with ideal growing conditions. During photosynthesis, algae remove carbon dioxide from the surface ocean, which in turn draws carbon dioxide out of the atmosphere. From 1993 to 2017, changes in sea ice dynamics off the West Antarctic Peninsula stabilized the upper ocean, resulting in greater algal concentrations and a shift in the mix of algal species. That's led to a nearly five-fold increase in carbon dioxide absorption during the summertime. The research also found a strong north-south difference in the trend of carbon dioxide absorption. The southern portion of the peninsula, which to date has been less impacted by climate change, experienced the most dramatic increase in carbon dioxide absorption, demonstrating the poleward progression of climate change in the region.
