All Good Things Must Come to an End

Every ending is a new beginning.

Last week I wrote a blog about getting the most out of life and maximizing our productivity for God’s specific calling on each of our lives. In the post, I shared my own understanding of what God is calling me to in this season including following him, loving my family well, pastoring the people of Transformation Church, and completing my doctorate.

Unfortunately, I have also come to a point where writing this blog twice a week is no longer the best use of the resources of time and mental energy that God has given me. I will continue to write occasionally and post clips from sermons at my personal website, DerwinLGray.com and invite you to join me there.

I am very thankful to Christianity Today and editor Mark Galli for encouraging an important discussion of multiethnic churches and for their continued commitment to reflect Christ in our world through this website and magazine.

Thank you for joining me on this journey. I hope you were encouraged and challenged by the posts I have written over the past nine months and will continue the conversation by reading my new book, The High-Definition Leader: Building Multiethnic Churches in a Multiethnic World, available September 15.

Marinate on that.

Madrid: The space cadets descended on Colorado’s Capitol this April for a show of exceptionalism

This year, it wasn’t the typical stoner types in all-green that descended on Civic Center Park in April with marijuana leaf flags. It was the star-spangled banners that waved sky high in an intense display of patriotic exceptionalism this past weekend that should have just stayed home.

US v. Hird

(United States Third Circuit) - Affirmed convictions of several individuals who were charged with crimes in connection with a ticket-fixing scheme in the Philadelphia Traffic Court. Some of the individuals pleaded guilty while others proceeded to trial and were acquitted of fraud and conspiracy counts but convicted of perjury for statements they made before the grand jury. The Third Circuit consolidated their appeals for efficiency and ultimately affirmed all of the convictions.

Murray v. City of Philadelphia

(United States Third Circuit) - Dismissed an appeal filed in a civil rights case by the estate of a man who was shot and killed by police officers. As the administrator of the estate, the man's mother filed suit alleging that the officers had used excessive force. When the jury returned a verdict in favor of the officers, she appealed pro se. Dismissing her appeal on grounds that she had filed it without counsel, the Third Circuit held that a non-attorney who is not a beneficiary of an estate may not conduct a case pro se on behalf of the estate.

Lifewatch Services Inc. v. Highmark Inc.

(United States Third Circuit) - Reinstated a medical device seller's claim that certain Blue Cross Blue Shield health insurance companies violated antitrust law by unreasonably restraining trade in the national market for outpatient cardiac monitors. The seller of a cardiac monitoring device contended that it was shut out of the market because the defendants conspired to deny insurance coverage for its product to shield themselves from patient demand for it. Holding that the seller stated a claim under section 1 of the Sherman Act, the Third Circuit reversed dismissal of the complaint and remanded for further proceedings.

Township of Bordentown v. FERC

(United States Third Circuit) - Rejected challenges to a natural gas pipeline project but remanded on one issue. Local governments and an environmental organization argued that the Federal Energy Regulatory Commission acted arbitrarily and capriciously in approving a proposed interstate pipeline expansion, but the Third Circuit rejected this argument. However, on a separate issue, the panel remanded to the New Jersey Department of Environmental Protection with instructions to reconsider the petitioners' request for an adjudicatory hearing.

hi

Vorchheimer v. The Philadelphian Owners Association

(United States Third Circuit) - Affirmed the dismissal of a disabled tenant's lawsuit under the Fair Housing Amendments Act. The tenant, who needs ready access to her rolling walker, brought suit when the building managers refused to allow her to leave it in the building's lobby. Unpersuaded by her arguments, the Third Circuit concluded she did not plausibly plead that her preferred accommodation of leaving the walker in the lobby was necessary, given that she was offered four other ways to store and access her walker.

hi

Jutrowski v. Township of Riverdale

(United States Third Circuit) - Held that a motorist who was kicked in the face during his arrest, breaking his eye socket, could pursue conspiracy claims against the four police officers at the scene, all of whom denied kicking him or seeing who did. The motorist did not know which of the officers had kicked him. The Third Circuit held that this doomed his excessive-force claim. However, the panel allowed him to continue litigating his claim of an unconstitutional after-the-fact conspiracy to cover up misconduct, reversing summary judgment in relevant part.

In re Sneed Shipbuilding, Inc.

(United States Fifth Circuit) - Affirmed the dismissal of an appeal in a matter concerning the bankruptcy of a shipbuilding company. The bankruptcy court's approval of the sale of certain key estate assets was the final word on the subject, when the objector did not obtain a stay of that ruling.

hi

Nabors Offshore Corporation v. Whistler Energy II

(United States Fifth Circuit) - Reversed, vacated, and remanded. Holding that a creditor can establish that its expenses are attributable to the actions of the bankruptcy estate through evidence of either a direct request from the debtor-in-possession or other inducement via the knowing and voluntary post-petition acceptance of desired goods or services.

ALI v. WOODBRIDGE TOWNSHIP SCHOOL DISTRICT 10

hi

Ohio Valley Environmental v. Scott Pruitt

(United States Fourth Circuit) - Reversed. Several environmental groups brought suit against the EPA for failing to perform duties under the Clean Water Act as to impaired waters in West Virginia. The district court found that plaintiffs have standing to bring the claim and granted summary judgment in their favor. The appellate court agreed that plaintiffs have standing, but reversed the grant of summary judgment. The appellate court reasoned that the doctrine of constructive submission under 33 USC section 1313(d)(2) which would have triggered the EPA’s duty to act was overcome by West Virginia’s partial compliance and agreement to do more. Therefore constructive submission would not apply and summary judgment improper.

hi

US v. Dhirane

(United States Fourth Circuit) - Affirmed the convictions and sentences for providing support to a foreign terrorist organization following a bench trial where the district court found that the two defendants had collected money to assist a foreign terrorist organization's activities. On appeal, the Fourth Circuit rejected the defendants' argument that the district court, among other things, should have suppressed evidence obtained pursuant to warrants issued under the Foreign Intelligence Surveillance Act.

hi

Children's Hospital of the King's Daughters, Inc. v. Azar

(United States Fourth Circuit) - Affirmed an order enjoining the U.S. Department of Health and Human Services from enforcing a Medicaid reimbursement policy that was set forth in a Frequently Asked Questions document. The plaintiff, a hospital, contended that the reimbursement policy was not validly promulgated because there was no formal rulemaking as required by the Administrative Procedure Act. Agreeing, the Fourth Circuit held that the FAQ document was insufficient and that notice-and-comment rulemaking was necessary.

hi

US v. Chittenden

(United States Fourth Circuit) - Vacated forfeiture orders in a case involving a fraudulent mortgage scheme. The defendant argued that she should not have been ordered to forfeit over $1 million when she had received only $230,000 in proceeds from the criminal scheme. On remand from the Supreme Court, the Fourth Circuit concluded that it was necessary to vacate and remand the forfeiture orders on the ground that joint and several forfeiture liability was precluded by the Supreme Court's recent decision in Honeycutt v. US, 137 S. Ct. 1626 (2017).
