The Justice Department’s Tax Division has issued a new directive to further the efforts of the Tax Division and the U.S. Attorneys’ Offices to respond quickly and effectively to the grave challenges in stolen identity refund fraud cases.

A Japanese freight forwarding company has agreed to plead guilty and to pay a $2.3 million criminal fine for its role in a conspiracy to fix certain fees in connection with the provision of freight forwarding services for air cargo shipments from Japan to the United States.

The Department of Justice announced today that it has entered into a settlement to resolve the department’s allegations that the city of Corpus Christi, Texas, violated Title VII of the Civil Rights Act of 1964 by discriminating against women when hiring entry-level police officers.

"There’s still much more we need to do, and it’s incumbent on all of us in the field – and throughout the justice system – to work together to meet the challenges that we – and all victims – continue to face," said Acting Assistant Attorney General Leary.

"This training could not be more timely. The tragic events in Oak Creek, Wisconsin just last month are a chilling reminder of the need to do all we can to foster tolerance, understanding, and respect among the diverse faiths, communities and peoples that make up America," said Deputy Attorney General Cole.

A jury in Cleveland today convicted 16 people, all residents of Ohio, of federal hate crimes arising out of a series of religiously-motivated assaults on practitioners of the Amish religion, the Justice Department announced.

The Justice Department announced today that it has moved to intervene in a class action lawsuit regarding conditions of confinement at the Orleans Parish Prison (OPP), a pre-trial and correctional facility in New Orleans. The litigation seeks to address conditions that violate the U.S. Constitution and Title VI of the Civil Rights Act of 1964. The department seeks remedies to correct inadequate medical, mental health care and suicide prevention practices; failures to protect prisoners from physical and sexual violence; deficiencies in environmental health and safety; and inadequate language access services for Latino prisoners with limited English proficiency (LEP).

"As history has consistently shown us, the most successful societies are those in which women are not only engaged in decision-making processes, but also empowered to assume larger roles and participate more broadly in society," said Attorney General Holder.

Attorney General Eric Holder and the Department of Justice’s Bureau of Justice Assistance Director Denise E. O’Donnell today announced more than $11 million in awards to address neighborhood-level crime in 15 locations nationwide.

The Justice Department announced today that it has filed a Fair Housing Act lawsuit against the owners and manager of approximately two dozen rental homes in Washington, N,C., alleging that the manager, William I. Cochran III, discriminated against African-American tenants.

The Department of Justice announced today that it will require Standard Parking Corporation and Central Parking Corporation to divest their interests in certain off-street parking facilities in 29 cities in 21 states in order to proceed with Standard’s acquisition of Central.

A Pennsylvania corporation pleaded guilty today to participating in a conspiracy to rig bids for the sale of tax liens auctioned by municipalities throughout New Jersey.

The U.S. Department of Justice and Federal Trade Commission (FTC) signed an antitrust memorandum of understanding (MOU) with the Government of India Ministry of Corporate Affairs and the Competition Commission of India (CCI) to promote increased cooperation and communication among competition agencies in both countries.

The Justice Department announced today that it reached an agreement with Diversified Maintenance Systems LLC, a provider of janitorial and facilities maintenance services based in Tampa, Fla. The agreement resolves allegations that the company violated the anti-discrimination provision of the Immigration and Nationality Act (INA) when it failed to fully reinstate an employee in retaliation for asserting her right to work in the U.S.

The Department of Justice, the Congress of Hispanic Educators (CHE) and the Denver Public Schools (DPS) have jointly requested court approval of a consent decree that requires that the more than 20,000 English Language Learner (ELL) students enrolled in DPS receive the services they need to overcome language barriers and meaningfully participate in school. The proposed consent decree will benefit all ELLs and LEP parents in the district, including not only the 87 percent of ELL students who are native Spanish speakers, but those who speak one of the 137 other languages spoken in the district as well.

Attorney General Eric Holder today announced $58 million in Second Chance Act grant funding to reduce recidivism, provide reentry services, conduct research and evaluate the impact of reentry programs.

Under a settlement announced today by the Department of Justice and the U.S. Environmental Protection Agency (EPA), Durand Glass Manufacturing Company Inc. has agreed to install emissions controls on its three glass furnaces that will reduce more than 173 tons of nitrogen oxides (NOx) and 23 tons of particulate matter (PM) per year.

The Justice Department announced that it has entered into a settlement agreement with the Northeastern Local School District in Springfield and South Vienna, Ohio, to resolve allegations of racial harassment of African-American students in the district. The district serves approximately 3,700 students, less than two percent of whom are African-American.

Attorney General Eric Holder, Deputy Attorney General James Cole, U.S. Attorney for the District of Maryland Rod Rosenstein, and Bureau of Justice Assistance Deputy Director, Kristen Mahoney, today announced more than $2.4 million in grants to 13 jurisdictions to combat the purchase and sale of counterfeit and pirated products. Intellectual Property theft refers to the violation of criminal laws that protect copyrights, patents, trademarks, other forms of intellectual property and trade secrets, both in the United States and abroad.

"Imitation may be the highest form of flattery, but American industry is not looking to be flattered by thieves engaged in illicit competition. Industry seeks a fair and level marketplace where American innovation can thrive," said Deputy Attorney General Cole.

The Justice Department announced today that it has entered into a settlement to resolve allegations that the city of Selma, Texas violated Title VII of the Civil Rights Act of 1964 by engaging in retaliation against a firefighter for filing a complaint against a superior for using ethnic slurs in the workplace.

"Several years ago, our Office for Victims of Crime funded the Clery Center to develop a training curriculum for university administrators and law enforcement executives about the requirements of the Clery Act. The Center continues to deliver the training throughout the country," said Acting Assistant Attorney General Leary.

The Justice Department today filed a lawsuit against the homeowners association and former manager of a 249-townhome community in Gibsonton, Fla., for violating the Fair Housing Act by discriminating against families with children.

The Justice Department today reached an agreement with Tuscany Hotel and Casino LLC in Las Vegas resolving a lawsuit alleging that the company discriminated in the employment eligibility verification and re-verification process. The Immigration and Nationality Act (INA) requires employers to treat all authorized workers equally during the hiring, firing and employment eligibility verification process, regardless of their national origin or citizenship status.

The United States has filed a complaint against three related companies that bought and sold consumer credit reports, the Justice Department announced today. The government’s complaint charges these companies with violating the Fair Credit Reporting Act (FCRA). The companies have agreed to pay a $1.2 million civil penalty to resolve these charges.

The Justice Department reached four settlement agreements with over-the-road bus companies in Florida in the last month, to ensure that bus transportation is accessible for people with disabilities. The settlements under the Americans with Disabilities Act (ADA) are with Dynamic Tours &s Jet Tours Corp./Pegasus Transportation.

The Justice Department announced today that it has filed a lawsuit against the state of Vermont and its chief election official to help ensure that military service members, their family members and U.S. citizens living overseas have the opportunity to participate fully in the Nov. 6, 2012 federal general election.

Police of Puerto Rico Lieutenant Erick Rivera Nazario and Officer Jimmy Rodriguez Vega were indicted on civil rights charges alleging that they used excessive force on two men, the Justice Department announced today. Nazario and Vega allegedly violated the constitutional rights of Jose Irizarry Perez and his father Jose Irizarry Muniz while the two were celebrating the local election results at the Las Colinas housing development in Yauco, Puerto Rico, on Nov. 5, 2008. Rivera was also indicted for making false declarations before the federal grand jury during its investigation into the civil rights violations.

The Justice Department today announced an agreement with the city of North Adams, Mass., to improve access for people with disabilities to civic life in North Adams. The agreement was reached under Project Civic Access (PCA), the Justice Department’s initiative to ensure that cities, towns and counties throughout the country comply with the Americans with Disabilities Act (ADA). The compliance review was initiated in response to a complaint that the city’s police station was physically inaccessible.

The owner of a 28-acre piece of property on the Mohawk River and the owner of a New Jersey solid waste management company were found guilty by a federal jury in Utica, N.Y., today of charges that they conspired to defraud the United States and violate the Clean Water Act by illegally dumping thousands of tons of asbestos-contaminated construction debris on the property in upstate New York.

"As we continue to work with reentry projects and learn about them, we realize more and more that they need to be sustained and continuous if they are to be successful. They need to start the first day an individual arrives at the prison," said Deputy Attorney General Cole.

A federal judge issued an order today allowing the Justice Department to intervene in a disability discrimination lawsuit against the Law School Admission Council (LSAC). The department’s intervention expands the case from a statewide class action limited to California residents to a nationwide pattern or practice lawsuit.

The Justice Department announced today that it will monitor portions of the early voting period for the Nov. 6, 2012, general election in Dallas and Harris Counties, Texas, to ensure compliance with the Voting Rights Act of 1965. The Voting Rights Act prohibits discrimination in the election process on the basis of race, color or membership in a minority language group. Early voting in Dallas and Harris Counties begins on Monday, October 22.

The Justice Department and U.S. Attorney Thomas G. Walker announced today the filing of a complaint in U.S. District Court for the Eastern District of North Carolina against the Warren County, N.C., Board of Education for violating the employment rights of Army Reserve Sergeant Dwayne Coffer under the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA).

The United States has filed a complaint against Jacintoport International LLC under the False Claims Act in connection with a warehousing and logistics contract for the storage and redelivery of humanitarian food aid, the Justice Department announced today. Jacintoport is a cargo handling and stevedoring firm headquartered in Houston.

The Justice Department today announced that the town of East Haven, Conn., memorialized its intention to enter into a settlement agreement to resolve the department’s civil investigation of allegations that the East Haven Police Department (EHPD) engaged in a pattern or practice of unlawful discrimination against Latinos on account of their race, color or national origin. The proposed agreement also resolves allegations that EHPD engaged in a pattern or practice of use of excessive force, unconstitutional searches and seizures and retaliation against persons who witnessed police misconduct or criticized EHPD’s practices.

"At the Department of Justice, we are fully aware of how critically important, and oftentimes life-saving, this work really is for countless children nationwide," said Deputy Attorney General Cole.

The Justice Department filed a lawsuit today against the city of Meridian, Miss.; Lauderdale County, Miss.; judges of the Lauderdale County Youth Court; and the state of Mississippi alleging that the defendants systematically violate the due process rights of juveniles.

The Justice Department announced today that it reached a settlement with Mrs. K’s Tollhouse Restaurant of Silver Spring, Md., to remedy alleged violations of the Americans with Disabilities Act (ADA). The agreement resolves allegations that the restaurant failed to remove architectural barriers that made parts of it inaccessible to people with disabilities, including those who use wheelchairs.

R. Dale Frazier, 57, of Flora Vista, N.M., pleaded guilty today in U.S. District Court in Albuquerque, N.M., to a federal civil rights charge in connection with the unlawful assault and beating of Dovovan Tanner with a flashlight.

Emmett McKenzie, 31, from Montezuma, Ga., formerly a sergeant at Macon State Prison in Oglethorpe, Ga., pleaded guilty to conspiring with other correctional officers to violate the civil rights of an inmate in 2010, the Justice Department Announced today. McKenzie, who most recently served as a lieutenant at Dooly State Prison in Unadilla, Ga., is the third officer to plead guilty in the course of the ongoing federal investigation.

A federal jury late last night convicted two Harlan County, Ky., men on federal kidnapping charges and conspiracy charges, exposing them to a maximum of life imprisonment. The jury also acquitted the men of violating the sexual orientation provision of the Matthew Shepard James Byrd, Jr. Hate Crimes Prevention Act. David Jason Jenkins, 37, and Anthony Ray Jenkins, 20, were convicted on the kidnapping and conspiracy charges for their roles in kidnapping and assaulting 28-year-old Kevin Pennington, a gay man.

The Justice Department announced today that it reached an agreement with Advantage Home Care LLC, a home health care provider based in Hackensack, N.J., resolving claims that the company violated the anti-discrimination provision of the Immigration and Nationality Act (INA), when it required newly-hired lawful permanent residents to provide more or different documents during the Form I-9 employment eligibility verification process.
