The bail application of Lalu Kumar Rana @ Lalu Rana has been moved by Mr. Rahul Ranjan, learned counsel for the petitioner and opposed by Mr. Ravi Prakash, learned A.P.P. for the State, which has been conducted through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.

In view of the allegations, let the case diary and antecedent report of the petitioner be called for from the court concerned.

1.2 Notice to the respondent was dispensed with, as the respondent had not yet been summoned by the Trial Court.

2 A perusal of the impugned order reveals that the Ld. Trial Court declined to take cognizance of the complaint primarily for the reason that the complainant despite availing several opportunities had not filed the ECS mandate. Further the account statement filed did not bear any stamp and was not even signed. Therefore, noticing that several opportunities have already been afforded to the complainant, the complaint was dismissed. 3 Sh.Anish Bhola, counsel for the petitioner has assailed the CR No.-97/2020 Page No.-1 of 4 impugned Order on the ground that the Ld. MM committed a grave error in observing that the ECS mandate was not on record. It is pointed out that the petitioner/ complainant along with the complaint had placed on record a ' Debit Authorization Form issued by the customer" i.e. the respondent to the petitioner bank. It is argued that the Debit Authorization Form is akin to ECS mandate. . To link the Debit Authorization Form with the loan agreement involved, an account statement was placed on record. The petitioner/complainant had also placed on record along with the complaint a memorandum issued by the bank, intimating return of the mandate on account of insufficiency of funds. Sh.Bhola has, further, argued that the offence as envisaged u/sec.-25 of the Payments & Settlement Systems Act (hereinafter referred to as 'the PSS Act') was completed, when the respondent, who had taken a loan and had issued authorization to debit the amount each month from his account failed to maintain sufficient balance in his account, thereby, resulting in failure of debit of amount. It is, therefore, argued that the Ld. MM committed a grave error in dismissing the complaint as both the documents constituting the offence were on record.

An Air India flight with 163 Indians landed at the Hyderabad international airport from Kuwait on Saturday night as part of the government's Vande Bharat Mission to bring home Indian nationals stranded abroad, airport sources said. The AI flight 988 landed at the airport shortly after 10 pm, the sources said. To facilitate the arriving passengers and aircraft crew, the Hyderabad International Airport has kept the international arrivals and the stretch right from the aerobridge to the arrivals ramp fully sanitized and fumigated, the sources said. It will be ensured that passengers follow social distancing norms, they said. The passengers would be screened by thermal cameras prior to immigration formalities, they said. Glass shields were provided at each manned immigration counter to avoid any personal contact between the passengers and immigration officers, they said. The West Bengal Health Department on Saturday formed teams to support surveillance and monitoring of treatment at five hospitals treating COVID-19 patients in the city. The team members will pay regular visits to these hospitals and send reports to the department, the state government said in an order. The department has also set up a dedicated help line for issues regarding the non-availability of PPEs and other supplies. The feedback and suggestions will be duly recorded and acted upon by the state government for appropriate remedial measures, the order said. At least five migrant labourers were killed and 13 others injured when a truck in which they were travelling overturned in Madhya Pradesh's Narsinghpur district, a police official said on Sunday. The accident took place near Patha village on Saturday night whennearly 20 migrant labourers were going in the truck to Jhansi and Etah in Uttar Pradesh from Hyderabad, Additional Superintendent of Police Rajesh Tiwari said. Five labourers were killed and 13 others were injured after the mangoes-laden vehicle overturned, he said. The injured persons were admitted to the district hospital for treatment, he added.

Apart from Shillong which currently has two active COVID-19 cases, the Meghalaya government has allowed shops to reopen and vehicles to ply across the state from Monday. The decision was taken at a review meeting chaired by Chief Minister Conrad K Sangma, official sources said. "The deputy commissioners and district transport officers have been asked to work out the modalities for regulating (public and private transport) on a rotation basis," Deputy Chief Minister Prestone Tynsong said on Saturday. All passenger vehicles have been asked to run with 50 per cent occupancy. In Shillong, Tynsong said, the government has granted permission to automobile and stationery shops for resuming business, while adhering to social distancing norms. Troops of India and China were involved in a fierce face-off and many of them sustained minor injuries in the clash near Naku La in the Sikkim sector along the Sino-Indo border on Saturday, official sources said. The troops disengaged after dialogue at the local level, they said. "Troops resolve such issues mutually as per established protocols. Such an incident occurred after a long time," said a source.

Fourteen people were rescued after the wall of a house collapsed in suburban Kandivali on Sunday morning, an official said. Two of those rescued received minor injuries and were admitted to a hospital, he said. The wall of the ground-plus-two-floor structure, known as Dipjyoti chawl, located in Lalji Pada area collapsed early morning, an official at the disaster control room said. Some locals said the incident took place when residents were asleep and they were unable to come out. Seven persons stranded on the upper floors were rescued after firefighters cut the grill and brought them down with the help of a ladder, the official said, adding that total 14 people brought out to safety from the structure. Four fire engines, a rescue van and an ambulance were pressed into service. Two persons, aged 45 and 48, received minor injuries and were admitted to Oscar Hospital, he said. Municipal leaders, including mayor of the BJP-ruled North Delhi Municipal Corporation (NDMC), on Sunday took part in a sanitisation drive outside Chief Minister Arvind Kejriwal's residence on Flagstaff Road here. The sanitisation exercise is part of the NDMC's campaign to prevent spread of COVID-19, said Jai Prakash, chairman of the standing committee of NDMC. "We have been sanitising the whole municipal area with mechanical and manual spray of sanitisers. So, we are here on Flagstaff road which comes under the NDMC's jurisdiction," Jai Prakash said. The municipal corporation has deployed nearly 40 large truck mounted power sprays and around 40 smaller mechanical sprays, to cover roads, residential areas, markets and other public places under the NDMC, he said.

Only 200 of the 403 MLAs will be able to sit inside the Uttar Pradesh Assembly if social distancing norms are implemented in the House as there are not enough seats, Speaker Hriday Narayan Dixit said. However, Dixit is "optimistic" and feels that by the time the next sitting of the Legislative Assembly is convened the situation will improve. "At present, the House is not in session. The Monsoon Session of the UP Legislative Assembly should be held some time in August and I am optimistic that by then the situation would have changed," the speaker told PTI in an interview.
